2.18<br />

DOMESTIC PARTNER<br />

Effective July 1, 2002, a Domestic Partner means an individual with<br />

respect to whom the following requirements are met:<br />

(a) Such individual is designated by an Active, Disabled, or Inactive<br />

Member as a Domestic Partner by one of the following methods:<br />

(i) The domestic partnership of such individual and Member is<br />

registered with the State of California, and a copy of the<br />

applicable valid State registration form(s) is filed with the<br />

University, or<br />

(ii) A valid Declaration of Domestic Partnership, University of<br />

California Retirement Plan, or such other form as required by<br />

the University, is filed by such Member with the University,<br />

and supporting documentation that demonstrates the<br />

existence of the domestic partnership at the time of filing is<br />

provided to the University by the Member in accordance with<br />

the Plan Regulations.<br />

(b) On the date of and at all times after Section 2.18(a) is met, the<br />

Member and the individual designated as his or her Domestic<br />

Partner satisfy the following requirements:<br />

(i) Each is the other’s sole Domestic Partner in a long-term,<br />

committed relationship and intends to remain so indefinitely<br />

(ii) Neither is legally married, and they are not related by blood to<br />

a degree of closeness that would prohibit legal marriage in the<br />

State of California<br />

(iii) Each is age 18 or older and has the ability to consent to the<br />

relationship<br />

(iv) They reside together and intend to reside together indefinitely<br />

(v) They are financially interdependent<br />

(c) The filing of any form or documentation with the University under this<br />

Section 2.18 shall be subject to the requirements set forth in the<br />

Plan Regulations. The University may add additional requirements<br />

or procedures for establishing the eligibility of a Domestic Partner in<br />

the Plan Regulations. An individual shall not be a Domestic Partner<br />

unless such requirements are satisfied with respect to such person.<br />
