ELIGIBLE SPOUSE<br />

expectancy) of the Member or the joint lives (or joint life<br />

expectancies) of the Member and the Member's Contingent Annuitant<br />

or person eligible for the Postretirement Survivor Continuance or for<br />

a specified period of ten years or more;<br />

(b) any distribution made in accordance with the Minimum Distribution<br />

Rule described in Section 2.36; and<br />

(c) any other distribution that applicable law does not permit to be rolled<br />

over.<br />

An Eligible Rollover Distribution is only payable to a Member, surviving<br />

spouse, spouse or former spouse who is the alternate payee under a<br />

qualified domestic relations order, or to an Eligible Retirement Plan as<br />

specified by such aforementioned person.<br />

Eligible Spouse means the widow or widower of a deceased Active<br />

Member or Disabled Member who was married to such Member for at<br />

least one full year before the Member's date of death, and who:<br />

(a) has care of an Eligible Child who is disabled or under the age of 18;<br />

additionally, for a widow or widower of a Member who entered the<br />

Plan prior to July 1, 1979, has care of an Eligible Child under the age<br />

of 22 who is attending an educational institution on a full time basis;<br />

(b) is disabled; or<br />

(c) is or attains age 60, except that a widow of such Member who<br />

became a Member before October 19, 1973, and who did not elect to<br />

become a Member with Coordinated Benefits, shall be eligible upon<br />

attainment of age 50, if married to the Member before October 19,<br />

1973.<br />

If a spouse has care of an Eligible Child who is the natural child of such<br />

Member, the one year marriage requirement is waived indefinitely as<br />

long as the child is eligible.<br />

For the purposes of this Section, "disabled spouse" means a medically<br />

determinable physical or mental impairment which prevents the person<br />

from engaging in substantial gainful activity, as determined by the Plan<br />

Administrator in accordance with Plan Regulations.<br />
