University of California Retirement Plan Article 5<br />
Service Credit must be received by the Plan Administrator by the<br />
later of July 1, 2000 or within 3 years after first returning to University<br />
employment as an Active Member from the Leave, but only while an<br />
Active Member of the Plan. Failure to elect to establish Service<br />
Credit within the prescribed period shall constitute an irrevocable<br />
waiver of the right to establish Service Credit for such Leave period.<br />
Payments must be completed while an Active Member over a period<br />
of 1, 2, 3, 4, or 5 years from the date of the election in accordance<br />
with Plan Regulations. The Plan Administrator may implement<br />
regulations on procedures for establishment of Service Credit<br />
including, without limitation, how the 3-year rule, the 5-year rule and<br />
minimum length of payment period rule shall be applied.<br />
Payments made to establish Service Credit under this Section shall<br />
be made as follows:<br />
(i) For elections to establish Service Credit received by the Plan<br />
Administrator on or before June 30, 1997, payments shall be<br />
made only on an after-tax basis.<br />
The following provisions shall apply if the payment schedule is<br />
not completed:<br />
(A) if an Active Member chooses to rescind an election or<br />
fails to cure a default in the payment schedule within 90<br />
days of default, then the Active Member shall receive a<br />
proportionate amount of the Service Credit eligible to be<br />
established based on the ratio of the amount actually<br />
paid to the total amount of payments required.<br />
(B) if a Member is no longer an Active Member of the Plan<br />
due to retirement, death, disability, or separation from<br />
service, such Member shall receive a proportionate<br />
amount of the Service Credit eligible to be established<br />
based on the ratio of the amount actually paid to the total<br />
amount of the payments required.<br />
(ii) For elections to establish Service Credit received by the Plan<br />
Administrator on or after July 1, 1997, payments shall be made<br />
only on a pretax basis in accordance with IRC §414(h) and are<br />
deemed to be employer pick-up contributions.<br />
Payments on a pretax basis shall be made by an Active<br />
Member's binding irrevocable payroll authorization and such<br />
Member shall not have the option to make lump sum or<br />
