SUMMARY OF BUSINESS TRANSACTED BY THE GOA LEGISLATIVE ASSEMBLY DURING THE SECOND SESSION OF JUNE-JULY-AUGUST, 2004 MONDAY 28 JUNE, 2004 The Second Session of the Fourth Legislative Assembly of the State of Goa commenced at the Assembly Hall, Porvorim at 2.30 p.m. on Monday 28 June, 2004. Shri Vishwas Satarkar, Speaker was in the Chair, (Second Session of the Fourth Legislative Assembly &as summoned on 27 May, 2004). \ I. NATIONAL ANTHEM The National Anthem was recited by the Members. / 11. QUESTIONS (i) Shri Manohar Parrikar, the Chief Minister asked for postponement of Starred Question Nos. 1,10 and Unstarred Question No. 9 for answer on 7/7/2004. I (ii) Shri Matanhy Saldanha, 'Minister for Tourism, Sports & Youth Affairs made corrections 10 Starred Question No. 2. (iii) Two postponed Starred Qdestions and Five Starred Questions were replied orally. RULING I have received a notice dated 27.6.2004 of Adjournment Motion for suspending the Question Hour for serious charges and abuse and misuse of the highest constitutional office in the State of Goa as reported on Indian Express dated 27/6/2004 by the off~ce of the Governor. The signatories are Shri. Luizinho Faleiro and Shri. Jitendra Deshprabhu. The Adjournment Motion confines to the aspect related to the office of the Governor. As per item (vi) of sub-rule 2 of Rule 278 of the Rules of Procedure and Conduct of Business of the Goa Legislative Assembly, the discussion shall ndt reflect upon the conduct of the Governor. I I would like to quote Kaul and Shakdhar vide page 512 " It has been held by the Speaker from time to time that the following I matters could not be raised by way of Adjournment Motion: Conduct of the Presideint or any action taken by him I Conduct of the ~ovedor of a State" and Conduct of the Speaker or an order passed by the Speaker Further as per Kaul an4 Shakdhar vide page 503, " Press reports unless admitted by Government cannot be accepted as authoritative for the purpose of an adjoumrbent motion'.. Secondly the matter rail ed in the adjournment motion is required to be of a specific matter of recent P occurrence. The notice does not speak about the specific issues to bh taken-up and besides the matter is not of recent occurrence. I therefore feel that matter raised in the notice does not warrant the disturbanck of the regular Business of the House and take UP- I therefore, disallow the notice for Adjournment Motion. Owing to pandemonium in the House, the Speaker adjourned the House again at 3:40 The House reassembled at 4:35 p.m. IV. MOTION FOR CONGRATULATON SIShri Dayanand G.
