A Brief Report of the Second Session (June-July-August), 2004<br />

of the Fourth <strong>Legislative</strong> <strong>Assembly</strong> of theistate of <strong>Goa</strong>.<br />

The Second Session (June - July - August), 2004 of the Fourth<br />

<strong>Legislative</strong> <strong>Assembly</strong> of the State of <strong>Goa</strong> commenced at the <strong>Assembly</strong> Hall,<br />

Porvorim on Monday the 28th June, 2004 and had twentysix sittings. The<br />

House was adjourned sine-die on the 2nd August, 2004 and later prorogued<br />

on 6th August, 2004. The total time taken for the business of the sittings was<br />

97 hours and 08 minutes.<br />

MOTION FOR CONGRATULATION<br />

The House congratulated Dr. Manmohansingh, for being sworn in as a<br />

Prime Minister of the Country.<br />

FINANCIAL BUSINESS<br />

General Discussion and Voting on 85 Demands for Grants (including<br />

three Charged Demands) for the year 2004-2005 took place for 15 days i.e.<br />

on7,8,12,13,14,15,19,20,21,22,26,27,28,29th July and 2nd August, 2004 and<br />

passed the connected <strong>Goa</strong> Appropriation (No.2) Bill on 2nd August, 2004.<br />

SUPPLEMENTARY DEMANDS FOR GRANTS<br />

The Second Batch of Vo e on Account 2004-2005 was presented,<br />

discussed and passed on 28th Ju h ,2004. Thirty Supplementary Demands for<br />

Grants for the year 2004 -20055( irst Batch) were presented to the House on<br />

29th July,2004 and discussed and passed on 2nd August, 2004.<br />

The Second Session of the Fourth <strong>Legislative</strong> <strong>Assembly</strong> of the State of<br />

<strong>Goa</strong> commenced at the <strong>Assembly</strong> Hall, Porvorim at 2.30 p.m. on Monday 28<br />

June, 2004. Shri Vishwas Satarkar, Speaker was in the Chair, (Second Session<br />

of the Fourth <strong>Legislative</strong> <strong>Assembly</strong> &as summoned on 27 May, 2004).<br />

I have received a notice dated 27.6.2004 of Adjournment Motion for<br />

suspending the Question Hour for serious charges and abuse and misuse<br />

of the highest constitutional office in the State of <strong>Goa</strong> as reported on<br />

Indian Express dated 27/6/2004 by the off~ce of the Governor. The<br />

signatories are Shri. Luizinho Faleiro and Shri. Jitendra Deshprabhu. The<br />

Adjournment Motion confines to the aspect related to the office of the<br />

Governor. As per item (vi) of sub-rule 2 of Rule 278 of the Rules of<br />

Procedure and Conduct of Business of the <strong>Goa</strong> <strong>Legislative</strong> <strong>Assembly</strong>,<br />

the discussion shall ndt reflect upon the conduct of the Governor.<br />

I would like to quote Kaul and Shakdhar vide page 512<br />

" It has been held by the Speaker from time to time that the following<br />

matters could not be raised by way of Adjournment Motion:<br />

Conduct of the Presideint or any action taken by him<br />

Conduct of the Speaker or an order passed by the Speaker<br />

Further as per Kaul an4 Shakdhar vide page 503, " Press reports unless<br />

admitted by Government cannot be accepted as authoritative for the<br />

purpose of an adjoumrbent motion'..<br />

Secondly the matter rail ed in the adjournment motion is required to be of<br />

a specific matter of recent<br />

occurrence. The notice does not speak about<br />

the specific issues to bh taken-up and besides the matter is not of recent<br />

occurrence. I therefore feel that matter raised in the notice does not<br />

warrant the disturbanck of the regular Business of the House and take<br />

I therefore, disallow the notice for Adjournment Motion.<br />

Owing to pandemonium in the House, the Speaker adjourned the<br />

House again at 3:40 The House reassembled at 4:35 p.m.<br />

These motions relate to religious aspects and may not be of general<br />

public interest. Therefore being a sensitive issue I directed my Secretariat<br />

As per Kaul and Shakdhar page 667 the following is relevant:<br />

"The general rule regarding motions is that a motion must not raise a<br />

question substantially identical with one on which the House has already<br />

given a decision inlthe same session."<br />

Further Rule 37 (6)' provides that it shall not repeat in the same session<br />

in substance questions already answered or to which an answer Qs<br />

been refused.<br />

However, considering the urgency of the matter I am reidy to convert<br />

this motion into Shdrt duration under Rule 64 of the Rules of procedure,<br />

if the Members agrhes. We can take-up the discussion at 6.30 p.m. far<br />

one hour after finishing discussion and voting on Demands. Discussiop<br />

on Demands will have to be stopped at 6.00 p.m. so that Ministers would<br />
