Alter being tangled in a maze <strong>of</strong><br />

lawsuits, CQuntersuits and arbitration,<br />

a $1.5 million Qut-af-court settlement<br />

ended a year and a half <strong>of</strong><br />

litigation over the leaking Kibbie Dome<br />

rool.<br />

Patrick Sullivan, the lawyer handling<br />

the case lor the university, said the<br />

agreement provided for a lump-sum<br />

payment to the university and prohibits<br />

all parties involved from Wing further<br />

claims.<br />

President, said that while the $1.5 will<br />

not cover the costs <strong>of</strong> repairing the<br />

dome, it will save the university money<br />

in the long run.<br />

"I saw an awiullot <strong>of</strong> future costs from<br />

consultants' and attorneys' fees if we'd<br />

pursued this in court. And I'm not sure<br />

the reward would go up," McKinney<br />

said.<br />

The university was asking for $11.2<br />

million from the dome's builder, Emerick<br />

Construction <strong>of</strong> Portland, and its architect,<br />

Cline Smull, Hamill Associates<br />

<strong>of</strong> Boise.<br />

In a suit filed in June <strong>of</strong> 1981, the<br />

university claimed that defects in the<br />

workmanship caused the dome ro<strong>of</strong> to<br />

leak and, that the design was in<br />

violation <strong>of</strong> <strong>Idaho</strong>'s Uniform Building<br />

Code.<br />

The action spawned a confusing array<br />

<strong>of</strong> counter-suits that drew Emerick's in­<br />

~urance company - Aetna Casualty<br />

and Surety - and a number 01 subcontractors<br />

and suppliers into the fray.<br />

Meanwhile, the university had been<br />

paying lor dome repairs out <strong>of</strong> a capital<br />

improvement fund.<br />

About $650,000 was spent on temporary<br />

ro<strong>of</strong> repairs, and during the summer<br />

a new, permanent rool was built at a<br />

cost <strong>of</strong> nearly $1 million.<br />

In the fall, eight contractors were<br />

hired to repair water damage inside the<br />

dome and correct building code<br />

violations, adding another $560,000 to<br />

the repair bill.<br />

The final price tag for fiXing the ro<strong>of</strong>,<br />

including fees for attorneys and consultants<br />

totaled well over $2 million according<br />

to McKinney. 0<br />
