INTRODUCTION<br />
NEW FINDS AND WINES TO LOOK OUT FOR<br />
Welcome to the <strong>Classic</strong> Vintners Wine Portfolio<br />
for 2012/13.<br />
In this year’s Portfolio, we have introduced many new<br />
wines that are exclusive to <strong>Classic</strong> Vintners and also<br />
exclusive to Bars, Restaurants and Pubs.<br />
Feedback from our customers told us that there was an<br />
increasing demand for more premium quality House<br />
wines, both traditional varietal wines and also more<br />
unusual and interesting varietals that match really<br />
well with a wide range of foods.<br />
I have selected three new ranges of premium quality<br />
House wines, from Spain, Italy and France that I am<br />
sure you will find of interest.<br />
Spain<br />
All 3 wines come from the Campo de Borja region in the North of<br />
Spain, sitting just below the Rioja region.<br />
Campo Castillo Garnacha red – full flavoured red but with soft<br />
tannins and ripe fruit flavours.<br />
Campo Castillo Viura white – delicious minerally white wine, dry<br />
but with excellent fruit flavours and balance.<br />
Campo Castillo Garnacha Rose - really fruity rose with lots of<br />
strawberry fruit character.<br />
Italy<br />
Villa Calvino Sangiovese red (from Puglia) – full flavoured red,<br />
great with rich tomato or bolognese sauces. Produced from the<br />
same grape variety as Chianti.<br />
Villa Calvino Catarratto white (from Sicily) – lovely aromatic<br />
dry white with delicious peachy fruit character.<br />
Villa Calvino Chiaretto rose (from Piemonte) – subtle dry rose<br />
but with excellent fruit and good length of flavour.<br />
Other finds to look out for in this year’s Portfolio<br />
Chile – Santa Alicia Reserva Sauvignon, Carmenere and a really<br />
delicious Malbec.<br />
South Africa – Red & White Rhino varietals from a<br />
winery that supports the Save the Rhino International Charity<br />
with contributions from its sales of Rhino wines.<br />
Also an excellent range from Franschhoek Estate – Shiraz, Merlot<br />
& Sauvignon Blanc.<br />
Australia – new range from the excellent Grant Burge winery<br />
in Barossa - Shiraz, Chardonnay and Rose.<br />
France – Pinot Noir and Viognier from Lunes Estates in the<br />
Languedoc, a stunning Corbieres from Castelmaure and Picpoul<br />
de Pinet from L’Ormarine.<br />
Italy – super Barolo from Fontanafredda and delicious Gavi<br />
from La Luciana.<br />
Spain – full flavoured rich red from Bodegas Lozano in<br />
La Mancha.<br />
New Zealand – fine stylish wines from Esk Valley –<br />
Sauvignon and a great Merlot/Cabernet/Malbec blend<br />

France<br />
Fontaine de la Tour is a range of easy drinking fruity wines, all with<br />
excellent varietal character, great on their own or with a variety of<br />
different food styles.<br />
Sauvignon Blanc – light dry fruity Sauvignon<br />
Chardonnay – unoaked with delicious fruit flavours and good<br />
length.<br />
Syrah Rose – light dry but fruity rose<br />
Grenache/Syrah – a delicious fruity blend with soft tannins – very<br />
easy to drink !<br />
Merlot – soft supple Merlot but with typical berry fruit character.<br />
David has over 35 years Buying experience in the Wine Trade, Training<br />
with Grants of St James’s and working for many large wine importers<br />
and retailers, including Chalie Richards, Morrison’s, Greenalls (Parisa<br />
Group) and Boutinot’s. David also ran his own Wine Bar and<br />
Restaurant in the late 80’s in Surrey.<br />

Producing your wine list together to increase<br />
your profits...<br />
Creating the correct wine offer for your outlet is one of<br />
the most important things you can do. Your wine<br />
choices represent you and your business; the wines you<br />
offer should always be chosen with delighting your<br />
customer in mind.<br />
That’s why at <strong>Classic</strong> Vintners we provide help and<br />
support through all stages of your list. We see it just<br />
like building a relationship.<br />
1. The first date Get in touch, and someone from <strong>Classic</strong> will<br />
come and see you at a time to suit you, this will be at your venue.<br />
We will chat with you about your business, your customers, your<br />
current wine offer, and basically get to know you. In return all we<br />
ask is that you put the kettle on! Don’t worry if you have limited<br />
wine knowledge, our team have great knowledge, if you do know<br />
lots about wine, that’s great too, we love talking about wine.<br />
2. The proposal After getting to know you and your business<br />
we will make a proposal, don’t order the hat just yet though, there’s<br />
still a long way to go! The initial proposal may sound like, would<br />
you like me to recommend like for like wines on your existing<br />
offer? Would you like us to refresh your list by introducing some<br />
new categories and keeping what works, or do you want to work<br />
together on building an offer from scratch to really maximise your<br />
offer? Often we end up doing a bit of all 3, it’s at this point we start<br />
to talk about money! Don’t worry its not going to cost you anything,<br />
here’s where we will talk you through the different margin<br />
opportunities to think about when doing the list, we do hundreds<br />
of lists every year so the team will be able to share lots of best<br />
practice and ideas. We have pre designed suggested lists for spicy<br />
foods, hotels, wedding venues etc. just to help the process along.<br />
3. Planning the Wedding A stressful time for many, but not<br />
when working with wine, this is when you get to start tasting. If you<br />
are unsure about any of the wines the team will taste them with<br />
you and give you information on the product and profitability.<br />
With your <strong>Classic</strong> contact you will start to work on the layout of<br />
the list, How many bins, red, white, rose split, House selections, by<br />
the glass offers, tasting notes, pricing. You will have 100%<br />
autonomy over what price you charge, our team will make<br />
suggestions about what GP to aim for and what cash per bottle you<br />
can command, they will share best practise from other customers<br />
on how to make wine more profitable. You will be surprised<br />
what a few tips on pricing, layout and selection can do for your<br />
bottom line.<br />
4. Choosing the theme and making initial commitments<br />
Once we know the range and pricing that are right for the business<br />
we can start to look at the design of the actual list. The look and<br />
feel of your wine list is key, lots of customers will interact with it so<br />
it’s important that it’s designed with them in mind. We have our<br />
own in house design team that enables us to meet your needs and<br />
wow your customers, we will have examples of previous lists to<br />
share or we can work up a design totally from scratch, don’t worry<br />
too much if you don’t have a design degree, again our team are<br />
very experienced and will make sure you and your customer get<br />
what they want. You can list by country, by grape varietal or even<br />
by style. There’s no problem reproducing lists from other printers.<br />
5. The rehearsal and last minute jitters It’s nearly the big<br />
day, we will get proofs to you of your list, you can still make last<br />
minute changes, maybe a price tweak here and there or an<br />
additional wine that your customers have requested can still be<br />
included. At this stage, or more usually after a change we can also<br />
offer staff training, this will really focus your team on up selling the<br />
more profitable wines in your cellar by communicating with<br />
customers and recommending wines.<br />
6. The big day You have your new list, your new wines and<br />
you’re ready to go! It won’t be the last you see of <strong>Classic</strong> drinks<br />
though, we will continue to call on and support your account<br />
taking you through the latest trends and recommending wines of<br />
the month that you in turn can recommend to your customer, we<br />
will let you know about any additions to our portfolio too.<br />
7. The Anniversary It’s always a good idea to keep refreshing<br />
your list and after a year that’s exactly what we would like to do,<br />
check your margins, check your volumes and look at any changes<br />
that will add value to what you do. We look forward to many<br />
happy anniversaries with you as our partner.<br />
Remember, we don’t have to drink wine, but we choose to do so<br />
because it’s enjoyable, you should enjoy selecting your wines and<br />
your customers should enjoy drinking them, we should also enjoy<br />
being your supplier. Getting your wine right will make a big<br />
difference to your cash earnings. Now this is the hard part for a<br />
Yorkshire man to say…….the above service is offered free<br />

For a typical Country Pub I would recommend grape varieties<br />
from New World, but keeping the price reasonable as people want good<br />

wines to extend the choice for the customer, and to offer the outlet a point<br />

Customers in City Centre Bars are not particularly food led, and it’s<br />
likely the outlet will sell lots by the glass. The demographic of a City<br />
Centre Bar is usually young, so I've gone with lots of New World and<br />
trendy but recognisable varietals such as Australian Shiraz, Chilean<br />
Merlot, Italian Pinot. For traditionalists I have chosen a great Rioja and<br />
a Chablis as well as a great value high margin Prosecco.<br />

The best wines for Asian Food outlets are those with moderate levels of<br />
alcohol, softer tannin and sometimes off dry in style. It is a question of<br />
harmony and balance within the context of hot, sour, salty and sweet<br />
food sensations. I have picked a range of wines from our new extensive<br />
portfolio which I think will pair well with Asian foods such as, Seifried<br />
Estate Gewurztraminer from New Zealand and Viognier from Lunes<br />
in the Languedoc.<br />

FOR VARIOUS OUTLET STYLES<br />
<strong>Classic</strong> Vintners offer a complete Wine List service to<br />
any customer who buys their range exclusively from<br />
<strong>Classic</strong> Vintners. This service is free of charge.<br />
Customers have the choice of many different styles of<br />
wine list to choose from which can be personalised<br />
with outlets name, logo and picture. All customers<br />
have to do is contact our Telesales Dept or Territory<br />
Manager and make an appointment to discuss the<br />
various options.<br />
Wine Development Managers are also on hand to<br />
offer help and advice when compiling wine lists to<br />
ensure that all customer needs are catered for. <strong>Classic</strong><br />
Vintners have a wealth of on trade, and commercial<br />
wine knowledge, which when combined with<br />
individual outlet requirements, guarantees a winning<br />
formula for your wine list.<br />
Support is continued with ongoing advice and product<br />
awareness in the form of product tastings, staff training<br />
and regular sales analysis to make sure your wine list<br />
remains fresh and interesting.<br />

Wine Lists are available in any style within A3 proportions.<br />
Lists can be presented in portrait or landscape formats to freestand<br />
on tables or bar areas. The size of a list is determined by the<br />
number of products and can carry an outlets identity or house<br />
style, any colour can be matched from a pantone swatch. A choice<br />
of gloss or matt laminate are available for a lists protection and<br />
high quality finish.<br />
Tent Cards are available for selected wine ranges, particularly<br />
useful for Wine of the Month promotions. Please ask your Wine<br />
Development Manager or your Telesales Department for details.<br />
Wine List Presenters are available in a leather style and carry<br />
clear plastic sleeves to display single or double sided sheets in A4<br />
or A5 sizes. The wine list presenters come in a number of colours,<br />
the cover is printed in a choice of gold or silver.<br />
Own Labelled House Wine is available for customers<br />
purchasing a full range of wines, exclusively from <strong>Classic</strong> Vintners.<br />
We are able to offer our 75cl Marechal Vin de Pays range with a<br />
customised House Wine label. Wines are supplied with a back<br />
label, which includes all legal requirements together with a supply<br />
of self adhesive labels. Due to minimum print runs for labels,<br />
we have to apply a minimum order requirement of 200 cases<br />
(12 x 75cl) per style, to be taken over a 12 month period.<br />

DEVELOPED WITH OUR CUSTOMERS
Creating a Wine List<br />
Most of our customers still plan their wine lists in a traditional<br />
manner, listing House Wines first and then their remaining wines<br />
by colour and country of origin.<br />
This is fine for some consumers but it is not always the most<br />
informative way for many, who have limited wine knowledge and<br />
no way of knowing whether Bordeaux red from St Emilion is light<br />
and fruity or full bodied or whether Chilean Riesling is dry or<br />
medium sweet.<br />
One answer is to compile your wine list by Wine Style.<br />
This is becoming increasingly popular in many restaurants and in<br />
particular Gastro Pubs.<br />
You can always start with a House Wine section first, if required,<br />
with tasting notes as a guide to style – dry crisp white, fruity white<br />
etc.<br />
The main body of the list can then be organised by wine style:<br />
Light dry white: Chablis, Gavi etc.<br />
Aromatic dry white: Sancerre, Pinot Grigio<br />
Fruity dry white: Unoaked Chilean Chardonnay<br />
Spicy white: Gewurztraminer<br />
Fruity medium white: Vouvray<br />
Light bodied fruity red: Valpolicella, Merlot Veneto,<br />
Beaujolais<br />
Medium bodied fruity red: Chilean Merlot<br />
Medium bodied oaked red: Rioja Crianza<br />

The descriptions can be short and simple (dry crisp white) or<br />
longer and more precise (herbaceous, aromatic dry white),<br />
whatever suites your style.<br />
The major benefit of this type of list is that it makes choosing a<br />
wine much easier for those customers with only a limited<br />
knowledge of wine and makes the whole experience much less<br />
of a lottery for them. You could also add a taste guide:<br />

From Médoc to Languedoc<br />
Since 2002 when the Fabre family took over<br />
Château d'Anglès, they have succeeded in revealing the<br />
true potential of this vineyard and now have a range of<br />
award winning wines to show for their enthusiasm<br />
and commitment.<br />
With a lifetime in wine making, Eric Fabre's career<br />
includes eight years as Technical Director of Château<br />
Lafite Rothschild, as well as taking a much lesser known<br />
Médoc label to the highest accolades in only six years.<br />
It was however, a lifelong dream to own a vineyard on the<br />
Mediterranean, so 2001 saw Eric and his wife Christine<br />
hunting from Perpignan to Nîmes for a high quality<br />
terroir. They were quickly seduced by the<br />
Château d'Anglès, and what a very understandable<br />
temptation! The beautiful ancient stone farmhouse of<br />
Château d'Anglès overlooks the vines that slope gently<br />
down to the shores of the Mediterranean. Hard really to<br />
imagine a more idyllic setting and just as hard to imagine<br />
a family more passionately dedicated to the constant<br />

The Loire region is most famous for its excellent white wines and refreshing roses. Whites vary<br />
from fine Sauvignon's in Sancerre and Touraine and flinty, minerally Muscadet from the area<br />
around Nantes. Muscadet in its Sur Lie form (aged on its lees) can be the perfect wine to drink<br />
with mussels, oysters and other seafood and is much underated these days. It is also worth trying<br />
the delightful Loire reds, made from Cabernet Franc, such as Chinon, which have a lovely<br />

Alsace lies in eastern France between the Vosges mountains to the west and the river Rhine to the east.<br />
The wine growing areas are Bas-Rhin near Strasbourg and Haut-Rhin in the south, with the most reputable<br />
vineyards sited in the lower foothills of the Vosges. Predominantley a high quality, white wine area, using<br />

The Rhone valley produces some of the most delicious red wines in France, from Grenache<br />
based wines in the South (such as Chateauneuf) to the spicy Syrah based wines in the North<br />
(Crozes Hermitage). The Grenache grape produces rich red wines with lots of flavour but<br />

Spain has seen a consistant improvement in quality, over the past few years,<br />
from regions such as Toro, Rioja, Jumilla and La Mancha. We particularly<br />

Roberto has been making the wines at<br />
Carlos Serres since 1993, following in his<br />
family’s footsteps. He studied winemaking<br />
in Madrid and the Basque Country,<br />
including an experience of a vintage in<br />
Bordeaux in 1990.<br />
He has two passions: wines with ageing<br />
potential, as has been the tradition in<br />
Haro – his home town and where the<br />
winery has been locate for over a century,<br />
and motorcycles. Roberto’s experience<br />
means he is a sought-after consultant and a<br />
lecturer in oenology at a Sommelier school.<br />
The winery owns a spectacular 60 hectare vineyard, which is<br />
bordered by a pond that gives it its name. Finca El Estanque,<br />
with its chalky-clay soils, is the source of the Tempranillo, Mazuelo,<br />
Graciano and Viura grapes that make up the core of the winery’s<br />
Reserva, Gran Reserva and Onomástica wines.<br />

Grant Burge Wines was formed in 1988 by<br />
Grant and his wife Helen, in the heart of the<br />
Barossa Valley, South Australia. A key<br />
philosophy is “fine wines are made in the<br />
vineyard” and Grant has , with close to<br />
1,000 hectares, one of the largest private<br />
vineyard holdings in the Barossa, some of<br />
which have vines dating back over<br />
100 years.<br />
His family has grown grapes in the Barossa<br />
since 1855 and winemaking has always<br />
been in his blood. Even as a school boy he<br />
knew he wanted to make wine.<br />
Grant was one of the last apprentice<br />
winemakers and did his apprenticeship at<br />
the Southern Vales Co-Op in McLaren Vale<br />
where after 7 years he had worked his way<br />
up from cellar hand to Chief Winemaker.<br />
His first vintage was 1970.<br />
Grant has achieved renown for all his wines. James Halliday awarded his winery the status of a “Red Five Star Winery” in his 2012<br />
Wine Companion. This translates to “consistently produces wines of exemplary quality” and a “long track record of excellence –<br />
truly the best of the best”. For the 5th year running he has just been awarded the Decanter Regional Trophy for his 20 Year Old<br />
Tawny, as well as picking up numerous medals in the IWC, IWSC and Decanter Awards.<br />

Growing up on my families Vineyard and<br />
Winery property in Upper Moutere, gave me<br />
an insight into the wine industry. Every<br />
holiday I helped in the winery with bottling<br />
and distribution, or often in the vineyard<br />
doing all sorts of tasks including hand<br />
picking and tractor work.<br />
In ‘94 I completed seventh form at Waimea<br />
College and applied to Charles Sturt<br />
University in Wagga Wagga, Australia to<br />
begin a Bachelor of Applied Science<br />
(Wine Science).<br />
New Zealand and Australian graduates<br />
from winemaking courses are highly sought<br />
after around the world, this means that it is<br />
easy for young winemakers to travel<br />
around the world with their work.<br />
This type of experience is beneficial<br />
for a winemaker as it helps to<br />
broaden their views due to different<br />
techniques in winemaking which<br />
are used around the world.<br />
My First “Real” job (away from home) was in Western Australia for 3 months, then Home for Winter, followed by four<br />
months in Oregon, USA between July and November, in 2000 I worked in the Yarra Valley (Australia), then in Austria for<br />
three months later in the year. In Mid 2001 I took up the winemaking role, which was very daunting, but a role that<br />
I thoroughly enjoy. This role allows me a lot of hands on wine making and also travelling to our export destinations to do<br />
wine tastings and sales support with distributors.<br />

David Gonzalez has been dedicated to the<br />
wine industry for the last 39 years. He began<br />
as a wine maker assistant at Chiles largest<br />
wine making company, Concha y Toro and<br />
worked in several areas in the same company<br />
which gave him a wide experience in the<br />
whole winemaking process; grape growing,<br />
vineyard management, cellaring, quality<br />
control, laboratory, bottling process, and<br />
so on.<br />
Davids philosophy as a winemaker is to pay<br />
careful attention to every link in the<br />
production chain. First, the selection of the<br />
right vines, the planting, cultivation, and all<br />
the work involved in the vineyards.<br />
He has participated in harvests of different<br />
types of wineries in California, Argentina<br />

Argentina is the largest wine producer in South America with most of its production coming from the regions<br />
of Mendoza and San Juan. Alot of investment has been made over the past few years and quality has improved<br />
dramatically. Malbec is the star red wine from Argentina producing really delicious complex wines that are<br />
great with beef, Argentina's other great export. Last year we have extended our range and introduced the<br />
excellent wines from Finca Las Moras in the province of San Juan, one of the very best producers in Argentina.<br />
This year we have introduced the Pacha Mama range or wines made from Organically grown grapes,<br />
both the Torrontes and Malbec are first class.<br />

the worlds wine producing areas. Production<br />

Yves Lallement Champagne was originally founded in 1999 by Nicolas Dubois and his wife,<br />
Myriam Lallement. Since then, the company has gone from strength to strength. They are now the<br />
proud owners of 30 hectares in Champagne and 120 hectares in the Loire Valley and have a yearly<br />
production of one million bottles.<br />
They are based at Villedommange, a charming village in the Montagne de Reims and located just<br />
5 Kilometres on the West part of Reims. The soil consists of chalk and lime. These vineyards, which<br />
generally face north and northeast, are planted with a high proportion of Pinot noir vines and produce<br />
well-structured, deeply flavoured wines.<br />

TERMS AND<br />
CONDITIONS<br />
Notice<br />
If the Customer is a consumer in terms of Section 12 of the Unfair Contract Terms Act<br />
then save where the Contract is for international sales of Goods nothing herein shall<br />
restrict or affect the statutory rights of the customer.<br />
1. Definitions<br />
The ‘Company’ means Booker Limited trading as <strong>Classic</strong> <strong>Drinks</strong>.<br />
The ‘Customer’ means the person, firm, company or other undertaking to whom the<br />
Goods are supplied and the order acknowledgement delivery note is addressed.<br />
The ‘Contract’ means any contract for the supply of the goods by the Company to<br />
the Customer.<br />
The ‘Goods’ means the beers, wines, spirits, soft drinks and other articles and services<br />
specified in the order acknowledgement/delivery note or credit invoice.<br />
2. Basis of Sale<br />
2.1 The Customer’s order constitutes an offer by the Customer which shall be accepted<br />
by the Company by the issue of the Company’s standard order acknowledgement/delivery<br />
note or, in the case of cash sales, the Company’s invoice.<br />
2.2 Acceptance shall bind the Customer to these conditions of Sale and they shall<br />
apply to the Contract to the exclusion of any terms and conditions issued by the<br />
Customer.<br />
2.3 No variation to these Conditions of Sale shall be binding unless agreed in writing<br />
by authorised representatives of the Company and the Customer.<br />
3. No Acknowledgement of Order<br />
The Company shall be under no obligation to acknowledge receipt of an order from<br />
the Customer and shall be entitled to execute the order without further reference to<br />
the Customer.<br />
4. Availability<br />
Orders are subject to availability of stocks.<br />
5. Delivery<br />
5.1 Any time or date for delivery of the Goods given by the Company shall only be an<br />
estimate and shall not be of the essence of the Contract.<br />
The Company shall not be liable to compensate the Customer for non or late delivery<br />
or for any loss, consequential or otherwise, arising therefrom.<br />
5.2 The Company shall be entitled to deliver part of the Goods or by installments and to<br />
invoice the Customer for such part delivery or each installment.<br />
5.3 If the Customer refuses or fails to take delivery of the Goods at a time when the<br />
Company could reasonably expect the Customer to take delivery,<br />
the Company reserves the right to charge for such abortive delivery.<br />
5.4 The Goods shall be at the Customers risk from delivery.<br />
6. Prices, VAT and Delivery Charges<br />
6.1 The price of the Goods shall be that ruling at the time of delivery.<br />
6.2 The price shall exclude VAT which shall be charged at the rate applicable at the<br />
time of delivery.<br />
6.3 The Company reserves the right to charge separately for delivery.<br />
6.4 All prices are subject to alteration without notice.<br />
7. Payment<br />
7.1 Payment for the Goods shall be made by the Customer on delivery by cash (or, if<br />
the prior agreement of the Company has been obtained, by cheque).<br />
7.2 If the Company has granted credit facilities to the Customer, such payment shall be<br />
made in accordance with the terms granted by the Company to the Customer.<br />
7.3 The Customer shall not be entitled to deduct for the price of the Goods and other<br />
charges made by the Company, any monies due to or claimed to be due to the<br />
Customer from the Company in respect of this or any other contracts.<br />
7.4 If the Customer fails to make payment in accordance with this clause the<br />
Company shall be entitled without notice to:<br />
a) Cancel this and any other Contract with the Customer or suspend deliveries.<br />
b) Charge interest on overdue sums at a rate of 2% above Lloyds TSB Bank Plc base<br />
rate from the date payment was due until the date of payment.<br />
c) Deem all other sums due from the Customer to be immediately payable.<br />
d) Charge the Customer with charges made by third parties to the Company in connection<br />
with any failure to make payment, including legal costs and bank charges for<br />
rejecting or re-presenting cheques or direct debits.<br />
7.5 The Company shall be entitled without notice to cancel the Contract or suspend<br />
deliveries if:<br />
a) The customer makes a voluntary arrangement with its creditors or a petition is presented<br />
for a bankruptcy order or a compulsory winding-up order, or an administrative<br />
order in respect of the Customer, or the Customer passes or gives notice of a<br />
meeting to pass any resolution for the voluntary winding -up of the Customer (other<br />
than a solvent Liquidation for the purposes of amalgamation or reconstruction;<br />
or<br />
b) An encumberancer takes possession, or a receiver is appointed, over any of the<br />
property or assets of the Customer, or<br />
c) The Customer becomes insolvent or ceases to or threatens to cease to carry<br />
on business;<br />
or<br />
d) The Company bona fide believes that any of the events mentioned in (a) to (c)<br />
above is about to occur and notifies the Customer accordingly.<br />
8. Goods - Inspection and Liability<br />
8.1 The Company shall not be liable for any shortages to or damage (apparent on<br />
reasonable inspection) to the Goods on delivery, unless the existence of such shortage<br />
or damages are recorded on the order acknowledgement/delivery note and full<br />
details thereof are delivered in writing to the Company within seventy two hours of<br />
delivery.<br />
8.2 Other shortages/damage and any claims by the Customer that the Goods are<br />
defective must be made within fourteen days of delivery otherwise the Customer will<br />
be deemed to have accepted them. The Company’s liability for Goods it agrees are<br />
defective shall be limited to the price thereof and all other warranties, conditions,<br />
terms and liabilities, express, implied, statutory or otherwise are excluded except any<br />
which by law cannot be excluded.<br />
8.3 Furthermore the Company does not accept liability for Goods which exceed the<br />
manufacturers or suppliers date code or sell by date within seven days from the date<br />
of delivery.<br />
8.4 The Customer shall indemnify the Company in respect of all damage, injury or<br />
loss occurring to any person or property and against all actions, claims, demands and<br />
expenses in connection therewith arising from the condition of use of the Goods or<br />
any property referred to in clause 9, in and to the extent that such damage, injury or<br />
loss shall have been occasioned partly or wholly by the act, omission, negligence or<br />
wilful default of the Customer, his servants or agents, or any breach by the Customer<br />
of its obligations to the Company.<br />
9. Company/Suppliers Property<br />
All containers (including bottles, cases, casks, kegs, cylinders, pallets) in or on which<br />
the Goods are supplied, all drinks dispense equipment and all ancillary equipment<br />
supplied in connection therewith, shall remain the property of the Company or the<br />
Company’s supplier (as the case may be) and the Company shall be entitled to<br />
charge the Customer a deposit for the safekeeping thereof. If the Customer fails to<br />
return such items upon request or returns them in a damaged condition, any deposit<br />
may be forfeited in whole or in part and the Company shall in addition be entitled to<br />
charge the Customer the balance of the cost of any replacement thereof or repair<br />
thereto.<br />
10. Retention of Title<br />
10.1 The Goods shall remain the sole and absolute property of the Company as<br />
legal and equitable owner until such time as the Customer shall have paid the<br />
Company for the Goods together with the price of any other Goods the subject of<br />
any other Contract with the Company and until that time the Customer acknowledges<br />
that it is in possession of the Goods solely as bailee in a financiary capacity for<br />
the Company.<br />
10.2 If the Customer sells or otherwise disposes of the Goods it shall do so as Agent<br />
for the Company and shall hold the proceeds of sale for and on behalf of the<br />
Company until the Company has received payment in full.<br />
10.3 In order to enforce its rights under sub-clause 10.1 above, the Company<br />
may repossess the Goods or any of them without prior notice and reserve the<br />
right to enter any premises owned or occupied by the Customer for the purpose of<br />
such repossession.<br />
10.4 Until such time as title to the Goods shall have passed to the Customer, the<br />
Customer shall store the Goods in such a way as to be identifiable property of the<br />
Company.<br />
11. Mistakes and Information<br />
The Company reserves the right to amend any clerical, administrative or computer<br />
processing error which appear in the Company’s order acknowledgement/delivery<br />
note, invoice or other documentation issued by it.<br />
12. Relaxation or Forbearance<br />
No relaxation or forbearance delay or indulgence by the Company in enforcing any<br />
of the terms and conditions of the contract or granting of time by the Company to the<br />
Customer shall prejudice, affect, or restrict the rights and powers of the Company hereunder,<br />
nor shall any waiver by the Company of any breach hereof operate as a waiver<br />
of any subsequent or any continuing breach.<br />
13. Jurisdiction<br />
These conditions and the Contract shall be governed and construed in accordance<br />
with English Law and any disputes shall be referred to the Courts of England and<br />
Wales.
