23/50/glj That's the document that goes out requesting the quotations that you then assess at Central TAFE. Correct?---Right. Is the scope of works all of the RFQ or is that just one part of the RFQ?---No, that's only one part of it. The scope of work is what defines for the contractor what we want to have happen. So we will tell them, for instance, "We want to buy a gas chromatograph," and that's - we would put in all the technical details, or if we want to hire a consultant we tell them, "We have this problem or this project. Quote me on what it will take to make it happen or to get us a conclusion, and how you're going to reach that conclusion. What's your - how do you see the project happening?" and that's what the scope of work is. So the scope of works is the guts of the RFQ, the real content of it?---Absolutely. What's required?---Yeah. Is that right?---Yes. And there are lots of details that surround it, that go in an RFQ. Correct?---Right. There's a lot of boiler plate, standard government language that goes in for every tender or every contract, but it's the scope of work is where you get creative. Because you weren't working there in April of 03 were you? ---No, that would be American dates. All right, so that's 4 September 2003, the subject is Implementation of Recommendations and you say: ---Right. Arwa, attached is the RFQ shell that I've put together so far. I still don't have the recommendations, their priority ranking, which ones will be implemented or how long it may take which depends on which recommendations will be implemented. I would appreciate your assistance with this if you can, thanks? So are you saying that you had done a lot of the boiler plate work or the standard stuff and created a shell? ---Right. And then - but the guts of it, the scope of works needed to be inserted. Is that the position?---That's correct and frankly that memo is a violation of process. You understand that? You don't go to someone you think will be the contractor and say, "Help me write the tender." Did you know at that point that Arwa would be one of the potential bidders?---Yeah, and I fought it. I didn't even send her the tender when it was published because I didn't want her to bid but I was told she's going to bid. Okay, that's later on but why did you do this?---I was instructed to do so by Mervyn Joseph. He said, "You have to get it from her, she's writing it," and I figured the only way I'm going to get a scope of work is to go to the source. I had already talked to her on the phone and I said, "Look, I need some help on this." So prior to this point had Mervyn Joseph provided you with a scope of works?---Just something in general. It wasn't enough. It wasn't enough to put out to the public. It was based on his knowledge as I understood it of what phase 3 was going to look like when it was finally drafted but he had already said - when I told him I said, "This really isn't enough, it's not specific enough for somebody to bid on," he said, "Well, you need to talk to Arwa because that's where it's coming from." 4/10/06 ROONEY, J.C.
