A Treasure in your Midst?<br />

Yes, it really is a treasure! How many times have you driven by Marinwood’s<br />

only National Historical Site and haven’t really “noticed” it?<br />

The old Dixie Schoolhouse has been restored by your neighbors who have<br />

strived to recreate it as closely as possible to the original, which was built in 1864.<br />

James Miller traveled across the country to make a home for his family in California.<br />

Their party who traveled across the Sierra’s was the first to have no deaths on<br />

the trek along the way. He built this schoolhouse so that his children would have<br />

a place to learn.<br />

We invite you to experience the look and the feel <strong>of</strong> a mid 1800’s classroom.<br />

This historic building is open the first Sunday <strong>of</strong> every month from 2-4. A docent<br />

is available on site to answer your questions. We also have a great documentary<br />

done by PBS telling the interesting tale <strong>of</strong> the Miller-Murphy party.<br />

We are very fortunate to have this example <strong>of</strong> a one-room schoolhouse in our<br />

community. Please take time to visit and bring out <strong>of</strong> town house guests, to explore<br />

a treasure that has been lovingly cared for by your community and the Dixie District.<br />

We are always surprised how many children haven’t had the opportunity to visit<br />

this fine example <strong>of</strong> history right in their own neighborhood. We look forward to<br />

seeing you!<br />

The schoolhouse is available for group visits, as well as it may be rented as a<br />

unique venue for a party or a special event. We also have a wide range <strong>of</strong> volunteer<br />

opportunities, some that only take a few hours a year! Call for more information:<br />

Holiday Tree Lighting hosted by the<br />

Jacobs family. Gather your neighbors<br />

and enjoy hot chocolate, cookies and<br />

children's wishes.<br />

The Fire Dept. will have a fire<br />

engine on display and will collect new<br />

unwrapped gifts for the Toys for Tots<br />

Drainage Culvert<br />

Reminder<br />

<strong>Homeowners</strong> whose yards abut the<br />

hills, are reminded that it is their responsibility<br />

to clean their concrete V-shaped<br />

drainage culverts at the periphery <strong>of</strong><br />

their property. Be sure to clean out<br />

branches and leaves that can cause a<br />

blockage on your property or further<br />

down the line. Serious damage and<br />

flooding can occur from accumulated<br />

debris and one could be liable for damage<br />

to a neighbors property.

BILLING POLICY<br />

Home Owners Dues<br />

<strong>Lucas</strong> <strong>Valley</strong> Home Owners dues are<br />

$160 per quarter and this amount is due<br />

and payable on the following dates:<br />

January 1, April 1, July 1 and October<br />

1. Invoices will be sent to home owners<br />

on these dates. Please note that the<br />

$160 includes the charge for Basic TV<br />

(Channels 2 through 13).<br />

Non payment <strong>of</strong> dues will result in the<br />

following actions: If dues are not paid<br />

within 30 days <strong>of</strong> the due date a late fee<br />

<strong>of</strong> $15 per quarter will be added to the<br />

invoiced amount. If not paid within 60<br />

days <strong>of</strong> the due date TV service to the<br />

residence will be terminated and use<br />

<strong>of</strong> the pool or tennis courts will not be<br />

permitted. If not paid within 90 days<br />

<strong>of</strong> the due date the LVHA <strong>Board</strong> may,<br />

place a lien on the property and file for<br />

foreclosure.<br />

October 21, 2009<br />

Present were: Denis Ford, Steve Rule<br />

and Scott Eichler. Absent Keith Dotto<br />

and Gary Scharlach.<br />

Approval <strong>of</strong> Agenda: Scott Eichler<br />

moved to approve the agenda. It was<br />

seconded by Denis Ford and carried<br />

unanimously.<br />

Approval <strong>of</strong> Minutes: Denis Ford<br />

moved to approve the minutes <strong>of</strong> the<br />

July meeting. It was seconded by Scott<br />

Eichler and carried unanimously.<br />

Office Manager’s Report: Community<br />

Center: Community Center:<br />

The Halloween Party is scheduled for<br />

Sunday, Oct 25 from 2 – 4 PM. The<br />

Holiday Tree Lighting will be held<br />

on Sunday, Nov 29 th . The World Affairs<br />

Council will have a speaker at<br />

Dominican University on October 29 th<br />

and Frank Rettenberg assures us it will<br />

be very informative. Flyers are on the<br />

sign-in table. Landscaping: George<br />

Farias has repaired a valve in the sprinkler<br />

system on the pool lawn. He has<br />

repaired a broken pipe at the upper<br />

courts and replaced a sprinkler with an<br />

impact rotor. Miscellaneous: Children<br />

from the valley have been seen tagging<br />

(with spray paint) the playground and<br />

tennis court areas in the afternoon.<br />

Please keep an eye out for this type <strong>of</strong><br />

activity and report it.<br />

President’s Report: Given by Steve<br />

Rule. Steve noted that the <strong>Board</strong> has<br />

drawn up a new use agreement for the<br />

LVA and a new one for LVST will be<br />

completed soon.<br />

Treasurer’s Report: Given by Denis<br />

Ford. Denis noted that the HOA is in<br />

good shape and revenues and expenses<br />

are proceeding as budgeted. The <strong>of</strong>fice<br />

has received an engagement letter<br />

from our CPA for 2009 tax year. However,<br />

the Finance Committee had some<br />

questions about methods used in the<br />

financial reports for 2008, so they will<br />

have further discussion before signing<br />

the letter.<br />

Committee Reports:<br />

ARC Committee: Given by Scott<br />

Eichler. Scott stated that the committee<br />

has had some turnover as <strong>of</strong><br />

late, however they have processed<br />

nine applications in the last month.<br />

The Committee is striving to be more<br />

proactive and be a resource to the<br />

community rather than just approve<br />

applications. For example; many<br />

new Eichler homeowners are unfamiliar<br />

with the Eichler modernist<br />

style and have design and remodeling<br />

questions that the ARC could be<br />

<strong>of</strong> help with.<br />

Watershed Committee: Given by<br />

Scott Eichler. Scott explained that Rachel<br />

Kamman has taken over the lead<br />

<strong>of</strong> this committee for Mike Elgie who<br />

resigned a few months ago. They need<br />

recruits to help on this committee. A<br />

homeowner asked about the FEMA<br />

remapping <strong>of</strong> flood zones and if<br />

there was any new news on the issue.<br />

It was explained that Rachel’s<br />

company, Kamman Hydrology<br />

and Engineering, is looking into it<br />

and have written a letter to FEMA<br />

asking for a review <strong>of</strong> the rezoned<br />

area maps.<br />

Old Business: Remodel Update:<br />

Steve Rule noted that Patrick Hunter<br />

has been working diligently to narrow<br />

down the contractor and it is expected<br />

that a decision will be made in the next<br />

week and a contract signed. The project<br />

is expected to take eight weeks and be in<br />

the range <strong>of</strong> $100,000 to $125,000. The<br />

initial building permit to begin the work<br />

is $4370 and another will be required for<br />

the electrical work.<br />

Playground Update: Valerie Charlton<br />

gave an update on the playground<br />

remodel and explained that the Ad-Hoc<br />

Committee has received four bids ranging<br />

in price from $27,000 to $37,000.<br />

This does not include tearing out the<br />

old equipment because Tad Jacobs has<br />

already <strong>of</strong>fered to donate his equipment<br />

and services to accomplish that.<br />

There are two ways to complete the<br />

project: 1) have it completely done by<br />

a licensed playground contractor, or 2)<br />

by a group <strong>of</strong> volunteer homeowners,<br />

similar to how the current playground<br />

was installed 20 years ago. If it is done<br />

by the second method LVHA may be<br />

able to get a grant through Susan Adams<br />

to cover part <strong>of</strong> the cost.<br />

The plans will be shared with the community<br />

through the LVHA website,<br />

LVHA.org, and the new ListServ<br />

group. They also hope to have plans<br />

available at the next board meeting on<br />

Nov. 18 th .<br />

Listserv Internet Group Update:<br />

Cindy Johanson explained that she and<br />

Dale Miller have been working on setting<br />

up a listserv group so that members<br />

<strong>of</strong> the community can stay in touch and<br />

There were some initial problems<br />

connecting it to the LVHA website but<br />

they have been resolved and we are now<br />

in the BETA testing phase. Members<br />

can go to the website and sign up to<br />

receive emails and announcements.<br />

New Business:<br />

Committee Charters: Scott Eichler<br />

suggested that each Committee write<br />

a charter for their committee. It has<br />

been quite a while since this has<br />

been done and some committees do<br />

not have one at all. All committees<br />

are asked to do this. This will give<br />

new committee members guidance<br />

about what the committee is trying<br />

to accomplish.<br />

Committee Applications: Three<br />

applications have been received in<br />

the last month due to Scott Eichler’s<br />

recruiting efforts.<br />

Patrick O’Hare has applied to be<br />

on the Architectural Review Committee<br />

and the Public Improvement<br />

Committee. He is an Architect and<br />

Interior Designer with over 20 years<br />

experience. Motion: Scott Eichler<br />

moved to accept Patrick O’Hare’s<br />

application to the ARC and the Public<br />

Improvement Committee. It was<br />

seconded by Denis Ford and carried<br />

unanimously.<br />

Jeff Swan applied to be on the Watershed<br />

and Open Space Committee.<br />

He is an avid outdoors person and<br />

lives next to the creek and wants to<br />

be sure it remains in pristine condition<br />

for future generations. Motion:<br />

Denis Ford moved to accept Jeff<br />

Swan to the Watershed Committee.<br />

It was seconded by Scott Eichler and<br />

carried unanimously.<br />

Chris Simpson has applied to be on<br />

the Pool Committee. He is a member<br />

<strong>of</strong> the Guardsmen <strong>of</strong> San Francisco<br />

and coaches soccer. He has children<br />

on the <strong>Lucas</strong> <strong>Valley</strong> Lightnings and<br />

the <strong>Lucas</strong> <strong>Valley</strong> Aquatics teams and<br />

he is a <strong>Board</strong> Member <strong>of</strong> the newly<br />

approved LV Masters program. Motion:<br />

Scott Eichler moved to accept<br />

Chris Simpson to the Pool Committee.<br />

It was seconded by Denis Ford<br />

and carried unanimously.<br />

Items from <strong>Homeowners</strong>: A member<br />

<strong>of</strong> the audience lamented about<br />

the state <strong>of</strong> some <strong>of</strong> the homes in the<br />

valley. Of particular annoyance are<br />

the homes that use their carports as<br />

storage areas and homes with neglected<br />

yards and peeling paint. She<br />

felt that there is an assumption by<br />

many owners that the <strong>Board</strong> should<br />

be on the lookout for infractions.<br />

She would like to see the <strong>Board</strong><br />

implement a fine structure.<br />

The <strong>Board</strong> explained that there<br />

is a policy in the CC&Rs and that<br />

the <strong>Board</strong> will not go around policing<br />

neighbors but that if someone<br />

brings an item to the attention <strong>of</strong> the<br />

<strong>Board</strong> and that person has attempted<br />

to work out the situation with their<br />

neighbor then the <strong>Board</strong> will look<br />

into it. However, the <strong>Board</strong> stressed<br />

that it would like neighbors to attempt<br />

to work out problems amongst<br />

themselves.<br />

Adjournment: Scott Eichler moved<br />

to adjourn the meeting. It was seconded<br />

by Denis Ford and carried<br />

ASK THE ARC<br />

QUESTION: We’re getting ready<br />

to paint our house. It was previously<br />

painted about 15 years ago. Do I need<br />

to submit an application? What information<br />

should we have before we select<br />

our colors?<br />

ANSWER: Thank you for your inquiry.<br />

All homeowners must submit an Application<br />

for approval (with paint<br />

chips attached) to the ARC before<br />

beginning to paint, even if you are<br />

planning to paint your house the existing<br />

colors. There is a paint chart at<br />

the Community Center, with handouts<br />

explaining how to make your choices<br />

and giving guidelines and suggestions.<br />

The paint colors that are approvable<br />

today may not be the same colors that<br />

were approvable 15 years ago, and so<br />

you must submit your application to<br />

the ARC. Also, be aware that you may<br />

deviate somewhat from the chart as long<br />

as you bear the paint guidelines in mind<br />

and submit your chips so the ARC may<br />

review it.<br />

As a quick summary, here is some<br />

helpful information: Make your color<br />

selections using this chart as a resource.<br />

Corresponding paint chips are available<br />

at the community center <strong>of</strong>fice. Testing<br />

samples <strong>of</strong> materials and paint colors are<br />

encouraged in order to understand how a<br />

particular material and color tie into the<br />

neighborhood and streetscape.<br />

Body color, including siding, vertical<br />

and horizontal trim and molding,<br />

garage doors, window and door trim/<br />

frames, should all be the same color.<br />

Horizontal fascia at ro<strong>of</strong> overhangs,<br />

horizontal beams and posts should be a<br />

lighter or darker color to complement<br />

the body color. Contrasting fascia and<br />

dark or flat-black foundation color highlights<br />

are an important characteristic <strong>of</strong><br />

Eichler design.<br />

Entry doors should be a solid color<br />

and may be a brighter accent color compatible<br />

with the exterior <strong>of</strong> the house<br />

and the surrounding hardscape and/or<br />

landscape.<br />

Base (exposed foundation) should<br />

be a dark gray or other color indicated<br />

on the paint chart.<br />

Beams were originally painted almost<br />

always exclusively classic white;<br />

some were deep brown or natural wood.<br />

American Guild homeowners should<br />

adhere to the above guidelines ins<strong>of</strong>ar<br />

as they apply to the American Guild<br />

architecture.<br />

These guidelines are consistent<br />

with the design principles followed by<br />

Eichler’s architects. Color has a great<br />

impact on the look <strong>of</strong> an individual<br />

house and on that <strong>of</strong> our community in<br />

general. One principle <strong>of</strong> Eichler design<br />

(and American Guild as well) is that the<br />

structure should be “compatible with<br />

the natural environment.” In <strong>Lucas</strong> <strong>Valley</strong>,<br />

almost every house is viewed with<br />

a backdrop <strong>of</strong> classic Marin County<br />

rolling hills dotted with stands <strong>of</strong> oaks.<br />

A house that is too light or too bright<br />

stands out obtrusively and clashes with<br />

this otherwise tranquil scene.<br />

Protect Our Creeks<br />

LVHA has been reminded by the<br />

County that homeowners whose property<br />

abuts a creek should be aware <strong>of</strong><br />

many Marin County Ordinances.<br />

Property owners must keep the<br />

creek free <strong>of</strong> obstructions or potential<br />

obstructions and may not enlarge<br />

their property because you may be<br />

in violation <strong>of</strong> one <strong>of</strong> the following<br />

ordinances: Chapter 23.08.025(5),<br />

Grading Ordinance; Chapter 11.08<br />

Creek Ordinance, and Chapter 23.18,<br />

Storm Water Management & Discharge<br />

Control Ordinance. You may also be in<br />

violation <strong>of</strong> California Department <strong>of</strong><br />

Fish and Game (CDFG), and/or State<br />

Regional Water Quality Control <strong>Board</strong><br />

(RWQCB) regulations.<br />

Please be aware that one may be<br />

held liable for any damages to property<br />

or from a pollution discharge if fill/debris<br />

falls into the creek. In addition one<br />

may be subject to civil liability. Property<br />

owners must maintain a minimum 2:1<br />

bank-slope.<br />

A permit is required for any fill<br />

and grading done within fifty feet <strong>of</strong><br />

the creek.<br />

Please do not put any debris onto<br />

the creek banks. During high rains this<br />

can flow into the creek and cause a<br />

blockage downstream thereby causing<br />

damage to homes or property.<br />

The LVHA <strong>of</strong>fice has received<br />

complaints from the Rotary Senior<br />

Village just east <strong>of</strong> Mt. Lassen Drive.<br />

Apparently, when walking dogs on<br />

the pathway that cuts through the area<br />

owners are not picking up after their<br />

dogs. Especially bothersome are the<br />

areas behind some <strong>of</strong> the homes and<br />

on their pathways. This causes smells<br />

to waft into their homes and sliping<br />

hazards.<br />

Many <strong>of</strong> the seniors cannot bend to<br />

pick up the unwanted deposits. Please<br />

be considerate and pick up.<br />

This column was suggested as a way<br />

<strong>of</strong> giving away an item that was still<br />

usable but no longer wanted, without<br />

having to call Goodwill for just one<br />

item or taking it to the dump to be put<br />

into landfill.<br />

so that it can be listed in the next issue<br />

The annual Halloween Party was a<br />

huge success. Everyone had a fun filled<br />

afternoon with games, face painting and<br />

goodies. Valerie Charleton and Annette<br />

Lowder organized the event and Doug<br />

Charlton was in charge <strong>of</strong> games such<br />

as the sack races.<br />
