The statute<br />
95. Section 1 of the Law, which is the definitions section, states:<br />
“resident of the region” – including a person who lives in<br />
the region but is not registered in the region’s Population<br />
Registry, and excluding a resident of an Israeli community<br />
in the region.<br />
The Respondents’ position, as reflected in practice (in that written procedures do not<br />
exist), including their position regarding P<strong>et</strong>itioners 1-5, is that a child who is born in<br />
the region, even if the center of the child’s life is in Jerus<strong>al</strong>em, is considered a<br />
“resident of the region” for the purposes of the Law.<br />
96. Section 2 of the Law states:<br />
During the period in which this Law sh<strong>al</strong>l be in effect,<br />
notwithstanding the provisions of any law, including Section<br />
7 of the Nation<strong>al</strong>ity Law, the Minister of the Interior sh<strong>al</strong>l<br />
not grant a resident of the region nation<strong>al</strong>ity pursuant to the<br />
Nation<strong>al</strong>ity Law and sh<strong>al</strong>l not give a resident of the region a<br />
permit to reside in Israeli pursuant to the Entry into Israel<br />
Law, and the region<strong>al</strong> commander sh<strong>al</strong>l not give such<br />
resident a permit to stay in Israel pursuant to the defence<br />
legislation in the region.<br />
