their children – only after a long wait for the response of an offici<strong>al</strong> in the office of the<br />

Ministry of the Interior. If, indeed, the offici<strong>al</strong> chooses to respond.<br />

147. While the Respondents insolently contend that, if any harm is caused, it is minim<strong>al</strong><br />

and in proper measure under the circumstances, P<strong>et</strong>itioner 1 finds herself in a<br />

distressful and frightening situation because no way exists for her minor children to<br />

obtain a status.<br />

148. The comments of the Honorable President Barak in <strong>HCJ</strong> 840/79, Contractors Center<br />

v. Government of Israel and Builders in Israel, Piskei Din 34 (3) 729, 745-746, are<br />

appropriate in our matter:<br />

The state, through those acting in its name, is the public’s<br />

trustee, and it holds the public interest and public property<br />

for use that benefits the public… This speci<strong>al</strong> status is what<br />

imposes the duty on the state to act reasonably, honestly,<br />

with integrity, and in good faith. The state is forbidden to<br />

discriminate, act arbitrarily, or without good faith, or be in<br />

a conflict of interest. In brief, it must act fairly.<br />

The Honorable Court is requested, therefore, to order the Respondents to act in<br />

accordance with the rule of law, according to reasonable and fair criteria, and to<br />

ensure the welfare and rights of residents of the state and of their children.<br />

For these reasons, the Honorable Court is requested to issue an Order Nisi as requested<br />

at the beginning of the p<strong>et</strong>ition, and after receiving the response of the Respondents to<br />

the Order Nisi, to make it absolute, and to order Respondent to pay the costs of suit.<br />
