In <strong>al</strong>l actions concerning children, wh<strong>et</strong>her undertaken by<br />

public or private soci<strong>al</strong> welfare institutions, courts of law,<br />

administrative authorities or legislative bodies, the best<br />

interests of the child sh<strong>al</strong>l be a primary consideration. [...]<br />

Article 7 states:<br />

1. The child sh<strong>al</strong>l be registered immediately after birth<br />

and sh<strong>al</strong>l have the right from birth to a name, the<br />

right to acquire a nation<strong>al</strong>ity and, as afar as<br />

possible, the right to know and be cared for by his or<br />

her parents.<br />

2. States Parties sh<strong>al</strong>l ensure the implementation of<br />

these rights in accordance with their nation<strong>al</strong> law<br />

and their obligations under the relevant<br />

internation<strong>al</strong> instruments in this field, in particular<br />

where the child would otherwise be stateless.<br />

Article 9(1) of the Convention states:<br />

States Parties sh<strong>al</strong>l ensure that a child sh<strong>al</strong>l not be<br />

separated from his or her parents against their will, except<br />

when comp<strong>et</strong>ent authorities subject to judici<strong>al</strong> review<br />

d<strong>et</strong>ermine, in accordance with applicable law and<br />

procedures, that such separation is necessary for the best<br />

interests of the child.<br />

Article 10(1) states:<br />

… application by a child or his or her parents to enter or<br />

leave a State Party for the purpose of family reunification<br />

sh<strong>al</strong>l be de<strong>al</strong> with by States Parties in a positive, humane<br />

and expeditious manner. States Parties sh<strong>al</strong>l further ensure<br />

that that submission of such a request sh<strong>al</strong>l entail no<br />

adverse consequences for the applicants and for the<br />

members of their family..<br />

113. The Convention on the Rights of the Child is gaining increasing recognition as a<br />

supplement<strong>al</strong> source of children’s rights and as a guide for construing “the best<br />

interest of the child” as a paramount consideration in our law. See Civ. App. 3077/90,<br />
