For the purpose of evaluationof financial Bid,compositeprice inclusive of all taxesand levies will be considered .The unit wise cost /breakup is necessary for thepurposes of information andverification of composite priceso quoted by thecontractor/supplier.The contractor suppliershall submit to BSNLdocuments /proof of paymentof altaxes /levies alongwithexemption certificate if any ,toavail CENVAT benefits byBSNLHowever the evaluationand comparison of respectivebids shall be done on thebasis of net cost to BSNL onthe prices of the goods offeredinclusive of duties andtaxes (but –excludingCENVAT-able duties andtaxes)sales ,tax,packing,forwarding,freight and insurance chargesas per existing BSNL policies.I/We hereby tender for the execution of the work specified for BSNLwithin the timespecified, as per the schedule of quantities and in accordance……and the amount of performanceguarantee to be deposited by the successful tenderer(s), and theamount of Security Deposit to be deducted from the bills.• The evaluation and comparison of responsivebids shall be done on the basis of Net cost to BSNL on theprices offered inclusive of duties and taxes (but excludingCENVAT – able duties & taxes), sales tax, packing, forwarding,freight and insurance charges etc., as indicated in the priceschedule.• Vendors should furnish the correct E.D. /Customs tariff Head in the price schedule. If the creditfor the Duties and Taxes under CENVAT credit rules, 2004 isfound to be not admissible at any stage subsequently owing towrong furnishing of Tariff Head, then the vendors will be liableto refund such non-admissible amount, if already paid, alongwith penalty if charged by the concerned authority.• In case the Duties & Taxes which are nonCENVAT – able as per the quotes indicated in the priceschedule by the vendors and subsequently at any stage it isfound that Credit for such Duties & Taxes is admissible as perCENVAT Credit Rules, 2004, then the vendors will be liable torefund the amount equivalent to such Duties & Taxes if alreadypaid to them. However, BSNL may allow the supplier to submitnecessary documents in this regard which may enable BSNL toavail the CENVAT credit provided such credit is still availablefor the amount so paid as per CENVAT Credit Rules 2004.• BSNL reserves the right to ask the bidders tosubmit documentary proof confirming the correct Tariff Headfrom the E.D. / Customs authority where the Tariff Headfurnished against the particular tendered item by differentbidders differs from each other or the same is found apparentlynot furnished in accordance with E.D. / Customs Tariffnotifications.4. Para 25 of“GeneralRules andDirections”.• If the supplier fails to furnish necessarysupporting documents i.e. Excise / Customs invoices etc. inrespect of the Duties / Taxes which are Cenvatable, theamount pertaining to such Duties / Taxes will be deducted fromthe payment due to the firm.• Invoice shall clearly indicate break up details ofcomposite price i.e. Basic, E.D., Sales Tax, any other Dutiesand Taxes, Freight / Packing Charges, Service Tax etc.12.
