actions <strong>and</strong> with <strong>College</strong> Directors <strong>and</strong> Learning Improvement Manager on Stage 2(Discipline) procedures• The Learning Improvement Manager is responsible for a case load of Stage 1 <strong>and</strong> 2Discipline meetings as directed by their line manager.• The Strategic Leadership Team is responsible for ensuring consistency in theimplementation of the student intervention <strong>and</strong> disciplinary policy• The <strong>Student</strong> Advice <strong>and</strong> Support Team is responsible for providing a source ofsupport for students in any stage of the procedures.The team are also responsible forproviding information about a student’s circumstances <strong>and</strong> progress to assist relevantstaff with the application of effective strategies <strong>and</strong> actions in any stage of theprocedures.They are also responsible for evaluating the liaison between the team <strong>and</strong>curriculum teams in utilising <strong>Student</strong> Advice <strong>and</strong> Support Tracking documentation.• The <strong>Student</strong> Services Team will be responsible for ensuring efficient <strong>and</strong> consistentcommunication between the <strong>College</strong> <strong>and</strong> parents/carers through the dispatch ofletters/emails/text messages as instructed <strong>and</strong> for setting up Stage 1 Discipline <strong>and</strong>Stage 2 Discipline appointments.• The Principal or a delegated alternative has the power to suspend a student as a firststep in a disciplinary investigation of a very serious nature, pending the outcome of aninvestigation. Examples would be cases of drug abuse, violence or theft or in anysituation in which the students continued presence poses a threat to themselves, otherstudents or <strong>College</strong> staff <strong>and</strong>/or reflects a serious breach of the <strong>College</strong>’s values,beliefs <strong>and</strong> behaviours• The Principal or a delegated alternative has the power to expel a student• The Principal or a delegated alternative can also suspend enrolment of a student if athreat is posed to other students or to <strong>College</strong> staff.• The Corporation is responsible, under Clause 15(2) of the Statutory Articles ofGovernance, for making rules concerning the conduct of students, includingprocedures for suspension <strong>and</strong> expulsion.NB. For Level 2 vocational, ESOL <strong>and</strong> Workskills, subject based tutors replace take theroles <strong>and</strong> responsibilities of Tutors. For visiting international students, members of theModern Foreign Languages Team replace the roles <strong>and</strong> responsibilities of Tutors.Procedures for implementing the student intervention <strong>and</strong> disciplinary policyThese procedures are set out below in three phases:• Curriculum <strong>Intervention</strong>/Guidance <strong>Intervention</strong>• Stage 1 Discipline• Stage 2 DisciplineThe procedures are set to adhere to the following principles of good practice:Good communication between curriculum <strong>and</strong> guidance staff, students<strong>and</strong> parents/carers.Shared ownership for intervention between curriculum <strong>and</strong> guidancestaff.Early intervention is more effective than allowing poor student habits tobecome established <strong>and</strong> low level disruptive behaviour to be toleratedQuality intervention is delivered through dialogue based on mutual respect<strong>and</strong> consideration between staff <strong>and</strong> between staff <strong>and</strong> studentsProcedures are also detailed for:4


• suspension• expulsion• appeal• removal of a student from the <strong>College</strong> roll in the absence of use of a stageddisciplinary processNotes1. Although the process described would normally progress through all three phases up toStage 2 <strong>Disciplinary</strong>, it will be appropriate in some circumstances to go straight to the Stage1 or 2 Discipline or to suspension or expulsion2. If a student aged 16-18 is to be suspended from the <strong>College</strong> or expelled, a parent/carer willbe notified before the student leaves the premises.The phases of the policy can be instigated for a wide range of issues associated withstudent behaviour that breaches the <strong>College</strong>’s <strong>Student</strong> Code of Conduct in areas ofprogress, commitment or behaviour.CURRICULUM INTERVENTION1. Curriculum intervention is enacted by teachers <strong>and</strong> the CTM were a studentis failing to engage with any aspect of the <strong>Student</strong> Code of Conduct1.1 Teachers to complete registers in the classroom during the teaching session. Ifthis is not possible, registers should be completed on the same day as the lesson–by 4.35pm at the latest.1.2 Teachers to address all absences with students at their next session to ensurethat the student followed the absence procedures correctly <strong>and</strong> to identify anycauses of concern.1.3 Teacher <strong>and</strong>/or the CTM to intervene appropriately with students whose progress,commitment or behaviour becomes a cause of concern.2. Teacher/CTM CURRICULUM INTERVENTIONS may include:a. 1 to 1 discussion with the student face to face in the next session or viatelephone (essential). It is not expected that telephone calls are required aftereach absence but where face to face communications are delayed for anyreason.b. Using the traffic lights system to record the initial concern <strong>and</strong> actions using anAMBER traffic light <strong>and</strong> specific action points. NB. The Amber should be usedwhen the teacher is attempting to resolve concerns with curriculum intervention.Teachers should use Red when teacher intervention has been unsuccessful<strong>and</strong> they are requesting intervention from Guidance.c. Liaison with <strong>Student</strong> Advisers/Senior <strong>Student</strong> Advisers on GUIDANCEINTERVENTION activityd. Referral to Subject Support, the Upgrade Centre, <strong>Student</strong> Advice <strong>and</strong> Support,e. Reviewing at curriculum team meetings intervention activity for individualstudents <strong>and</strong> ensuring actions are recorded on <strong>Student</strong> Track <strong>and</strong> traffic lightsupdates as appropriate every two weeksf. Contacting parents/carers to discuss the cause for concern.5


GUIDANCE INTERVENTION1. Guidance intervention is enacted by Tutors <strong>and</strong> Senior Tutors through eitherreferral from teachers or Curriculum Team Managers or through self-referral fromthe student or parents/carers. In addition, Tutors <strong>and</strong> Senior Tutors will bereviewing data on the progress of individual students to target early intervention<strong>and</strong> action planning.2. Tutors <strong>and</strong> Senior Tutors will prioritise one to one appointments with theirdelegated students causing concern in progress, commitment or behaviour – anyGUIDANCE INTERVENTION activity required/enacted will be recorded on <strong>Student</strong>Track.3. Tutors <strong>and</strong> Senior Tutors GUIDANCE INTERVENTIONS may include:a. One to one meetingsb. Liaison with Parents/Carersc. Case conferences/liaison with curriculum teachers/CTMsd. Action planning to be recorded on <strong>Student</strong> Tracke. Referral to Stage 1 Disciplinef. Referral to Upgrade, <strong>Student</strong> Advice <strong>and</strong> Supportg. Referral to external agency supporth. Requests to <strong>Student</strong> Services for timetable adjustmentsSTAGE 1 DISCIPLINE1. Stage 1 Discipline is conducted by the Senior Tutors <strong>and</strong>/or <strong>College</strong> Directorsusing a Stage 1 <strong>Student</strong> Contract proforma (See Appendix 1). It is in this stage thatit is reinforced with the student the consequences of failure to adhere to the Stage1 <strong>Student</strong> Contract both in terms of likely success, support for progress (asappropriate) to further study at the <strong>College</strong>, impact on any <strong>College</strong> references forUCAS <strong>and</strong>/or employment <strong>and</strong> Stage 2 Discipline referral which might jeopardisetheir place as an enrolled student at the <strong>College</strong>.2. Stage 1 Discipline contracts will be reported to the student’s parents/carers inwriting through <strong>Student</strong> Services as appropriate.3. Compliance with Stage 1 Discipline contracts will be reviewed by SeniorTutors/<strong>College</strong> Directors with the student two weeks after the contract isestablished – using the <strong>Student</strong> Track to evaluate achievement of the targets asset out in the contract. At such time they may elect to extend the Stage 1 or refer toStage 2 Discipline.4. Senior Tutors will meet with <strong>College</strong> Directors once every two weeks to reviewStage 1 Discipline cases <strong>and</strong> referrals from STutors/CTMs6


STAGE 2 DISCIPLINE1. Stage 2 Discipline is conducted by <strong>College</strong> Directors <strong>and</strong> the LearningImprovement Manager using a Stage 2 Discipline contract proforma (SeeAppendix 2). Parents/Carers will be invited into the Stage 2 Discipline meeting toaccompany the student as appropriate <strong>and</strong> act as a signatory to the Stage 2Discipline contract (See Appendix 2) where present. Parents/Carers will also beissued with a letter to confirm details of the contract (See Appendix 3)2. Stage 2 Discipline will involve clear recognition of the potential sanctions thatmay be enacted by a <strong>College</strong> Director/Learning Improvement Manager as aresult of the failure of a Stage 2 Discipline contract. It will also make clear to thestudent that he/she has a right of appeal against a decision to put a student onStage 2 Discipline contract. Such an appeal should be presented in writing to theVice Principal stating clearly the reasons why the student feels an appeal isjustified.3. A <strong>College</strong> Director/Learning Improvement Manager can enact one or more of thefollowing sanctions as a result of a student failing a Stage 2 Discipline contract:3.1.1 The student may be removed from the <strong>College</strong> roll.3.1.2 Extension of the Stage 2 Discipline contract3.1.3 The student’s opportunity to re-enrol for a further year of study may bewithdrawn in accordance with the Admissions <strong>Policy</strong>.3.1.4 The student may be retained as non-entry for exam entries.4. The outcomes of a Stage 2 Discipline contract review which takes place 1, 3 <strong>and</strong>5 weeks after the setting of the contract will be communicated in writing to thestudent <strong>and</strong> parents/carers. In the event of a failed Stage 2 Discipline contractthis communication will include notice of the right <strong>and</strong> process of appeal againstsanctions enacted.5. When making judgements about progression of students, i.e. level 2 to level 3,Year 12 to 13 or Year 13 to 14, a student’s disciplinary record will be a keyconsideration. Any student who has reached Stage 1 or 2 during the academicyear may:• Be placed on Stage 1 of the <strong>Student</strong> <strong>Intervention</strong> <strong>and</strong> <strong>Disciplinary</strong>procedures disciplinary procedure at the start of the next academic year <strong>Student</strong>s who have not satisfactorily met the requirements of a Stage 2procedure at the end of an academic year will not normally be allowed toprogress to a subsequent year of study6. <strong>Student</strong>s placed on a Stage 2 Discipline Contract will again be reminded of theadvice <strong>and</strong> welfare services of the <strong>Student</strong> Advice <strong>and</strong> Support Team. <strong>Student</strong>swill be advised that the <strong>Student</strong> Advice <strong>and</strong> Support Team can help to supportstudents in meeting the requirements of the stages in the disciplinary policy.7. Review dates are set for 1, 3 <strong>and</strong> 5 weeks after the initial meeting to place thestudent on a Stage 2 DisciplineContract. <strong>Student</strong>s would not normally be on7


Stage 2 for any longer than 5 weeks. Any extension should be by agreement withthe Vice Principal8. <strong>Student</strong>s will normally agree when the Stage 2 Discipline Contract has beenbroken. This agreement <strong>and</strong> the subsequent removal of the student from the<strong>College</strong> roll does not constitute an expulsion.9. If a student disputes the evidence of failure to keep to the Stage 2 DisciplineContract, a hearing will be conducted by the Vice Principal. A decision will bereached based on the evidence presented.10. Upon satisfactory completion of the terms of the Stage 2 Discipline Contract astudent may revert to any stage of these procedures at the discretion of the<strong>College</strong> Director. If students reach Stage 2 Discipline for a second time in anyacademic year, they would normally be required to leave <strong>College</strong>.Non-Entry Status1. When a student enrols for a course at the <strong>College</strong>, there is an expectation of a highlevel of commitment on both sides. This expectation is reaffirmed throughout thecourse. Enrolment at the <strong>College</strong> does not give students an automatic right to beentered for external examinations. Entry is an ‘entitlement’ for students whodemonstrate an appropriate level of commitment to their studies, including goodattendance <strong>and</strong> punctuality. The college reserves the right to refuse students whohave not shown satisfactory commitment, progress or behaviour, the opportunity tocomplete their qualifications at the college.2. The final decision as to whether a student will be entered for an examination will bemade by the Principal or his delegate. The term ‘examination’ is also taken to meanother forms of external assessment, for example, AS/A2 or BTEC courseworkunits.3. When a student is placed on a stage 2 disciplinary contract their examinationstatus will automatically change to ‘Non-Entry’. Parents will be written to in order toinform them of this change <strong>and</strong> to ask them to attend the next review meeting.4. <strong>Student</strong>s will remain on Non-Entry until the start of the summer term, regardless ofwhether they are subsequently removed from the Stage 2 <strong>Disciplinary</strong> contract. Atthe start of the summer term the <strong>College</strong> Director will determine whether thestudent should be entered for their examinations. The <strong>College</strong> Director has twooptions: Restore entry status – the student is allowed to take their exams <strong>and</strong> thecollege pays the costs of exam fees in line with its normal practice. Non-entry– the student will not be entered for the final examination units thatsummer for one or more of their qualifications. This decision will not be subjectto appeal or a further probationary period. Where non-entry status applies, thestudent will not be able to take the final examination units as an externalc<strong>and</strong>idate at the <strong>College</strong>. The <strong>College</strong> will not accept any responsibility for8


finding an alternative exam centre at which the student may sit theexamination(s).5. It should be noted that Non-Entry status only applies to summer exam unitsSuspension1. A suspension is used when a sudden, serious incident arises within the <strong>College</strong> <strong>and</strong>temporary removal of the student for a short, fixed period of time is necessary for oneof the following reasons:1.1.1 To enable an investigation of a serious matter, within the <strong>College</strong> or by thepolice, to take place. The purpose of the suspension would be to remove apossible threat that might be posed by the students under investigationduring this period. (Information coming to light during the period ofsuspension may be used in judgments made regarding any futuredisciplinary action that follows)An investigation should normally be conducted by a <strong>College</strong> Director or the VicePrincipal1.1.2 To make a strong statement to the student population regarding certainserious breaches of college’s expectations. This might include thedistribution by e-mail or other means of materials likely to offend, grossdisregard for the <strong>College</strong> EO policy, gross disregard for the <strong>College</strong> stanceon care of the environment to include smoking, violence or the threat ofviolence to others, failure to respond when cautioned about inappropriatebehaviour <strong>and</strong> serious breaches of the <strong>College</strong>’s values, beliefs <strong>and</strong>behaviours. Some serious breaches may be treated as criminal activity.1.1.3 Other serious breaches of college expectations at the Principal's discretion.2. Prior to suspension a meeting will be held with the student to explain the reasons forsuspension. This will be attended by the <strong>College</strong> Director <strong>and</strong> Principal or VicePrincipal. This meeting will be followed up with a letter or email communication to thestudent <strong>and</strong> their parents/carers regarding a suspension from college. It will includethe reason for suspension, the type of suspension (fixed term or indefinite), proposedday of re-admission (if appropriate <strong>and</strong> normally no longer than ten working days fromthe day of suspension), procedures for appeal <strong>and</strong> where appropriate arrangementsfor students to continue with their studies <strong>and</strong> to take examinations. A member of theSLT support team will take notes of the meeting.3. When a student is suspended, a meeting will be arranged with the student <strong>and</strong> aparent/carer (16-18 students). This meeting will normally be attended by the <strong>College</strong>Director, Principal or Vice Principal. In the case of students over the age of 18 at firstenrolment at the college, the students can be accompanied by another person aged 18years or over <strong>and</strong>/or another adult. The purpose of the meeting will be to establish theconditions on which the student may return to <strong>College</strong> <strong>and</strong>, if appropriate, when. Themeeting will also establish arrangements for students to continue with their <strong>College</strong>studies at home. If the Principal is considering expulsion this should be stated9


explicitly at the meeting. This meeting will be followed up with a letter or emailcommunication from the Principal or Vice Principal to confirm the outcomes of themeeting. A member of the SLT Support Team will take notes of the meeting.4. The Principal will notify the Chair/Vice Chair of the Corporation of any cases ofsuspension.Expulsion1. In making a judgement about expulsion the over-riding considerations for thePrincipal will be: the potential threat to college staff <strong>and</strong> students of physical violence the threat posed by extreme forms of harassment, bullying,victimisation or discriminatory behaviour the threat caused by alcohol or drug abuse the threat to college property or other’s possessions the threat posed by the possession of offensive weapons on collegepremises the threat posed by interference with college health <strong>and</strong> safetymeasures the threat posed by the student to themself blatant <strong>and</strong>/or persistent issues which have not been resolved byStage 2 Discipline2. An investigation will normally be conducted by a <strong>College</strong> Director or the VicePrincipal. The decision to proceed to expulsion may result when a studentdisputes the evidence about failure to keep a Stage 2 Discipline contract.3. If expulsion is a possible outcome the <strong>College</strong> will convene a hearing with thestudent <strong>and</strong> parent/carer or another person over 18. <strong>Student</strong>s over the age of 18may elect to be accompanied by another person over the age of 18 to supportthem. A member of the SLT Support Team will minute the meeting.4. Following the hearing the <strong>College</strong> will reach a decision on expulsion. This will becommunicated in writing to students <strong>and</strong> parents/carers. If the decision is to expelthe information provided will include the reason for expulsion <strong>and</strong> procedures forappeal.5. The Principal will notify the Chair/Vice Chair of the Corporation of any cases ofexpulsion.6. Any suspension or expulsion against which an appeal is made, shall continue tooperate pending the determination of the appealAppeals against Suspension or Expulsion1. In cases of suspension or expulsion, the student, or the parent/carer if the studentis under 18, has the right of appeal to an Appeals Committee of the <strong>College</strong>Corporation. The Chair of the Corporation must be notified within 10 working daysa suspension or expulsion of any decision to appeal. The student or parent/carer10


must clearly identify the reasons for the appeal in their notification. A meeting of anAppeals Committee must then be held within 10 working days of receipt of thenotification to appeal2. The Appeals Committee will consist of up to three members of the <strong>College</strong>Corporation not including the Principal. The Principal or delegated alternative canrequest the attendance of another member of the <strong>College</strong> staff to present thecollege case for expulsion. <strong>Student</strong>s aged 16-18 must attend the appealsprocedure. If a student does not attend the appeal committee, the appeal will beconsidered to be withdrawn. A parent/carer would normally accompany to supportstudents aged 16-18 who attend the meeting of the Appeals Committee. <strong>Student</strong>saged over 18 may elect to be accompanied by another person over the age of 18<strong>and</strong>/or another adult to support them.3. Should a student wish to be legally represented, the Appeals Committee must beinformed at least five working days before the meeting of the Appeals Committee.All attendees at the meeting will be given the opportunity to make a statement <strong>and</strong>to ask questions.4. All parties must be informed of the outcome as soon as possible (no later than fiveworking days after the meeting) in writing.5. When a student has exhausted the college’s appeal procedures, the student hasthe right to make a complaint to the Skills Funding Agency <strong>and</strong> would be providedwith information on this should the appeal be rejected.6. Appeals against being placed on Stages 1 or 2 of the disciplinary procedure orassociated outcomes6.1.1 In cases of students disputing the reason for being placed on any stage of thedisciplinary procedure or the outcomes of a Stage 1 or 2 Discipline the studentshould write to the Vice Principal.6.1.2 In their letter the student should state why they are disputing the decisionsreached or, if relevant, of any mitigating circumstances that they wish to bringto the Vice Principal’s attention.6.1.3 The Vice Principal will normally arrange a meeting with the appellant. <strong>Student</strong>saged 16 – 18 will be invited to bring a parent/carer to the meeting with them.Alternatively, they may choose to bring a friend. For students on Stages 1 <strong>and</strong>2 Discipline the meeting will be minuted by a member of the SLT Support Team<strong>and</strong> attended by the <strong>College</strong> Director.6.1.4 Prior to the meeting the VP will gather evidence from teaching <strong>and</strong> tutoring staff<strong>and</strong> peruse the student’s file.6.1.5 Possible outcomes of the meeting are:• No change to the original application of the student disciplinary process• An extension of a Stage 1 or 2 Discipline to give students an opportunity todemonstrate improvement (usually with associated conditions defined bythe VP)• Removal or reduction of a Stage 1 or 2 Discipline11


6.1.6 Outcomes will be conveyed to the student (<strong>and</strong> parent/carer of students aged16 – 18) by letter or email communication within 2 working days of the appealmeeting.6.1.7 The decision of the Vice Principal is final.Removal of a student from the <strong>College</strong> roll in the absence of use of a stageddisciplinary process1. In the event of sustained absence of more than two weeks with no contact from thestudent <strong>and</strong>/or no response to college contacts, the <strong>College</strong> may not have had theopportunity to utilise the stages of its disciplinary procedures <strong>and</strong> as such will senda letter giving 7 calendar days’ notice of its intention to remove the student from the<strong>College</strong> roll back dated to the last date of attendance.2. A student will have a right of appeal against the decision to remove them from the<strong>College</strong> roll. Any appeal should be made in writing to the Vice Principal stating thegrounds on which the appeal is made. In their letter the student should state whythey are disputing the decision to remove them from the <strong>College</strong> roll or, if relevant,any mitigating circumstances that they wish to bring to the Vice Principal’sattention.3.
