Beginning in 2007, SSA implemented a backlog reduction plan that led to anincreased number of dispositions. From 1999 to 2003 (with a one-time exception in 2002), SSAwas unable to hire ALJs because of Azdell v. James, a lawsuit that arose out of changes that the Office ofPersonnel Management (the agency that has responsibility for the initial examination, certification forselection, and compensation of ALJs) made in 1996 to the scoring formula that is used to rate and rankpotential ALJs. Even after the lawsuit was resolved in 2003, OPM did not open its hiring process to newapplicants until 2007.
