(c) Top of tender.116. Oil tanks.Top of tender behind fuel space shall be kept clean, <strong>and</strong> means provided to carry off excesswater. Suitable covers shall be provided for filling holes.The oil tanks on oil burning steam locomotives shall be maintained free from leaks. The oil supplypipe shall be equipped with a safety cut-off device that:(a) Is located adjacent to the fuel supply tank or in another safe location;(b) Closes automatically when tripped <strong>and</strong> that can be reset without hazard; <strong>and</strong>(c) Can be h<strong>and</strong> operated from clearly marked locations, one inside the cab <strong>and</strong> one accessiblefrom the ground on each exterior side of the steam locomotive.Appendix A - Exclusions & ExceptionsThese St<strong>and</strong>ards do not apply to locomotives used exclusively in tourist excursion train service thattravels no further than a round trip of 150 miles (240 km) at a speed not exceeding a maximum of 25mph (40 km/h) if:a) the locomotive owner uses these st<strong>and</strong>ards as a guide <strong>and</strong> consults with the locomotiveoperator <strong>and</strong>/or railway to establish appropriate inspection, safety criteria <strong>and</strong> speedrestrictions to be applied exclusively in tourist trains; <strong>and</strong>b) the locomotive operator files railway schedules with Transport Canada that specify thelocations of the service, the round trip distance, the type of equipment operated, along with theapplicable inspection, safety criteria, <strong>and</strong> any other restrictions imposed on the operation ofsuch equipment, 90 days prior to operation.c) the locomotive owner/operator complies with Part V of the Canadian Occupational Safety <strong>and</strong>Health Regulations <strong>and</strong> provides Transport Canada upon request with a current copy of theNBIC inspection report required by that Part V of the Canadian Occupational Safety <strong>and</strong>Health Regulations.
