Documentation providing evidence for persons qualified under this section shall be recorded <strong>and</strong>maintained by the locomotive owner <strong>and</strong>/or operator.5. Person qualified to operateA person who is qualified to operate a steam locomotive shall:(a) be qualified according to the Canadian Railway <strong>Operating</strong> Rules (CROR), <strong>and</strong>(b) be qualified to inspect steam locomotives as required in Section 4 (b) <strong>and</strong>(c) have received classroom training on how to operate steam locomotives, <strong>and</strong>(d) have demonstrated knowledge by means of a written or oral examination, <strong>and</strong>(e) have received no less than 6 months practical experience through on the job trainingunderthe guidance <strong>and</strong> direction of another qualified operator, or other equivalent practicalexperience as required by the Railway.Documentation providing evidence for persons qualified under this section shall be recorded <strong>and</strong>maintained by the locomotive owner <strong>and</strong>/or operator.6. Preemptive effectExcept as provided herein, this st<strong>and</strong>ard preempts any local or provincial rule, regulation, st<strong>and</strong>ardor order covering the same subject matter regarding the inspection, maintenance or operation ofsteam locomotives <strong>and</strong> boilers while on railway tracks subject to federal jurisdiction.7. ExemptionsAny exemptions to any part of these st<strong>and</strong>ards must be submitted at least 90 days in advance toeach affected railway company(s) for approval. Such an exemption, if approved, will be valid onlyfor operation on that railway companies tracks. Separate exemptions are required in order tooperate on another railway.8. Responsibility for compliance.The railway company is directly responsible to Transport Canada for compliance to all parts of thisst<strong>and</strong>ard <strong>and</strong> to any other rule, regulation or order imposed under the Railway Safety Act.Prior to the operation of any steam locomotive on a federal railway, the railway company shallprovide Transport Canada with a current copy of Form No. 4 as described herein, <strong>and</strong> a currentcopy of the NBIC inspection report required by Part V of the Canadian Occupational Safety <strong>and</strong>Health Regulations.
