The locomotive owner <strong>and</strong>/or operator, if other than a railway company, is directly responsible tothe railway company for ensuring that all requirements of this st<strong>and</strong>ard are satisfied, <strong>and</strong> is theentity primarily responsible for compliance with this st<strong>and</strong>ard.Although the duties imposed by this st<strong>and</strong>ard are generally stated in terms of the duties of arailway or a steam locomotive owner <strong>and</strong>/or operator, any person, including a contractor for arailway, who performs any function covered by this st<strong>and</strong>ard must perform that function inaccordance with this st<strong>and</strong>ard.9. Definitions.As used in this st<strong>and</strong>ard, terms listed in this section have the following definitions:Alteration.ANSI.API.ASME.Boiler surfaces.Break.Code of originalconstruction.Crack.Dead locomotive.Fire.Any change to the boiler which affects its pressure retention capability.Rating changes are considered alterations.American National St<strong>and</strong>ards Institute.American Petroleum Institute.American Society of Mechanical Engineers.The boiler interior is all the space inside a boiler occupied by water orsteam under pressure, <strong>and</strong> all associated surfaces inside that space exposedto that water <strong>and</strong> steam. The boiler exterior is the opposite surface of allcomponents directly exposed to the boiler interior. This includes the fireside of the firebox sheets.A fracture resulting in complete separation into parts.The manufacturer's or industry code in effect when the boiler wasconstructed. If the exact code is not known, the closest contemporary codemay be used provided it does not pre-date the construction date of theboiler.A fracture without complete separation into parts, except that castings withshrinkage cracks or hot tears that do not significantly diminish the strengthof the member are not considered to be cracked.A locomotive unable to produce tractive effort.Anything that produces products of combustion that heat transferringcomponents of the locomotive are exposed to.Government agency. Any government agency, or representative or inspector of such agency,who has jurisdiction over railway locomotives <strong>and</strong>/or steam pressurevessels in a location where any work or operation referred to in thisst<strong>and</strong>ard may take place.<strong>Locomotive</strong> operator. Person or entity which operates, but which does not necessarily own, one ormore steam locomotives. This term means, for purposes of inspection <strong>and</strong>maintenance responsibility, the entity responsible for the day-to-dayoperation of the steam locomotive, or the delegate thereof.
