7.3. EVALUATION OF PART- II SUBMISSION7.3.1 Jharia Rehabilitation and Development Authority shall mark the proposal of thebidder in accordance to the lowest financial involvement of Jharia Rehabilitation andDevelopment Authority. The offer which is found most economical to JhariaRehabilitation and Development Authority in terms of financial involvement shall beranked first and so on.7.3.2 The Qualified Bidder ranked first would be the Preferred Bidder.7.3.3 In case there are two or more Bidders quoting the same best Financial Proposal,Jharia Rehabilitation and Development Authority may in such case call all suchBidders for negotiations and select the Preferred Bidder on the outcome of thenegotiations. The selection in such cases shall be at the sole discretion of JhariaRehabilitation and Development Authority.7.3.4 JRDA reserves the right to reject any Proposal, if:At any time, a material misrepresentation is made or discovered or the Bidder doesnot respond promptly and diligently to requests for supplemental infomation requiredfor the evaluation of the Proposal.Rejection of a Proposal by JRDA as aforesaid would lead to the disqualification ofthe Bidder. If the Bidder is a Consortium, then the entire Consortium would bedisqualified / rejected. If such disqualification / rejection occur after the Proposalshave been opened and the Preferred Bidder gets disqualified / rejected, then JRDAreserves the right to:o Either select the next best Bidder, or o Take any such measure/s as may be deemed fit in the sole discretion ofJRDA, including annulment of the bidding process. 7.3.5. To assist in the examination and comparison of Proposals, JRDA may utilize theservices of consultant(s) or advisor(s).7.3.6. Notwithstanding anything contained in this Bid Document, JRDA reserves the rightto accept or reject any Proposals, or to annul the bidding process or reject allProposals, at any time without any liability or any obligation for such rejection orannulment and without assigning any reasons thereof.Page 16 of 52
8. AWARD OF PROJECT8.1 In the event of acceptance of the Preferred Bidder with or within negotiations, JRDAshall declare the Preferred Bidder as the Successful Bidder. JRDA will notify theSuccessful Bidder through a Letter of Intent (hereinafter referred to as “LoI”) induplicate that its Proposal has been accepted.8.2 The successful bidder in turn would acknowledge the receipt of LoI through a Letterof Acceptance (hereinafter referred to as “LoA”) along with a copy of the LoI dulysigned with seal within 7(seven) days of receipt of LoI.8.3 The Successful Bidder then shall execute an agreement for execution of the project.This shall be known as “The Execution Agreement” and it has to be signed withinsuch time as may be mutually agreed between this Authority and the successfulbidder.8.4 The Execution Agreement shall be drafted in accordance with the terms of referencesof the Bid Document for Survey work, Valuation work, Preparation of PIC’s andData Compilation Work.8.5 The initial draft of the Execution Agreement shall be provided by JRDA within15(fifteen) days after the receipt of the LoA and the performance guarantee. The samecan be finalized after mutual discussion without any deviation from project guidelinesand the terms of the bid. EMD of the selected bidder of the project can only be refundedafter the signing of the Execution Agreement.9. EARNEST MONEY DEPOSIT (EMD)9.1 Along with Part-I submission, the bidders shall submit an earnest money deposit ofRs. 91,900/- only in the form of Bank Draft or Bankers Cheque of anyNationalised/Scheduled Bank in favour of JRDA payable at Dhanbad in a separatesealed envelope.9.2 The EMD of every unsuccessful Bidder would be returned within a period of eight(8) weeks from the date of announcement of the Successful Bidder, i.e. after receiptof LoA from the successful bidder.9.3 The EMD submitted by the Successful Bidder would be released upon furnishing ofthe Performance Guarantee, by way of an irrevocable Bank Guarantee, issued by aPage 17 of 52
