➤ <strong>The</strong> Criminal <strong>Justice</strong>System will beresponsive <strong>to</strong> the needsof female offendersand their families.“Respect. Take us seriously andunderstand the trauma that wehave been through. ”Female victim<strong>The</strong> Commission has a vision of a criminaljustice system which recognises that equalitydoes not require that women offenders shouldbe treated the same as male offenders butrather that women offenders should be treatedappropriately according <strong>to</strong> need. <strong>The</strong>re will berespect for the rights of women in cus<strong>to</strong>dy,including their dignity, privacy and access<strong>to</strong> legal advice. Women with mental healthproblems will be diverted <strong>from</strong> the criminaljustice system in<strong>to</strong> health and social care attheir initial stage of contact with the justicesystem. Non-violent female offenders will not begiven cus<strong>to</strong>dial sentences but will be diverted<strong>to</strong>wards services in the community <strong>to</strong> addressthe causes of their offending behaviour, and<strong>to</strong> ensure they can continue <strong>to</strong> parent theirchildren.Sentencers, and the wider community, will haveconfidence in the community alternatives <strong>to</strong>cus<strong>to</strong>dy in their local area. <strong>The</strong> current femaleprison estate will be phased out and replacedwith small cus<strong>to</strong>dial units, designed specificallyfor the needs of female offenders and theirfamilies, in each county area. <strong>The</strong>se smallcus<strong>to</strong>dial units will operate alongside a networkof gender specific community provision.Page 87
