SUMMARY OF SUBMISSIONS:Rezoning requestsIntroductionRezoning requests are those submissions that request a specific change for a property or propertiesto enable a different range of developments to be undertaken on the subject land. Some of therequests are for additional subdivision potential for a parcel of land. As the draft Shoalhaven LEP2009 has a Lot Size map, a change of zone would not actually be required in all situations where achange to the Lot Size map would suffice. For further information on how rezoning requests arelikely to be considered, please see Fact Sheet 5: Rezoning Requests/ Proposals.Where a person has made multiple submissions, theses submissions have been grouped togetherand only one number assigned per person. These numbers correspond to folders containing copiesof all the submissions which will be made available to all Councillors prior to the series of Councilmeetings being held to consider the outcomes of the exhibition. Please note submissions have been summarised as best as possible given the number ofsubmissions and the resources available. Please keep enquiries on these summaries to a minimumto allow staff to continue to prepare the reports to be considered at the Council meetings.SummariesNo. Summary Propertyaddress1 Rezone a 1.6 ha site at Princes Highway, Lots 3 & 5Bomaderry from proposed R5 Large Lot DP 619493,Residential to B5 Business Development toenable continued improvement of the Princes Highwayproperty which contains a 20 suite motel. DRAFT SHOALHAVEN LEP 2009 – SUMMARIES OF REZONING REQUESTSNo. Summary Propertyaddress60 Support the proposal to zone the subject Lots 5 – 7 DPland, Zone B4 Mixed Use.1123774Requests that no clause having a similareffect to the present clause 20B of theShoalhaven Local Environmental Plan1985 (SLEP 1985) be included over theland, particularly Lots 5 &6 as developmentfor tourist purposes is not viable on thesesmaller allotments. The clause restrictingpermanent occupation to 25% wouldunreasonably impact on the range of usesthat would otherwise be permitted in theproposed B4 Mixed Use zone. It is overlyrestrictive and contrary to a sound planningapproach to future development of theland. This is particularly the case for thesmaller two (2) of the three allotments(Lots 5 & 6).61 Requests that the zoning of part of the landbe changed to R2 Low Density Residential.62 The proposal seeks to create 3 ruralresidential in return for dedication of land toNational Parks.
