General InformationAdmission <strong>to</strong> Schools in Newcastle upon Tyne Local Authority AreaNewcastle Local Education Authority (LA) is responsible for determining <strong>the</strong> admissionarrangements for Community Schools in Newcastle. Nurseries plan a wide range <strong>of</strong> activities <strong>to</strong> help children enjoy learningthrough play.In addition, Day Nurseries <strong>of</strong>fer full-time and part-time places and are open weekdays, manyfrom 8am <strong>to</strong> 6 pm.Section 3 describes how <strong>to</strong> apply for a nursery place.16

This means that eachCommunity First School is linked <strong>to</strong> (“feeds in<strong>to</strong>”) a designated Middle School and each MiddleSchool is linked <strong>to</strong> a designated High School. Each Community Primary School is linked <strong>to</strong> adesignated Secondary School or The Excelsior Academy.The Church <strong>of</strong> England First and Primary Schools feed in<strong>to</strong> designated Community Schools orin<strong>to</strong> The Excelsior Academy.The Roman Catholic schools in Newcastle also operate a feeder school system. If you live outside <strong>the</strong> City, you may apply <strong>to</strong> send your child <strong>to</strong>a school in Newcastle. If you live in Newcastle, you have <strong>the</strong> right <strong>to</strong> apply for a place in aschool outside Newcastle.The admissions authority for <strong>the</strong> school considers applications in accordance with its publishedarrangements for processing admissions and <strong>transfer</strong>s and <strong>the</strong> criteria for allocating places.We try <strong>to</strong> meet parental preferences as far as possible.Please consider your preferences carefully as it will not be possible <strong>to</strong> make changes, unless<strong>the</strong>re is a genuine reason for doing so.Voluntary Aided Schools in Newcastle have different arrangements which are described inSection 7 <strong>of</strong> this handbook.Offer <strong>of</strong> a place for your childIf <strong>the</strong>re are more places available than applicants, all applicants will be accepted and you willbe <strong>of</strong>fered a place.If you are not <strong>of</strong>fered a place at one <strong>of</strong> your preferred schools because it is over-subscribed youwill be advised <strong>of</strong> your right <strong>to</strong> appeal against <strong>the</strong> decision.If we are unable <strong>to</strong> <strong>of</strong>fer you a place in any <strong>of</strong> your preferred schools you will be <strong>of</strong>fered a placeat <strong>the</strong> nearest available school <strong>to</strong> your home address. You will also be advised <strong>of</strong> alternativeschools that have places available.Waiting ListsIf a place is not available for your child his or her name will be held on a waiting list. General InformationAdmission <strong>to</strong> Schools in Newcastle upon Tyne Local Authority AreaAdmission <strong>to</strong> a Year Group outside <strong>the</strong> normal age rangeEarly entry or deferred entry <strong>to</strong> Primary or First SchoolThe Authority considers that it is in <strong>the</strong> best interests <strong>of</strong> your child <strong>to</strong> enter formal <strong>education</strong> asearly as possible and in <strong>the</strong> appropriate year group.Most children will be admitted <strong>to</strong> a school within <strong>the</strong>ir own age group but it is possible for you <strong>to</strong>request a place outside your child’s normal age group in exceptional circumstances.If you think that your child should be in a lower age group or a higher one <strong>the</strong>n please contactyour child’s school in <strong>the</strong> first place. If your child is not in school please contact <strong>the</strong> school <strong>to</strong>which you would like your child admitted.A decision will be made in consultation with appropriate pr<strong>of</strong>essionals, such as an <strong>education</strong>psychologist, a welfare <strong>of</strong>ficer and <strong>the</strong> Headteacher.Early or deferred entry must be agreed with <strong>the</strong> Headteacher. General InformationAdmission <strong>to</strong> Schools in Newcastle upon Tyne Local Authority AreaIndependent and boarding schoolsWith <strong>the</strong> exception <strong>of</strong> children with special <strong>education</strong>al needs, we do not make anyarrangements for <strong>the</strong> provision <strong>of</strong> <strong>education</strong> at schools not maintained by <strong>the</strong> Local Authority(LA).Information on independent schools is available from <strong>the</strong> Independent Schools Council.Telephone 020 7766 7070 www.isc.co.ukEducation for pupils with disabilitiesSchools are under a duty <strong>to</strong> make reasonable adjustments <strong>to</strong> ensure that pupils with disabilitiesare not placed at a substantial disadvantage, although you should note that this does not apply<strong>to</strong> <strong>the</strong> provision <strong>of</strong> auxiliary aids and services or <strong>to</strong> physical adaptations <strong>to</strong> buildings.Education for children who have special needsIf you have concerns about your child's needs or <strong>education</strong>al progress you should contact<strong>the</strong> school in <strong>the</strong> first instance.All schools are required <strong>to</strong> have a clear policy for special <strong>education</strong>al needs and should provideyou with a copy on request.The needs <strong>of</strong> most children can be met in mainstream schools and all schools in <strong>the</strong> city canprovide for pupils with special <strong>education</strong>al needs. Additional information about support forchildren with special needs can be found in Section 6.A number <strong>of</strong> mainstream schools have additionally resourced centres (ARC) that provide arange <strong>of</strong> specialist staff and facilities for children with special <strong>education</strong>al needs. These arelisted in <strong>the</strong> tables <strong>of</strong> information on every school in Newcastle which can be found in section 5.For children whose special <strong>education</strong>al needs cannot be met in a mainstream school <strong>the</strong>re are5 Special Schools.For a minority <strong>of</strong> children, nei<strong>the</strong>r a special school, an ARC placement nor mainstream schoolis appropriate. In <strong>the</strong>se cases <strong>the</strong> LA pays for placements in independent and non-maintainedspecial schools.If your child has special needs but not a statement, your application for a school place will beconsidered on <strong>the</strong> basis <strong>of</strong> <strong>the</strong> school’s published admission criteria.Children with statements <strong>of</strong> special <strong>education</strong>al need that name a school are required <strong>to</strong> beadmitted <strong>to</strong> <strong>the</strong> school that is named. The admission authority (even when it is <strong>the</strong> governingbody) does not have <strong>the</strong> right <strong>to</strong> refuse admission. Children with statements naming schoolscount <strong>to</strong>ward <strong>the</strong> admission number and have a priority in admission arrangements.21

This will give you time <strong>to</strong> visit<strong>the</strong> new school and <strong>to</strong> consider all <strong>the</strong> options within <strong>the</strong> same timescales as o<strong>the</strong>r parents andcarers. As parent or carer you have <strong>the</strong> right <strong>to</strong> state a preference for <strong>the</strong> school you wish yourchild <strong>to</strong> attend.Your child’s statement must be amended by 15 February 2009.Your views, and <strong>the</strong> recommendations <strong>of</strong> <strong>the</strong> annual review, will be considered. Twice Excluded PupilsIf a child has been permanently excluded from two or more schools a parent may stillexpress a preference for a school place but <strong>the</strong> requirement for <strong>the</strong> Admission Authority<strong>to</strong> comply with <strong>the</strong> parent’s request is removed for a period <strong>of</strong> 2 years from <strong>the</strong> date onwhich <strong>the</strong> latest exclusion <strong>to</strong>ok place.2. Pupils with Challenging BehaviourAn Admission Authority must not refuse <strong>to</strong> admit a child on <strong>the</strong> basis <strong>of</strong> <strong>the</strong>ir behaviourelsewhere (unless <strong>the</strong> child has been excluded twice). Where <strong>the</strong>re are more applications for admission thanplaces available, <strong>the</strong> following ranked criteria will be used <strong>to</strong> determine which children will beallocated places after children with Statements <strong>of</strong> Special Educational needs where <strong>the</strong>statement names a specific school.1. Children in public care (looked-after children).2. Where <strong>the</strong>re will be an older bro<strong>the</strong>r or sister in attendance at <strong>the</strong> school at <strong>the</strong> date <strong>of</strong>admission.3. Children with a special medical condition. Any relevant medical condition must be madeknown at <strong>the</strong> time <strong>the</strong> application for a place is made. A medical certificate is required if <strong>the</strong>application is <strong>to</strong> be considered on this basis and may be referred <strong>to</strong> <strong>the</strong> health authority forconsideration – we must be satisfied that <strong>the</strong>re is a specific medical reason which makesattendance at a particular school essential.4. Starting School – First and Primary SchoolClass Size Restrictions in Key Stage 1Key Stage 1 includes Reception, Year 1 and Year 2 in First and Primary schools.All schools must follow class size legislation in Key Stage 1 (ages 4 <strong>to</strong> 7). Schools are notallowed <strong>to</strong> have more than 30 children <strong>to</strong> one qualified teacher in any Key Stage 1 class,including reception classes.Once this limit <strong>of</strong> 30 children <strong>to</strong> one teacher is reached and your child is refused admission <strong>the</strong>n<strong>the</strong>re are only very restricted grounds for appeal. An Appeal Panel can uphold your appeal onlyif <strong>the</strong>y are satisfied that ei<strong>the</strong>r:• The decision <strong>to</strong> refuse admission was not one which a reasonable Admission Authoritywould make in <strong>the</strong> circumstances <strong>of</strong> <strong>the</strong> case; or• The child would have been <strong>of</strong>fered a place if <strong>the</strong> admission arrangements had beenproperly implemented.The Appeal Panel members must consider whe<strong>the</strong>r or not <strong>the</strong> Local Authority has satisfied<strong>the</strong>m that <strong>the</strong>ir decision <strong>to</strong> refuse admission was reasonable in accordance with admissionlegislation and that <strong>the</strong> admission procedures were properly implemented. If this is shown <strong>to</strong>be <strong>the</strong> case, <strong>the</strong> Panel is obliged <strong>to</strong> dismiss <strong>the</strong> appeal.Your child may be refused a place at a school on <strong>the</strong> grounds that <strong>the</strong> admission would causeclass size prejudice. Class size prejudice means that a school would not be able <strong>to</strong> keep <strong>to</strong> <strong>the</strong>30:1 class size limit unless extra measures were taken, such as <strong>the</strong> need <strong>to</strong> provide an extrateacher or classroom or even a reorganisation <strong>of</strong> classes. Fac<strong>to</strong>rs relevant <strong>to</strong> <strong>the</strong> admissionauthority’s decision could be:• Where <strong>the</strong> introduction <strong>of</strong> an extra pupil would necessitate <strong>the</strong> introduction <strong>of</strong> mixed-agedteaching in a school previously operating in single year groups• Whe<strong>the</strong>r <strong>the</strong> admission <strong>of</strong> <strong>the</strong> child would lead <strong>to</strong> a breach <strong>of</strong> <strong>the</strong> limit fur<strong>the</strong>r up <strong>the</strong> system– some schools decide <strong>to</strong> have small reception classes with larger year 1 and year 2classes (e.g. admission number <strong>of</strong> 45 with 2 reception classes <strong>of</strong> 22 and 23 and 3 mixedyear 1and year 2 classes <strong>of</strong> 30). Admitting extra pupils <strong>to</strong> <strong>the</strong> reception class would notbreach <strong>the</strong> limit in that year but could do so in future years.You will find information about how <strong>to</strong> appeal in Section 2 in this handbook.Exception <strong>to</strong> Key Stage 1 Class Size LegislationException <strong>to</strong> <strong>the</strong> class size legislation is possible only in very limited circumstances, forexample where a child is in receipt <strong>of</strong> a Statement <strong>of</strong> Special Educational Needs naming <strong>the</strong>school in question, or where a child has moved in<strong>to</strong> an area during <strong>the</strong> school year and <strong>the</strong>re isno o<strong>the</strong>r school within a reasonable distance from home. In ei<strong>the</strong>r case <strong>the</strong> class may remainabove <strong>the</strong> 30:1 limit only for <strong>the</strong> remainder <strong>of</strong> that school year.43

Newcastle operates a ‘feederschool’ system for its schools. The Roman CatholicPrimary schools each have a feeder link <strong>to</strong> a designated Roman Catholic Secondary school.They do not link in<strong>to</strong> Community Secondary schools.When considering applications, <strong>the</strong> governing bodies <strong>of</strong> <strong>the</strong> Roman Catholic Secondaryschools generally give priority <strong>to</strong> Baptised Roman Catholic children attending <strong>the</strong> feederPrimary schools in <strong>the</strong> school’s catchment area. We strongly advise you <strong>to</strong>nominate four preferences. This will not alter your chances <strong>of</strong> securing a place at your 1 stpreference school. The majority <strong>of</strong> 6 th form students <strong>transfer</strong> fromyear 11 in <strong>the</strong>ir current school, but all schools have places available for external students.The entry requirements for 6 th form are largely dependent on <strong>the</strong> course <strong>of</strong> study that a studentwishes <strong>to</strong> access. Attendance and behaviourThe Law on School AttendanceSchools and <strong>the</strong> local authority, through <strong>the</strong> Education Welfare Service, moni<strong>to</strong>r absence and work withfamilies and young people where <strong>the</strong> level <strong>of</strong> absence is giving cause for concern. The informationbelow explains <strong>the</strong> law, legal sanctions, prosecution procedures, definitions <strong>of</strong> absence and helpfuladvice on absence and truancy.School attendance - <strong>the</strong> lawThe law makes parents responsible for ensuring that <strong>the</strong>ir children <strong>of</strong> compulsory school age (5 <strong>to</strong> 16)receive a suitable, full-time <strong>education</strong> (Section 7, Education Act 1996). This can be ei<strong>the</strong>r by regularschool attendance or o<strong>the</strong>rwise. In Newcastle, <strong>the</strong> Education Welfare Service (on behalf <strong>of</strong> <strong>the</strong> LocalAuthority) is responsible for ensuring that parents fulfil this duty.Children not registered at school – <strong>the</strong> lawIf <strong>the</strong> local authority believes that a child <strong>of</strong> compulsory school age is not receiving a suitable <strong>education</strong>,<strong>the</strong> Education Welfare Service will attempt <strong>to</strong> encourage and support parents <strong>to</strong> register <strong>the</strong> child at aschool. If <strong>the</strong>se efforts are not successful, a school attendance order can be used <strong>to</strong> direct parents <strong>to</strong>send <strong>the</strong>ir child <strong>to</strong> a specified school (Section 437, Education Act 1996). Failure <strong>to</strong> comply with a schoolattendance order is an <strong>of</strong>fence (Section 443, Education Act 1996).Children registered at school – <strong>the</strong> lawParents are responsible for ensuring that <strong>the</strong>ir children attend school regularly. The local authority maytake legal action against parents if <strong>the</strong>ir children do not attend school regularly (Section 444, EducationAct 1996) and <strong>the</strong> absences are not authorised by <strong>the</strong> school. The procedure for <strong>the</strong> use <strong>of</strong> legalsanctions by <strong>the</strong> Education Welfare Service is available at www.newcastle.gov.uk/<strong>education</strong>.The legal sanctions that <strong>the</strong> local authority can use are:Prosecution under Section 444 (1), Education Act 1996.If a child <strong>of</strong> compulsory school age who is a registered pupil at a school fails <strong>to</strong> attend regularly at <strong>the</strong>school, his parent is guilty <strong>of</strong> an <strong>of</strong>fence. The maximum fine if found guilty is £1,000.Prosecution under Section 444 (1A), Education Act 1996 and Section 72, Criminal Justice andCourt Service Act 2000.If in <strong>the</strong> circumstances mentioned in subsection (1), <strong>the</strong> parent knows that his child is failing <strong>to</strong> attendregularly at <strong>the</strong> school and fails without reasonable justification <strong>to</strong> cause him <strong>to</strong> do so; he is guilty <strong>of</strong> an<strong>of</strong>fence. This is a more serious <strong>of</strong>fence and a warrant can be issued <strong>to</strong> make <strong>the</strong> parent attend court.Conviction can lead <strong>to</strong> a cus<strong>to</strong>dial sentence <strong>of</strong> up <strong>to</strong> 3 months; <strong>the</strong> maximum fine is £2,500.Penalty NoticeParents may be issued with a fixed penalty as an alternative <strong>to</strong> prosecution under section 444. Thepenalty is £50 if paid within 28 days, rising <strong>to</strong> £100 if paid after 28 days but within 42 days. Nonpaymentwill result in prosecution for <strong>the</strong> original <strong>of</strong>fence <strong>of</strong> irregular attendance (Section 23, Anti-socialBehaviour Act 2003, Education Act 1996 Sections 444A and 444B).An Education Supervision Order (Section 447, Education Act 1996, Section 36, Children Act 1989)The LA may apply for an <strong>education</strong> supervision order through <strong>the</strong> Family Proceedings Court. An ESOmakes <strong>the</strong> local authority responsible for advising, supporting and giving ‘directions’ <strong>to</strong> <strong>the</strong> supervisedchild and his/her parents <strong>to</strong> ensure that <strong>the</strong> child is properly educated. Where parents persistently fail <strong>to</strong>comply with reasonable directions, <strong>the</strong>y may be guilty <strong>of</strong> an <strong>of</strong>fence.107


The Education Welfare ServiceAttendance and behaviourLinks between home and schoolThe Education Welfare Service plays an important role in establishing and maintaining links betweenschool and home <strong>of</strong>fering advice and support <strong>to</strong> families mainly about school attendance. The servicecan also advise and assist with issues such as bullying, exclusion from school, special <strong>education</strong>alneeds, child employment/entertainment and where <strong>the</strong>re are child protection issues.The service accepts referrals from schools, parents/carers, children and o<strong>the</strong>r family members, statu<strong>to</strong>ryand voluntary agencies.Working in partnership with <strong>the</strong> business community, <strong>the</strong> Service recognises, celebrates and rewardsboth excellent and improved attendance. The head teacher must inform you,in writing, <strong>of</strong> <strong>the</strong> period <strong>of</strong> <strong>the</strong> exclusion and <strong>the</strong> reason for <strong>the</strong> decision. Getting <strong>to</strong> SchoolThe School JourneyAt 8:50am, one car in every five in England is involved in <strong>the</strong> school run. This is <strong>the</strong> peak timefor school travel. The number <strong>of</strong> children now travelling by car <strong>to</strong> school has more thandoubled in <strong>the</strong> last twenty years and <strong>the</strong> numbers <strong>of</strong> children walking has greatly reduced. Youare encouraged <strong>to</strong> allow your children <strong>to</strong> walk, cycle, or use public transport instead <strong>of</strong> using<strong>the</strong> car for <strong>the</strong> school journey. If you must drive, please try and car-share with ano<strong>the</strong>r parentand remember <strong>to</strong> drive and park safely.Newcastle City Council is under a duty <strong>to</strong> promote sustainable travel <strong>to</strong> schools. This will bringhealth benefits <strong>to</strong> children and parents through increased activity, gained for example throughwalking or cycling. There will also be benefits for <strong>the</strong> local community through improved roadsafety, reduced traffic congestion and associated noise and air pollution.School Travel PlansMany schools in Newcastle have developed school travel plans <strong>to</strong> encourage children andparents <strong>to</strong> use sustainable transport alternatives when travelling <strong>to</strong> and from school. Thispolicy supports <strong>the</strong> implementation <strong>of</strong> individual school travel plans by encouraging parents <strong>to</strong>make sustainable choices for <strong>the</strong> school journey. There are reduced fares available for school children and in some cases freetravel may be available. This will be decided by responses <strong>to</strong> written questionsprovided by <strong>the</strong> school, which demonstrates an appreciation <strong>of</strong> our religious and<strong>education</strong>al values.NB Verification <strong>of</strong> baptism will be required for all students in Categories A, B, C andD.Year 12 entry <strong>to</strong> Sixth FormGirls applying from outside <strong>the</strong> school will have <strong>to</strong> meet <strong>the</strong> same requirement as girlscontinuing through <strong>the</strong> school <strong>to</strong> this <strong>stage</strong>, namely <strong>the</strong> necessary grades in GCSE orequivalent <strong>to</strong> study for chosen A level subjects or vocational options.In <strong>the</strong> case <strong>of</strong> over-subscription, <strong>the</strong> same criteria would apply as for <strong>the</strong> main school.Where <strong>the</strong>re are any concerns about admission <strong>to</strong> <strong>the</strong> Sixth Form, a trial period may bearranged, at <strong>the</strong> school’s discretion, on entry <strong>to</strong> Year 12. Targets will be negotiated and agreedwith <strong>the</strong> student and <strong>the</strong>n put in writing <strong>to</strong> student and parents at <strong>the</strong> start <strong>of</strong> <strong>the</strong> trial and againat <strong>the</strong> review <strong>of</strong> progress after half a term. Where serious concerns still exist, a student may beasked <strong>to</strong> leave.Entry <strong>to</strong> a third year in Sixth Form will similarly depend on <strong>the</strong> criteria above.144
