General InformationAdmission <strong>to</strong> Schools in Newcastle upon Tyne Local Authority AreaExceptions <strong>to</strong> <strong>the</strong> Duty <strong>to</strong> Offer a School PlaceIf <strong>the</strong>re are more places available than applicants, <strong>the</strong> admission authority must accept all <strong>the</strong>applications except in <strong>the</strong> circumstances described below.1. Twice Excluded PupilsIf a child has been permanently excluded from two or more schools a parent may stillexpress a preference for a school place but <strong>the</strong> requirement for <strong>the</strong> Admission Authority<strong>to</strong> comply with <strong>the</strong> parent’s request is removed for a period <strong>of</strong> 2 years from <strong>the</strong> date onwhich <strong>the</strong> latest exclusion <strong>to</strong>ok place.2. Pupils with Challenging BehaviourAn Admission Authority must not refuse <strong>to</strong> admit a child on <strong>the</strong> basis <strong>of</strong> <strong>the</strong>ir behaviourelsewhere (unless <strong>the</strong> child has been excluded twice). If a pupil, once admitted, is found<strong>to</strong> be seriously disruptive, <strong>the</strong>n <strong>the</strong> school may consider disciplinary action, includingexclusion procedures.Exceptionally, outside <strong>the</strong> normal year <strong>of</strong> entry, an Admission Authority for certainschools may decide <strong>to</strong> refuse <strong>to</strong> admit a child with challenging behaviour where <strong>the</strong>reare places available, on <strong>the</strong> grounds that admission would prejudice <strong>the</strong> provision <strong>of</strong>efficient <strong>education</strong> or <strong>the</strong> efficient use <strong>of</strong> resources. This will normally only be where aschool has a particularly high concentration <strong>of</strong> pupils with challenging behaviour orpreviously excluded children and in ei<strong>the</strong>r case <strong>the</strong> school:• requires special measures or has recently come out <strong>of</strong> <strong>the</strong>m (within <strong>the</strong> last 2 years)or• has been given ‘notice <strong>to</strong> improve’ by Ofsted or• is subject <strong>to</strong> a formal warning notice, or• is a Fresh Start school or Academy open for less than 2 years, or• is a Secondary school where less than 30% <strong>of</strong> children are achieving 5 or moreGCSEs at grades A* - C or• a Primary school where fewer than 65% <strong>of</strong> pupils achieve Level 4 at Key Stage 2 inboth English and Ma<strong>the</strong>matics for four or more consecutive yearsIn Newcastle <strong>the</strong> only secondary school that would qualify under this regulation is <strong>the</strong>Excelsior Academy.6 primary schools had Key Stage 2 results below 65% from 2003 - 2007:-Atkinson RoadBykerHawthornSt John’sSt Anthony’s2 primary schools are in special measures:-Throckley PrimaryWestgate Hill Primary24
