Starting School – First and Primary SchoolAdmissions Policy for Newcastle Community First and Primary SchoolsYour child will be able to go to your preferred school unless there are more applications for thatschool than there are places available. Where there are more applications for admission thanplaces available, the following ranked criteria will be used to determine which children will beallocated places after children with Statements of Special Educational needs where thestatement names a specific school.1. Children in public care (looked-after children).2. Where there will be an older brother or sister in attendance at the school at the date ofadmission.3. Children with a special medical condition. Any relevant medical condition must be madeknown at the time the application for a place is made. A medical certificate is required if theapplication is to be considered on this basis and may be referred to the health authority forconsideration – we must be satisfied that there is a specific medical reason which makesattendance at a particular school essential.4. The measure of the straight line distance from the school to the home address of the child.Available places will be allocated to those applicants living the nearest.Important – proof of addressYou will be asked to provide proof of your address if the school is over-subscribed. If you donot do so when asked, or if you supply information that is fraudulent or intentionally misleadingthen the LA has the right to withdraw any offer of a school place.An offer may also be withdrawn if you do not respond to the offer and return theacceptance form by 13 March 2009.Voluntary Aided (Church) SchoolsThe governing body of each school determines the admission policy for its school. Furtherinformation about admission policies for Voluntary Aided (Church) Primary schools inNewcastle can be found in Section 7 in this handbook.The Local Authority will, on behalf of the Voluntary Aided school governing body, offer a placeto you at whichever of the schools you ranked highest.42
Starting School – First and Primary SchoolClass Size Restrictions in Key Stage 1Key Stage 1 includes Reception, Year 1 and Year 2 in First and Primary schools.All schools must follow class size legislation in Key Stage 1 (ages 4 to 7). Schools are notallowed to have more than 30 children to one qualified teacher in any Key Stage 1 class,including reception classes.Once this limit of 30 children to one teacher is reached and your child is refused admission thenthere are only very restricted grounds for appeal. An Appeal Panel can uphold your appeal onlyif they are satisfied that either:• The decision to refuse admission was not one which a reasonable Admission Authoritywould make in the circumstances of the case; or• The child would have been offered a place if the admission arrangements had beenproperly implemented.The Appeal Panel members must consider whether or not the Local Authority has satisfiedthem that their decision to refuse admission was reasonable in accordance with admissionlegislation and that the admission procedures were properly implemented. If this is shown tobe the case, the Panel is obliged to dismiss the appeal.Your child may be refused a place at a school on the grounds that the admission would causeclass size prejudice. Class size prejudice means that a school would not be able to keep to the30:1 class size limit unless extra measures were taken, such as the need to provide an extrateacher or classroom or even a reorganisation of classes. Factors relevant to the admissionauthority’s decision could be:• Where the introduction of an extra pupil would necessitate the introduction of mixed-agedteaching in a school previously operating in single year groups• Whether the admission of the child would lead to a breach of the limit further up the system– some schools decide to have small reception classes with larger year 1 and year 2classes (e.g. admission number of 45 with 2 reception classes of 22 and 23 and 3 mixedyear 1and year 2 classes of 30). Admitting extra pupils to the reception class would notbreach the limit in that year but could do so in future years.You will find information about how to appeal in Section 2 in this handbook.Exception to Key Stage 1 Class Size LegislationException to the class size legislation is possible only in very limited circumstances, forexample where a child is in receipt of a Statement of Special Educational Needs naming theschool in question, or where a child has moved into an area during the school year and there isno other school within a reasonable distance from home. In either case the class may remainabove the 30:1 limit only for the remainder of that school year.43
