<strong>EMED</strong> <strong>Mining</strong> - <strong>Biely</strong> VrchNovember 2010Explorati<strong>on</strong> for minerals, which are <strong>the</strong> property of <strong>the</strong> State, may <strong>on</strong>ly be carried out in explorati<strong>on</strong>areas (claims) granted by <strong>the</strong> Ministry. An exclusive explorati<strong>on</strong> area for a specified mineralcommodity may be granted for up to four years and is renewable for ano<strong>the</strong>r four years and anadditi<strong>on</strong>al two years. The size of <strong>the</strong> explorati<strong>on</strong> area is limited to 250 km 2 . The fee per km 2 is 100Euros (formerly 3000 Sk, now about $130) per year during <strong>the</strong> first four years period, 200 Eurosduring <strong>the</strong> sec<strong>on</strong>d period and 300 Euros during <strong>the</strong> last two year period. The first applicati<strong>on</strong>registered for a given explorati<strong>on</strong> area has priority. Explorati<strong>on</strong> areas are transferable. A specialexplorati<strong>on</strong> licence is issued for government funded explorati<strong>on</strong> projects. The special explorati<strong>on</strong>licence may be changed to an explorati<strong>on</strong> licence. In such <strong>the</strong> case <strong>the</strong> ministry organises a tender.The right to mine a mineral deposit is given by granting a mining licence and by permissi<strong>on</strong> toperform mining activity. Both are issued by regi<strong>on</strong>al mining offices of <strong>the</strong> Ministry of Ec<strong>on</strong>omy.The owner of an explorati<strong>on</strong> area (claim) has priority to apply for a mining licence within 6 m<strong>on</strong>thsfrom <strong>the</strong> approval of <strong>the</strong> mineral reserves by <strong>the</strong> State Commissi<strong>on</strong> for Classificati<strong>on</strong> of Reserves, at<strong>the</strong> Ministry of Envir<strong>on</strong>ment, and <strong>the</strong> issue of a certificate <strong>on</strong> a protected mineral deposit. <strong>Mining</strong> hasto start within three years from granting of <strong>the</strong> mining licence. A fee for <strong>the</strong> mining licence is 200Euros per km 2 per year. A system of royalties related to producti<strong>on</strong> is also used. Foreign companieshave <strong>the</strong> same rights and obligati<strong>on</strong>s as domestic <strong>on</strong>es.Envir<strong>on</strong>mental legislati<strong>on</strong>Protecti<strong>on</strong> and improvement of <strong>the</strong> envir<strong>on</strong>ment in <strong>the</strong> Slovak Republic is based <strong>on</strong> Act No. 287/1994quoted in Acts No. 222/1996, 171/1998 and 211/2000. This defines <strong>the</strong> basic terms and establishes<strong>the</strong> basic principles of envir<strong>on</strong>mental protecti<strong>on</strong> and <strong>the</strong> obligati<strong>on</strong>s of legal entities and individuals inprotecting and improving <strong>the</strong> envir<strong>on</strong>mental situati<strong>on</strong> when exploiting natural resources.Act No. 127/1994 covering envir<strong>on</strong>mental impact assessment regulates <strong>the</strong> method of professi<strong>on</strong>aland public assessment of designed c<strong>on</strong>structi<strong>on</strong>s and o<strong>the</strong>r activities prior to <strong>the</strong>ir approval, as well assome development proposals, in terms of <strong>the</strong>ir expected envir<strong>on</strong>mental impact. Mineral explorati<strong>on</strong> isnot subject to assessment of its compliance with this law, but mining activities are subject to suchassessment.In order to harm<strong>on</strong>ise <strong>the</strong> Slovak legislati<strong>on</strong> in <strong>the</strong> field of envir<strong>on</strong>mental impact assessment with <strong>the</strong>legislati<strong>on</strong> of <strong>the</strong> European Uni<strong>on</strong>, <strong>the</strong> Act No. 391/2000 Coll. amending <strong>the</strong> Act No. 127/1994 Coll.of <strong>the</strong> Nati<strong>on</strong>al Council of <strong>the</strong> Slovak Republic <strong>on</strong> envir<strong>on</strong>mental impact assessment was adopted in2000.At present, <strong>the</strong> Act No. 24/2006 Coll. <strong>on</strong> envir<strong>on</strong>mental impact assessment and <strong>on</strong> amendments tocertain acts applies, which entered into force <strong>on</strong> 1st February 2006. It regulates <strong>the</strong> envir<strong>on</strong>mentalimpact assessment, strategic documents assessment and impact assessment of c<strong>on</strong>structi<strong>on</strong>s,installati<strong>on</strong>s and o<strong>the</strong>r activities <strong>on</strong> <strong>the</strong> envir<strong>on</strong>ment. The Decree No.113/2006 Coll. Of <strong>the</strong> Ministryof Envir<strong>on</strong>ment regulates <strong>the</strong> details of <strong>the</strong> professi<strong>on</strong>al qualificati<strong>on</strong> for <strong>the</strong> purposes ofenvir<strong>on</strong>mental impact assessment.Act No. 287/1994 in Act 222/1996 covers protecti<strong>on</strong> of <strong>the</strong> envir<strong>on</strong>ment and <strong>the</strong> country. Its aim is tosupport <strong>the</strong> measures taken to preserve variety and forms of biodiversity, to create c<strong>on</strong>diti<strong>on</strong>s formaintaining, regenerati<strong>on</strong> and rati<strong>on</strong>al use of <strong>the</strong> natural resources, to protect natural heritage andcharacteristic scenery of <strong>the</strong> country and to attain and maintain ecological stability. Five levels ofprotecti<strong>on</strong> are in effect. The degree of restricti<strong>on</strong> increases with <strong>the</strong> increasing level of protecti<strong>on</strong>.The first level is a general protecti<strong>on</strong> measure applicable to <strong>the</strong> whole territory of Slovakia.
