On the basis of a noticeof intent to participate, and an adequatesubstantive response filed on behalf ofdomestic interested parties, as well as alack of response <strong>from</strong> respondentinterested parties, the Departmentconducted an expedited (120–day)sunset review. As a result of the sunsetreview, the Department finds thatrevocation of the antidumping dutyorder would be likely to lead tocontinuation or recurrence of dumping.The dumping margins are identified inthe Final Results of Review section ofthis notice.SUPPLEMENTARY INFORMATION:BackgroundOn June 5, 2008, the Departmentpublished the notice of initiation of thesunset review of the antidumping dutyorder on saccharin <strong>from</strong> the PRCpursuant to section 751(c) of the TariffAct of 1930, as amended (‘‘the Act’’).See Initiation of Five–Year (‘‘Sunset’’)Reviews, 73 FR 31974 (June 5, 2008)(‘‘Initiation Notice’’). On June 20, 2008,the Department received a notice ofintent to participate <strong>from</strong> a domesticinterested party, PMC SpecialtiesGroup, Inc. (‘‘PMCSG’’), within thedeadline specified in section351.218(d)(1)(i) of the Department’sregulations. PMCSG claimed interestedparty status under section 771(9)(C) ofthe Act as the sole domestic producer ofsaccharin in the United States and thepetitioner in the original investigation.On July 7, 2008, the Departmentreceived a substantive response <strong>from</strong>PMCSG within the deadline specified insection 351.218(d)(3)(i) of theDepartment’s regulations. We did notreceive responses <strong>from</strong> any respondentinterested parties to this proceeding. Asa result, pursuant to section 751(c)(3)(B)of the Act and section351.218(e)(1)(ii)(C)(2) of theDepartment’s regulations, theDepartment determined to conduct anexpedited review of the order.Scope of the OrderThe product covered by thisantidumping duty order is saccharin.<strong>Saccharin</strong> is defined as a non–nutritivesweetener used in beverages and foods,personal care products such astoothpaste, table top sweeteners, andanimal feeds. It is also used inmetalworking fluids. There are fourprimary chemical compositions ofsaccharin: (1) Sodium saccharin(American Chemical Society ChemicalAbstract Service (‘‘CAS’’) Registry 128–44–9); (2) calcium saccharin (CASRegistry 6485–34–3); (3) acid (orinsoluble) saccharin (CAS Registry 81–07–2); and (4) research grade saccharin.Most of the U.S.-produced and importedgrades of saccharin <strong>from</strong> the PRC aresodium and calcium saccharin, whichare available in granular, powder,spray–dried powder, and liquid forms.The merchandise subject to this order iscurrently classifiable under subheading2925.11.00 of the Harmonized TariffSchedule of the United States(‘‘HTSUS’’) and includes all types ofsaccharin imported under this HTSUSsubheading, including research andspecialized grades. Although theHTSUS subheading is provided forconvenience and customs purposes, theDepartment’s written description of thescope of this order remains dispositive.Analysis of Comments ReceivedAll issues raised in this review areaddressed in the ‘‘Issues and DecisionMemorandum’’ (‘‘DecisionMemorandum’’) <strong>from</strong> Stephen J. Claeys,Deputy Assistant Secretary for ImportAdministration, to David M. Spooner,Assistant Secretary for ImportAdministration, dated concurrentlywith this notice, and is hereby adoptedby this notice. The issues discussed inthe Decision Memorandum include thelikelihood of continuation or recurrenceof dumping and the magnitude of themargins likely to prevail if the orderwere revoked. Parties can find acomplete discussion of all issues raisedin this review and the correspondingrecommendations in this publicmemorandum, which is on file in theCentral Records Unit in room 1117 ofthe main Commerce building.In addition, a complete version of theDecision Memorandum can be accesseddirectly on the web at http://ia.ita.doc.gov/frn.
