Wetl<strong>and</strong>s are a subset <strong>of</strong><strong>the</strong> “waters <strong>of</strong> <strong>the</strong> United States” that may be subject to regulation underSection 404. One key feature <strong>of</strong> <strong>the</strong> definition <strong>of</strong> wetl<strong>and</strong>s is that, undernormal circumstances, <strong>the</strong>y support “a prevalence <strong>of</strong> vegetation typicallyadapted for life in saturated soil conditions.” Many waters <strong>of</strong> <strong>the</strong> UnitedStates are unvegetated <strong>and</strong> thus are excluded from <strong>the</strong> <strong>Corps</strong>/EPAdefinition <strong>of</strong> wetl<strong>and</strong>s, although <strong>the</strong>y may still be subject to Clean Water Actregulation. Delineation <strong>of</strong> <strong>the</strong>se waters is based on <strong>the</strong>high tide line, <strong>the</strong> “ordinary high water mark” (33 CFR 328.3e), or o<strong>the</strong>rcriteria <strong>and</strong> is beyond <strong>the</strong> scope <strong>of</strong> this Regional Supplement.
