The districtmay, without limitation by any other provisions of this part, enterinto any contract and cooperate with and accept cooperation fromthe state or the United States, or any department, instrumentality,or agency thereof, or any public agency in the acquisition,construction, maintenance, and operation of, and in financing theacquisition, construction, maintenance, and operation of, any railtransit facilities. The district may do any and all things necessaryin order to obtain the aid, assistance, and cooperation under anyfederal or state legislation now or hereafter enacted. Any evidenceof indebtedness issued under this section shall constitute anegotiable instrument.105103. The rates and charges for rail transit servicefurnished pursuant to this part shall be fixed by the board and shallbe reasonable.105104. The district shall work with the North Coast RailAuthority (NCRA), the Federal Railroad Administration (FRA)Railroad Authority, the Federal Railroad Administration, and anyof its successor agencies, to achieve safe, efficient, and compatibleoperations of both passenger rail and freight service along the railline in Sonoma and Marin Counties.105105. The district shall be responsible for any advancepayment of any portion of the North Coast Railroad Authority’sQ-Fund loan repayment obligation caused by the district’s action.Any amount advanced by the district shall be reimbursed by theNorth Coast Railroad Authority at the time the North CoastRailroad Authority’s obligation to repay that portion of theQ-Fund loan would otherwise become due.Article 5.Taxation105115. Upon the affirmative vote of a majority of thedirectors, which shall include an affirmative vote of at least threedirectors from each county within the district appointed pursuantto subdivisions (a), (b), (c), (d), (e), and (f) of Section 105020, theboard may by resolution submit to the voters of the district ameasure proposing a retail transactions and use tax ordinance inaccordance with the provisions of Part 1.6 (commencing withSection 7251) of Division 2 of the Revenue and Taxation Code.93

The district’s investment of any surplus money in itstreasury, including money in any sinking fund, shall be inaccordance with Article 1 (commencing with Section 53600) ofChapter 4 of Part 1 of Division 2 of the Government Code.105126. The district’s deposit of district money shall be inaccordance with Article 2 (commencing with Section 53630) ofChapter 4 of Part 1 of Division 2 of the Government Code.CHAPTER 5.Article 1.PERSONNELEmployee Relations105140. Except as otherwise provided in this article and inArticle 2 (commencing with Section 105150), the determinationof questions concerning employee representation and the conductof employee-employer relations within the district shall begoverned by the Meyers-Milias-Brown Act (Chapter 10(commencing with Section 3500) of Division 4 of Title 1 of theGovernment Code).105141. Except as otherwise provided in Article 2(commencing with Section 105150), whenever a majority of theemployees employed by the district in a unit appropriate forcollective bargaining indicate a desire to be represented by a labororganization, and upon determining that the labor organizationrepresents at least a majority of the employees in the appropriateunit, the board and the accredited representative of employeesshall bargain in good faith and make all reasonable efforts to reachagreement on the terms of a written contract governing wages,hours, and other terms and conditions of employment within thescope of representation set forth in Section 3504 of theGovernment Code.105142. (a) If, after a reasonable period of time,representatives of the district and the accredited representatives ofthe employees fail to reach agreement either on the terms of awritten contract governing wages, hours, and other terms andconditions of employment or the interpretation or application ofthe terms of an existing contract, upon the agreement of both the93
