The districtmay, without limitation by any other provisions of this part, enterinto any contract and cooperate with and accept cooperation fromthe state or the United States, or any department, instrumentality,or agency thereof, or any public agency in the acquisition,construction, maintenance, and operation of, and in financing theacquisition, construction, maintenance, and operation of, any railtransit facilities. The district may do any and all things necessaryin order to obtain the aid, assistance, and cooperation under anyfederal or state legislation now or hereafter enacted. Any evidenceof indebtedness issued under this section shall constitute anegotiable instrument.105103. The rates and charges for rail transit servicefurnished pursuant to this part shall be fixed by the board and shallbe reasonable.105104. The district shall work with the North Coast <strong>Rail</strong>Authority (NCRA), the Federal <strong>Rail</strong>road Administration (FRA)<strong>Rail</strong>road Authority, the Federal <strong>Rail</strong>road Administration, and anyof its successor agencies, to achieve safe, efficient, and compatibleoperations of both passenger rail and freight service along the railline in <strong>Sonoma</strong> and <strong>Marin</strong> Counties.105105. The district shall be responsible for any advancepayment of any portion of the North Coast <strong>Rail</strong>road Authority’sQ-Fund loan repayment obligation caused by the district’s action.Any amount advanced by the district shall be reimbursed by theNorth Coast <strong>Rail</strong>road Authority at the time the North Coast<strong>Rail</strong>road Authority’s obligation to repay that portion of theQ-Fund loan would otherwise become due.Article 5.Taxation105115. Upon the affirmative vote of a majority of thedirectors, which shall include an affirmative vote of at least threedirectors from each county within the district appointed pursuantto subdivisions (a), (b), (c), (d), (e), and (f) of Section 105020, theboard may by resolution submit to the voters of the district ameasure proposing a retail transactions and use tax ordinance inaccordance with the provisions of Part 1.6 (commencing withSection 7251) of Division 2 of the Revenue and Taxation Code.93
