AB <strong>2224</strong> — 20 —123456789101112131415161718192021222324252627282930313233343536373839district and the representatives of the employees, the dispute maybe submitted to an arbitration board.(b) The arbitration board shall be composed of tworepresentatives of the district and two representatives of the labororganization, and they shall endeavor to agree upon the selectionof a fifth member. If they are unable to agree, the names of fivepersons experienced in labor arbitration shall be obtained from theState Conciliation Service. The labor organization and the districtshall, alternately, strike a name from this list, and the nameremaining after the labor organization and the district havestricken four names shall be designated as the fifth arbitrator andchairperson of the board of arbitration. The labor organization andthe district shall determine by lot who shall first strike a name fromthe list. The decision of a majority of the arbitration board shall befinal and binding upon the parties thereto.(c) Each party shall be responsible for the expense of thepresentation of its case. All other expenses of arbitration shall beborne equally by the parties and the expenses may include themaking of a verbatim record of the proceedings and transcript ofthat record.105143. The district may contract for management serviceswith any public agency or person and may contract for operationsand maintenance services with the district organized pursuant toPart 3 (commencing with Section 27000) of Division 16 of theStreets and Highways Code. However, the district may notcontract out the performance of services performed by or fairlyclaimable by employees of a bargaining unit without theagreement of the accredited representative of that bargainingunit’s employees.Article 2.Transfer of Collective Bargaining Rights105150. The Legislature hereby finds and declares that thecreation of the district may adversely affect the collectivebargaining rights, wages, benefits, and employment opportunitiesof employees of the district organized pursuant to Part 3(commencing with Section 27000) of Division 16 of the Streetsand Highways Code.93
