City <strong>of</strong> Charlottetown Section 00 20 00May <strong>2012</strong>Instructions to Bidders<strong>2012</strong> Storm Pipe Construction, Package B Page 3 <strong>of</strong> 5.2 A bid bond in the amount <strong>of</strong> ten percent (10%) <strong>of</strong> the <strong>tender</strong> value, excluding GST. The bondshall be from a surety company authorized to carry on business in Canada guaranteeing tosupply a performance bond equal to fifty percent (50%) <strong>of</strong> the contract value..2 Performance Security must be filed with the Owner before work on the project commences. Thissecurity shall be held and retained by the Owner for the due and faithful performance, observanceand fulfilment by the Contractor <strong>of</strong> all the covenants, provisos, agreements, conditions andreservations in this Contract contained on the part <strong>of</strong> the Contractors to be observed, performed andcomplied with shall be in the form <strong>of</strong>:.1 A certified cheque in the amount <strong>of</strong> ten percent (10%) <strong>of</strong> the contract value, excluding GST,which shall be retained until the warranty period (one (1) year after final completion) haselapsed.or.2 A performance bond equal to fifty percent (50%) <strong>of</strong> the contract value, excluding GST, whichshall be retained until the warranty period (one (1) year after final completion) has elapsed..3 All performance security which has an expiry date which precedes the end <strong>of</strong> warranty date must berenewed prior to the time that the security would expire. The Bidder will forfeit security to the Ownerif the Bidder fails to enter into or carry out the Contract when called upon to do so.1.11 Supervision and Coordination.1 The Contractor shall be responsible for supervising and coordinating all aspects <strong>of</strong> the work.1.12 Responsibility.1 The Contractor shall be responsible to be fully familiar with the complete documents and shallinclude in his bid those items which are named, implied, or traditionally a part <strong>of</strong> the general contractwork.1.13 Guarantees.1 The Contractor shall be required to guarantee the work <strong>of</strong> this Contract for a period <strong>of</strong> twelvemonths after the Owner’s acceptance <strong>of</strong> work, against improper or defective materials andworkmanship, and shall repair and make good at his own expense any damage to the building andcontents through any <strong>of</strong> the above causes during this period. Any contract omissions and/ordeficiencies reported to the Contractor within twelve months after acceptance <strong>of</strong> the work shall bemade good by the Contractor at his own expense.1.14 Rejection <strong>of</strong> Bids.1 Tenders that are unsigned, improperly signed or sealed, conditional, illegible, obscure, containarithmetical errors, erasures, alterations, or irregularities <strong>of</strong> any kind, shall at discretion <strong>of</strong> Owner, berejected..2 Tenders with Tender Forms and enclosures which are improperly prepared shall at discretion <strong>of</strong>Owner, be rejected..3 Tenders that fail to include security deposit, bonding or insurance requirements shall at discretion <strong>of</strong>Owner, be rejected.
