R. Civ. P. 26(f), Local Rule 26-1, and this Court’s May 26, 2010 Order SettingRule 26(f) Scheduling Conference for August 2, 2010. The parties hereby submit thefollowing <strong>Joint</strong> Report detailing the results of that conference in accordance with thisCourt’s March 29, 2010 Standing Order.I. JURISDICTIONThis is an action for patent infringement arising under the patent laws of the UnitedStates of America, 35 U.S.C. §1, et. Seq., including §271. This Court has subject matterjurisdiction over this action under 18 U.S.C. §§1331 and 1338(a).II. CLAIMS AND DEFENSESA. Plaintiff’s StatementPlaintiff Jake Lee is the sole inventor and owner of United States Patent No.6,418,936 (the Patent-in-Suit) for the “Six Shooter Pipe” which duly and legally issued inhis name on July 16, 2002. Plaintiff claims that Defendants Mike’s Novelties, Inc. dbaMike’s Worldwide Imports and Manisch Chander have been offering for sale and sellingknock offs of Plaintiff’s Six Shooter Pipe with knowledge of the patent and validitythereof from 2008 to the present. Plaintiff will show at trial that Defendants have soldand continue to sell knock offs of the Six Shooter Pipe for at least the last three years,despite Plaintiff’s written and in-person warnings to Defendants to cease and desistselling the infringing Six Shooter Pipes.Plaintiff pleads a single claim for patent infringement against all Defendants andseeks injunctive relief to temporarily and permanently enjoin Defendants from offeringfor sale and selling the infringing Six Shooter Pipe for the duration of the term of thePatent-in-Suit. In addition Plaintiff seeks treble damages and attorney’s fees against allDefendants for prosecution of this action pursuant to 35 U.S.C. §§284-285.B. Defendants’ StatementIn its Complaint, Plaintiff alleges that Defendants have infringed the U.S. PatentNo. 6,418,936 entitled “Tobacco Pipe” by using, offering for sale, and selling the SixJOINT RULE 26(f) REPORT- 1 -CASE NO.
