With respect to Handal’shourly rate, the Court considered the aforementioned factors as well as Handal’s statement to the Courtthat prior to establishing his current law office, he worked with a larger law firm at which his hourly ratewas $765.In reaching this conclusion as to the fee award, the Court also has considered that: (i)Defendants did not object to either the hourly rates proposed by Plaintiff’s counsel or the number ofhours each charged; and (ii) in an aggressive response to Plaintiff’s settlement communications,Defendants’ counsel asserted that if the matter proceeded, Defendants would prevail at trial and wouldbe entitled to recover their attorney’s fees, which Defendants’ counsel estimated would beapproximately $320,000. Dushane Decl., Exh. E, Dkt. 178-2. This figure is approximately $89,000 and38.5% more than the Court’s fee award of $231,025.III.CONCLUSIONFor the reasons states in this Order, the Court GRANTS Plaintiff’s motion for enhanceddamages, and applies a 1.75 multiplier with respect to the jury award of $40,000, yielding totaldamages of $70,000.
