But, if in fact, the juryfinds that despite the presence of the spring and ball, the weight of the turret still playseven a contributory role in maintaining the turret stationary, then the claim is infringed.This Court has suggested that the question should be whether the weight of theturret in Defendants’ accused product is sufficient to maintain it stationary when thespring and ball are removed. This is the wrong analysis because Defendants sell theaccused product with the spring and ball, not without. If a consumer or user that acquiresDefendants’ accused product decides to remove the spring and ball before using it, then itis that individual who infringes the Patent-in-suit, assuming arguendo, that without thespring and ball, the turret in Defendants’ accused product is heavy enough to maintain itstationary. But that is NOT the issue in this case. The central issue is whetherDefendants’ accused product, as it is imported and sold by Defendants, infringe thePatent-in-suit.III. CONCLUSIONAccordingly, the claim construction phase of this case was completed with theCourt Order Re Claim Construction which clearly and unambiguously finds that thedisputed claim language is construed “as it is written”. See Docket Item #50. As such,this Court must respect that finding and not allow the claim construction issue to beadjudicated all over again on the eve of jury deliberations. The Court Order Re ClaimConstruction was issued after the Court reviewed the prosecution history of the Patent-insuit,prior art that had a turret maintained stationary by a spring, and other prior art that- 4 -DEFENDANTS’ PROPOSED LANGUAGE FOR JURY INSTRUCTION NO. 15CASE NO.
