I am the plaintiff in this action and in such capacity could and would testifycompetently to the following facts.2. I provide this declaration in support of my opposition to Defendants’ motionfor summary judgment to invalidate my patent for the Six Shooter pipe at issue in thiscase.3. I met Larry Addison at Jim Henson’s Creature Shop (“Henson”) in LosAngeles, California in or about 1996. Larry was my co-worker and in a short time webecame lifelong friends. After I left Henson in or about 2000, I regularly kept in touchwith Larry about my family, personal and business life experiences. Unfortunately, Larrydied of an allergic reaction to a bee sting on October 19, 2010 at just 40 years old. I was atLarry’s funeral.4. Attached hereto as “EXHIBIT A” is Larry’s obituary posted at:http://www.zirana.com/glendale/obituaries/obituary_larry_addison_bortolott_.html.5. I testified about Larry Addison at my depositions in this case on August 27,2010 and July 27, 2011. I have carefully reviewed all of my testimony with respect toLarry Addison and all other topics. I stand by all of my testimony as true and correct.6. To reiterate, Larry asked me to make a pipe for him on and off during ourtime as co-workers at Henson. I did so. I gave Larry one of the first two “Six Shooter”pipes that I created in or about May 1999. Larry did not pay me for the pipe, nor did heparticipate in the “design and development” of the pipe. I created the Six Shooter all onmy own, and filed a provisional patent application for the Six Shooter on May 14, 1999.7. I gave Larry one of the two first Six Shooter prototypes in May 1999, I toldLarry that I was going to patent the pipe.
