lu date du pa<strong>ie</strong>ment et <strong>le</strong>s périodes de travail<br />

qui correspondent au pa<strong>ie</strong>ment;<br />

<strong>le</strong> nombre d'heures norma<strong>le</strong>s;<br />

<strong>le</strong> nombre d'heures mujorées;<br />

<strong>le</strong> taux horaire du salaire;<br />

<strong>le</strong> montant du salaire brut;<br />

la nature et <strong>le</strong> montant- des retenues opérées;<br />

<strong>le</strong> montant du salaire net versé au salarié.<br />

XII. Confié annuels payés: a) Durée du<br />

congé: Tout salarié visé par <strong>le</strong> présent décret<br />

a droit à des congés payés conformément aux<br />

dispositions suivantes:<br />

1° Uu congé annuel continu payé d'une durée<br />

minimu<strong>le</strong> dc sept (7) jours après un (1) an de<br />

service continu chez un employeur,<br />

2° Un congé annuel continu payé d'une durer<br />

minima<strong>le</strong> d'autant dc demi-jours qu'il a de mois<br />

civils de service continu dans <strong>le</strong> cas où il a moins<br />

«l'un an de service continu chez un employeur.<br />

b) Période de reference: La période «<strong>le</strong> service<br />

continu chez un employeur pendant laquel<strong>le</strong><br />

un salarié acqu<strong>ie</strong>rt progressivement <strong>le</strong> droit<br />

au congé intégral, s'étend du prem<strong>ie</strong>r mai de<br />

l'année précédente au .'10 avril «<strong>le</strong> l'année en cours.<br />

c) Services continus: La «lurée des services<br />

continus signif<strong>ie</strong> la période pendant laquel<strong>le</strong> <strong>le</strong><br />

salarié est lié à son employeur par un contrat<br />

«<strong>le</strong> travail, même si l'exécution «<strong>le</strong> celui-ci a été<br />

interrompu sans f regular hours;<br />

hourly wuge rate;<br />

gross amount of wages;<br />

type and amount «)f de«luctions made;<br />

net amount of wages.<br />

XII. Annual vacation with pay: (a) Length aj<br />

vacation: Kvery employee subject to this dccr paid vacations, pursuant to the<br />

following provisions:<br />

(1) An annual paid vacation of seven (7) days'<br />

minimum «luration after one (1) year's employment<br />

with an employer.<br />

(2) When an employee has <strong>le</strong>ss than one (11<br />

year's employment with an employer, he is entit<strong>le</strong>d<br />

to an annual paid vacation equal to one<br />

half-day per ca<strong>le</strong>ndar month «>f service.<br />

(6) Qualifying period: The eontimams employ<br />

ment period with an employer during which tune<br />

an employee progressively becomes entit<strong>le</strong>d t«t a<br />

comp<strong>le</strong>te vacation extends from May 1st of thi<br />

previous year to April 30 of the current year.<br />

(c) Continuous employment: The <strong>le</strong>ngth «>!<br />

continuous employment means the period during<br />

which an employee is hound to his employer<br />

by a work contract, even though the carrying<br />

out of the contract has been interrupted without<br />

cancellation thcretd. The following cannot Im<br />

considered as interrupting the «luration of continuous<br />

employment: days of illness, if the contract<br />

has pot been cancel<strong>le</strong>d; days «»f rinsing, annua 1<br />

vacation periods, terms «>f notice, authorized<br />

absences, provided the employee has not held<br />

any other gainful employment during such time.<br />

The ca<strong>le</strong>ndar months during which an employee<br />

has not worked and the w«>rk contract has not<br />

been cancel<strong>le</strong>d may count towards the duration<br />

of continuous employment.<br />

(d) Vacation pay: Every employee with <strong>le</strong>ss<br />

than five (5) years' sen-ice is entit<strong>le</strong>d to vacation<br />

pay equal to 2 % «>f his total earnings during<br />

the qualifying period.<br />

Every employee with five (5) years' service «»i<br />

more is entit<strong>le</strong>d to vacation pay ctpial to 4','j «•!<br />

his total earnings during the «pialifying period<br />

The gross total earnings includes all mon<strong>ie</strong>s<br />

earned or received, especially: wages for régulai<br />

hours; overtime: pay f«>r annual vacation ami<br />

holidays (those prescribed by the «<strong>le</strong>cree as well<br />

as other freely granted by the employer or obtained<br />

under a special col<strong>le</strong>ctive agreement).<br />

(e) Additional benefits: During the employee's<br />

vacation, the employer must continue to provulc<br />

him with benefits in kin«l or othcnvi.se to which<br />

he is entit<strong>le</strong>d, such as contributions to a pension<br />

fund, group life-insurance plan, medical care<br />

l>enefits. etc.<br />

(/) Vacation pay due date: The vacation pay to<br />

which an employee is entit<strong>le</strong>d must !>e given him<br />

before his <strong>le</strong>aving on vacation.<br />

(g) Vacation period: Each vacation must be<br />

granted within the twelve (12) months following<br />

the date when entit<strong>le</strong>ment to such vacation is<br />

acquired*, i.e., May 1 of each year.<br />

(h) Timing of vaation period: An employee i<br />

entit<strong>le</strong>d t«) he advised of his vacation period al<br />

<strong>le</strong>ast fifteen (15) days beforehand.
