Distribution of Convicted and Undertrials Prisoners under Indian Penal Code<br />

(IPC) and Special and Local laws (SLL)<br />

Convicts<br />

IPC crimes (1,14,584)<br />

A total of 1,14,584 convicts were<br />

lodged in various jails of the country for<br />

committing offences under Indian Penal<br />

Code (IPC). Uttar Pradesh has reported the<br />

highest number of convicts (23,667)<br />

convicted for crime under various sections<br />

of IPC followed by Madhya Pradesh<br />

(15,813), accounting for 20.7% and 13.8%<br />

of the total convicted inmates (1,14,584)<br />

respectively under IPC crimes in the<br />

country. There were 69,773 murder<br />

convicts out of the total 1,14,584 convicts<br />

lodged in jails under various IPC crimes in<br />

the country at the end of <strong>2014</strong>, accounting<br />

for 60.9% of the total convicts. The<br />

numbers of convicts in other IPC offences<br />

were on the lower side as compared to<br />

murder convicts. Significant numbers of<br />

persons were lodged as convicts for the<br />

offence of rape (8,879), attempt to murder<br />

(7,015) and dowry deaths (5,176). The<br />

highest share of convicts under murder was<br />

reported in Uttar Pradesh 21.3% (14,881<br />

out of 69,773) followed by Madhya Pradesh<br />

15.9% (11,069 out of 69,773) in the country.<br />

Uttar Pradesh has also reported the highest<br />

share of 16.2% (1,136 out of 7,015), 26.2%<br />

(838 out of 3,203), 21.0% (1,862 out of<br />

8,879), 24.4% (658 out of 2,698), 15.3%<br />

(352 out of 2,307) and 11.1% (341 out of<br />

3,072) convicts to the total convicts in the<br />

country under attempt to murder, culpable<br />

homicide not amounting to murder, rape,<br />

kidnapping & abduction, robbery and<br />

dacoity respectively. It is worth mentioning<br />

that Uttar Pradesh has accounted for 42.5%<br />

(2,200 out of 5,175) of total convicts in the<br />

country under crime head dowry deaths.<br />

4.1.<br />

Special and Local Laws (SLL) (16,775)<br />

A total of 16,775 convicts were<br />

lodged in various jails of the country for<br />

committing offences under Special and<br />

Local Laws. The highest percentage of<br />

convicts (53.2%) was reported under The<br />

NDPS Act (8,923) followed by The Arms<br />

Act (9.1%) (1,533), the Registration of<br />

Foreigners Act (11.5%) (1,925), the Excise<br />

Act (4.7%) (789) and the Indian Railways<br />

Act (3.2%) (545). Punjab has reported the<br />

highest number of convicts (3,972) under<br />

the NDPS Act, followed by Uttar Pradesh<br />

(884). Out of the 1,533 convicts undergoing<br />

sentences under the Arms Act in the<br />

country, 362 were reported from Punjab<br />

accounting for 23.6% followed by Uttar<br />

Pradesh (21.7%), Bihar (13.3%) and<br />

Madhya Pradesh (7.4%). The highest<br />

number of convicts (192) under The Indian<br />

Railways Act was reported from Uttar<br />

Pradesh (35.2%) followed by Punjab<br />

(14.3%), Bihar (12.1%). Out of 1,925<br />

convicts under the Registration of<br />

Foreigners Act in the country, 1,105<br />

convicts were lodged in West Bengal,<br />

accounting for 57.4% of total convicts under<br />

the Registration of Foreigners Act. The<br />

details may be seen in Table-4.2.<br />

Undertrial Inmates<br />

IPC crimes (2,31,962)<br />

A total of 2,31,962 undertrial<br />

prisoners from various States and UTs were<br />

lodged in jails for committing crimes under<br />

IPC, wherein 63,225 persons were lodged<br />

as undertrials under murder which<br />

accounted for 27.3% of the such undertrial<br />

prisoners in the country. The highest<br />

number of undertrial prisoners under head<br />

murder was reported from Uttar Pradesh<br />

(11,326) followed by Bihar (5,558),<br />

Karnataka (5,015), Madhya Pradesh<br />

(4,890), Maharashtra (4,650) and Odisha<br />

(4,556). These six States taken together<br />

accounted for 56.9% of the total undertrial<br />

prisoners under crime head murder in the<br />

country. Theft and attempt to murder were<br />

the next two IPC crimes which contributed<br />

large number of undertrial prisoners, a total<br />
