various jails at the end of <strong>2014</strong>. The details<br />

may be seen in Table-4.3.<br />

Special and Local Laws (SLL) (50,730)<br />

A total of 50,730 prisoners were<br />

lodged as undertrial prisoners in various<br />

jails of the country for committing crimes<br />

under Special and Local Laws compared to<br />

2,31,962 undertrial prisoners for committing<br />

IPC crimes. Thus the share of undertrial<br />

prisoners under SLL was 17.9% of total<br />

undertrial prisoners (IPC offences and SLL<br />

offences combined). The highest number of<br />

undertrial prisoners (16,039) was reported<br />

under the NDPS Act which accounted for<br />

31.6% of the total undertrial prisoners under<br />

SLL. This was followed by undertrial<br />

prisoners under the Arms Act (16.2%) and<br />

the Excise Act (10.7%). Punjab has<br />

reported the highest number of undertrials<br />

(4,803) under the NDPS Act which<br />

accounted for 29.9% of the total undertrial<br />

prisoners under the NDPS Act in the<br />

country. However, the percentage share of<br />

undertrial prisoners reported under the<br />

Protection of Civil Rights Act was the lowest<br />

at 0.3% (148 out of 50,730). The details<br />

may be seen in Table-4.4.<br />

Comparison of Convicted and Undertrial<br />

prisoners lodged in jails during <strong>2014</strong><br />

over previous year (2013)<br />

The convicted prisoners have<br />

marginally increased by 1.5% in <strong>2014</strong> over<br />

2013 as the number of convicts (1,29,608)<br />

lodged in various jails of the country at the<br />

end of 2013 increased to 1,31,517 at the<br />

end of <strong>2014</strong>. Five States out of 9 States<br />

having share of 5.0% crimes or more out of<br />

total IPC crimes in the country as per<br />

“Crime in India <strong>2014</strong>” report, have<br />

reported decline in convicts population<br />

during the year <strong>2014</strong>. These States were<br />

West Bengal (8.6%), Rajasthan (6.8%),<br />

Kerala (6.0%), Maharashtra (1.5%) and<br />

Bihar (0.8%). On the other hand, four major<br />

States reported increase in convict<br />

population during <strong>2014</strong>. These States were<br />

Delhi (8.4%), Tamil Nadu (6.3%), Madhya<br />

Pradesh (1.3%) and Uttar Pradesh (1.0%).<br />

The number of undertrial prisoners has<br />

also increased slightly by 1.6% in <strong>2014</strong><br />

(2,82,879) over 2013 (2,78,503). Tamil<br />

Nadu was the only State in the country<br />

which showed remand prisoners as a<br />

separate category from undertrial prisoners<br />

and had supplied the data till 2006 on<br />

these lines. However, from 2007, like other<br />

States, they included data of remand<br />

prisoners under category of undertrial<br />

prisoners. Hence, the number of undertrial<br />

prisoners shown have increased<br />

considerably from 2007. 7 States out of 9<br />

major States (having share of 5% crimes<br />

under IPC or more) have reported increase<br />

in undertrial inmates during <strong>2014</strong> as<br />

compared to 2013. These States were<br />

Rajasthan (10.3%), Madhya Pradesh<br />

(9.2%), Tamil Nadu (8.9%), Uttar Pradesh<br />

(7.6%), Maharashtra (2.9%), Bihar (0.7%),<br />

and Delhi (0.2%). Two major State namely<br />

West Bengal & Kerala have reported a<br />

decline of 14.7% and 3.2% respectively in<br />

undertrial population in <strong>2014</strong> over 2013.<br />

The details may be seen in Table 4(A).<br />

During the calendar year <strong>2014</strong>, a<br />

total of 1,87,269 convicts were released out<br />

of which 1,18,903 released after completion<br />

of conviction period and 47,383 released on<br />

bail (Table 4.5).<br />

A total of 796 convicts were<br />

transferred from one State to other States<br />

during <strong>2014</strong>. Jharkhand (158) and Uttar<br />

Pradesh (150) have reported the highest<br />

number of transfer of convicts to other<br />

States.<br />

A total of 139 convicts were<br />

released under pardon during <strong>2014</strong>,<br />

maximum such released were reported in<br />

Maharashtra (69) followed by Rajasthan<br />

(29) and Uttar Pradesh (21).<br />

Similarly, 13,95,121 undertrials were<br />

released during <strong>2014</strong> out of which<br />

12,39,733 released on bail, 58,589 released<br />

on appeal and 64,216 were acquitted. A<br />

total of 64 undertrials were extradited during<br />

<strong>2014</strong>. (Table 4.6).<br />

In <strong>2014</strong>, 32,890 persons were<br />

released on Parole. 374 prisoners released<br />

on Parole have absconded.<br />
