Should ZDC not agree to rectification of the first<br />

sales agreement and to transfer proceeding,<br />

then Cloudberry Investments 21 (Pty) Ltd<br />

will commence proceedings in the High Court<br />

with a view to obtaining the rectification order<br />

and an order directing ZDC to proceed with<br />

the transfer of the properties to Cloudberry<br />

Investments 21 (Pty) Ltd.<br />

Telecommunications Projects<br />

ZEMA has been hard at work over the past few<br />

months to try to “improve cellular signal” and<br />

facilitate a “full community fibre-to-the-home<br />

(FTTH) infrastructure installation”. We’ve faced<br />

many unexpected obstacles in our quest to<br />

finalise these projects, but we want to assure<br />

Members that Telecommunications remains at<br />

the top of the agenda and that we will continue<br />

to treat it with the utmost priority.<br />

Much has happened since we last reported<br />

on these projects, but we will endeavour to<br />

summarise as much as possible on what has<br />

transpired.<br />

(1) Cellular Masts to Improve Signal<br />

Coverage<br />

We last reported on the Cellular Mast project<br />

in October 2015. Since then, 3 sites were<br />

identified for mast installations, being:<br />

1. ZEMA Workshop (Westgate)<br />

2. ZCC Tennis Courts (Vacant Land)<br />

3. Fairmont Zimbali Hotel<br />

It is important to note that sufficient<br />

improvement of signal coverage for the Estate<br />

cannot be achieved without masts being<br />

installed at these three strategic locations, or<br />

within close proximity to all three sites, at the<br />

least.<br />

Once the mast specs and locations were<br />

established, Members were invited to attend a<br />

public participation presentation by ATC/EMSS<br />

on 12 November 2015 at the BBC, which took<br />

place successfully. Lease agreements between<br />

respective landowners and ATC were then<br />

negotiated and prepared.<br />

The lease for the ZEMA Workshop site was<br />

signed on 4 March 2016 and the application<br />

to build was lodged with KDM for approval.<br />

As this usually takes about 6 months, ATC<br />

committed to installing a temporary mast. At<br />

the time of writing this article, ZEMA was not<br />

satisfied with the proposed temporary mast<br />

design and negotiations were underway with<br />

ATC to provide a mast that was more visually<br />

acceptable.<br />

For the ZCC Tennis Courts site (which is ZDCowned<br />

land leased to ZCC), ZDC was not willing<br />

to give consent for ZCC to sign the lease, so<br />

ZEMA then identified an alternative site on<br />

ZEMA-owned land 22 metres north of the<br />

ZCC Tennis Courts site. At the time of writing<br />

this article, the lease agreement had just been<br />

signed and the same statutory process as the<br />

above Workshop site will now follow, with a<br />

temporary mast also to be installed.<br />

For the Fairmont Zimbali Hotel site, the<br />

proposed ATC roof-mast was considered by IFA<br />

to be obtrusive and aesthetically unacceptable,<br />

so IFA decided to instead appoint Vodacom<br />

to install a small, unobtrusive roof-mast in<br />

addition to the roof-masts already installed by<br />

MTN and Telkom. Vodacom’s mast will also<br />

include the Cell C network, so it will cater to<br />

the four primary cellular networks. At the time<br />

of writing this article, IFA was in the process<br />

of giving final approval for the design of the<br />

Vodacom mast, before signing the lease<br />

agreement.<br />
