2.6.1. Legal aspects<br />
2.6.1.1. Introduction<br />
According to the Civil Code, parties of the<br />
contract may benefit from the principle of<br />
freedom of contracts, which gives them<br />
an opportunity to modify the statutory<br />
types and provisions of the civil contract.<br />
However, there are some mandatory<br />
provisions and limitations, which have to be<br />
considered by the parties. Among all types<br />
of property exploitation agreements, the<br />
below are the most common for the Polish<br />
real estate sector:<br />
• Lease (najem) – regulated in articles<br />
659 to 692 of the Civil Code,<br />
• Tenancy (dzierżawa) - regulated in<br />
articles 693 to 709 of the Civil Code,<br />
• Leasing of real estate (leasing<br />
nieruchomości) - regulated in articles<br />
709(1) to 709(18) of the Civil Code,<br />
• Property management (zarządzanie<br />
nieruchomościami) - regulated in the<br />
Act on Property Management.<br />
