(b) any other condition so that the sign in the opinion of the Development<br />

Officer will not constitute a hazard to the public;<br />

(c) where a sign may affect traffic flow, control or safety, the Development<br />

Officer may impose suitable conditions on the location, size, colours,<br />

animation, lighting or other characteristics related to traffic safety or to the<br />

provisions of reasonable distance, traffic visibility and clearance between<br />

streets and travelled ways and the sign or advertising structure.<br />

ENCROACHMENT LICENSE<br />

14DA(7) In addition to the provisions within this section regarding sign permits, if a sign<br />

or advertising structure is intended to project or extend over any portion of any<br />

street, no permit for such sign or advertising structure shall be granted until the<br />

applicant obtains approval under the Encroachment By-<strong>law</strong> permitting such<br />

applicant to maintain such sign or advertising structure so projecting or<br />

extending over a portion of a street.<br />

SIGNS ON BUILDINGS<br />

14DA(8) No sign or advertising structure attached to any building shall extend more than<br />

two metres (2m) at its highest point including its supporting structures above the<br />

roof of the building.<br />

14DA(9) On the roof of any building no sign or advertisement more than one-point-four<br />

metres (1.4m) high across the face shall be erected, and applicants must submit to<br />

the Development Officer drawings to scale showing method of construction and<br />

means of attachment, and the bottom of any such sign shall not be nearer than<br />

one hundred fifty millimetres (150mm) nor more than four hundred fifty<br />

millimetres (450mm) above the roof.<br />

14DA(10) No sign or advertising structure beyond the building line shall be less than three<br />

metres (3m) above the surface of a vehicular passageway.<br />

14DA(11) No sign or advertising structure shall overhang the street for a distance of more<br />

than two-thirds of the width of the sidewalk, excepting marguees or canopies.<br />

14DA(12) No part of a sign or structure shall be closer than nine hundred millimetres<br />

(900mm) horizontal from a curb face or the nearest edge of a vehicular<br />

passageway or traffic lane.<br />

ILLUMINATED SIGNS<br />

14DA(13) Signs shall be illuminated in such a manner not to ca<strong>use</strong> a glare to motorists,<br />

pedestrians or neighbouring premises<br />

14DA(14) Signs shall not be illuminated between the hours of 11:00 p.m. of any day and<br />

7:00 a.m. of the following day unless related to an establishment operating during<br />

these hours.<br />
