ADMINISTRATION<br />
LAND USE BY-LAW - MAINLAND AREA<br />
1(1) This <strong>by</strong>-<strong>law</strong> shall be administered <strong>by</strong> the Development Officer of the City of Halifax.<br />
1(2) No person shall undertake a development without first obtaining a development<br />
permit.<br />
1(3) Every application for a development permit shall be accompanied <strong>by</strong> such materials as<br />
required <strong>by</strong> Sections 63 and 64 of this <strong>by</strong>-<strong>law</strong>.<br />
APPLICATION<br />
lA This <strong>by</strong>-<strong>law</strong> shall apply to the zoning area as defined in Section 2.<br />
DEFINITIONS<br />
2 In this <strong>by</strong>-<strong>law</strong>:<br />
"Accessory Building" means a detached subordinate building not exceeding one<br />
storey and 14 feet in height, not <strong>use</strong>d for human habitation, located on the same lot as<br />
the main building, structure or <strong>use</strong> to which it is accessory, the <strong>use</strong> of which is naturally<br />
or customarily incidental and complementary to the main <strong>use</strong> of the <strong>land</strong>, building or<br />
structure;<br />
"Accessory Use" means a <strong>use</strong> that is normally incidental, subordinate and exclusively<br />
devoted to a principal <strong>use</strong> and located on the same lot therewith;<br />
"Adult Bookstore" includes any establishment or place for the purpose of retail trade<br />
where 20% or more of the value of the total stock in trade in any such establishment or<br />
place is comprised of books, magazines, or other periodicals relating to or portrayed as<br />
relating to sexual activities;<br />
"Adult Cabaret" means any premises or part thereof, whether public, semi-private, or<br />
private, wherein is provided the opportunity to feel, handle, touch, paint, be in the<br />
presence of, be entertained <strong>by</strong> the nude body of another person, or to observe, view or<br />
photograph any such activity;<br />
"Adult Entertainment Use" means a massage parlour, sex-aid shop, adult bookstore,<br />
or adult cabaret;<br />
"Alter" means to make any change in the size, shape, structure or materials of a<br />
building or any part thereof;<br />
"Am<strong>use</strong>ment Centre" means a commercially operated facility providing more than<br />
three (3) am<strong>use</strong>ment machines.<br />
