Tawiah Ackaah-<br />
Boafo, has annulled<br />
the Ghana Private<br />
Road Transport Union’s<br />
(GPRTU) 2015 elections that<br />
elected Mr Musah Khaleepha as<br />
its general secretary.<br />
According to the court, Mr<br />
Khaleepha, who contested the<br />
election and won by 80.61% had<br />
himself admitted that he did not<br />
meet the legibility criteria as provided<br />
for in clause (13 b) of the<br />
GPRTU constitution.<br />
It was the case of the plaintiffs,<br />
Ricky Kuenyehia, former<br />
deputy national general secretary<br />
in charge of operations and James<br />
Aryee, the vice chairman of the<br />
Accra branch that, Mr Khaleepha<br />
remained dismissed from the<br />
union since December 2011 and<br />
that his nomination and subsequent<br />
election as general secretary<br />
should be declared as void.<br />
They sought an order annulling<br />
the purported nomination and<br />
election of the general secretary.<br />
The court in its judgement said<br />
from the proceedings, it seemed<br />
that the second defendant conceded<br />
that as at the time of the<br />
election he held no other office as<br />
per their constitution and therefore<br />
did not meet the requirement.<br />
The court after annulling the<br />
election, additionally awarded the<br />
plaintiffs damages in the sum of<br />
GH¢ 10, 000.00 and also awarded<br />
further cost of GH¢10, 000.00<br />
against the GPRTU and the second<br />
defendant.<br />
Capacity<br />
On whether or not the plaintiffs<br />
had the capacity to institute<br />
the action, the court said the capacity<br />
argument was anchored on<br />
the fact that a search conducted at<br />
the Greater Accra Secretariat of<br />
the GPRTU showed that the<br />
plaintiffs were no more members<br />
of the GPRTU .<br />
According to the court, the<br />
plaintiffs tendered in their membership<br />
and dues cards and the<br />
cards had records of payment of<br />
membership dues by the plaintiffs<br />
at the time the action commenced.<br />
Justice Ackaah-Boafo said the<br />
defendants did not seriously challenge<br />
that exhibit as to their validity<br />
and reliability though counsel<br />
for the defendants contested it in<br />
the cross-examination.<br />
The court said based on balance<br />
of probability, the defendant<br />
failed to establish that the plaintiffs<br />
lacked capacity to take the action.<br />
“I am of the opinion that in<br />
the absence of clear, unambiguous<br />
or express language that the<br />
plaintiffs are not members of the<br />
GPRTU, even if they no longer<br />
hold official positions of their<br />
branch, the plaintiffs have the<br />
right with justifiable interest to<br />
seek judicial review as they claim<br />
in this case.”<br />

THE CHIEF Executive Officer<br />
(CEO) of the National Pensions<br />
Regulatory Authority (NPRA),<br />
Mr Hayford Attah Krufi, has<br />
called on the government to give<br />
the authority prosecutorial powers<br />
to prosecute employers who<br />
fail to pay social security contributions.<br />
Mr Krufi said the core mandate<br />
of the authority, which is to<br />
inform and educate people on<br />
the need to have retirement income<br />
security, is gradually changing<br />
to enforcing and ensuring<br />
that consumers have value for<br />
money and enjoy better pay at<br />
the end of service.<br />
“With these powers, the Authority<br />
will be able to hold employers<br />
and companies to task<br />
when they fail to remit monthly<br />
contribution to the mandatory<br />
Tier 1 and Tier 2 pension<br />
schemes,” Mr Krufi said.<br />
Mr Krufi made these statements<br />
in Accra at a media training<br />
exercise on the<br />
implementation of the 3-tier<br />
pension which is the voluntary<br />
group or the personal pension<br />
scheme.<br />
He said after the establishment<br />
of the National Pensions<br />
Act, 2008, Act 766 which was<br />
amended, the entity had been<br />
able to sensitise the general public<br />
and employers on the need to<br />
ensure their retirement security<br />
