Tension
in GPRTU
• As court quashes
election of Gen Secretary
BY MUNTALLA INUSAH
muntalla.inusah@dailyheritage.com.gh
THE HIGH Court in
Accra, presided over
by Justice Kwaku
Tawiah Ackaah-
Boafo, has annulled
the Ghana Private
Road Transport Union’s
(GPRTU) 2015 elections that
elected Mr Musah Khaleepha as
its general secretary.
According to the court, Mr
Khaleepha, who contested the
election and won by 80.61% had
himself admitted that he did not
meet the legibility criteria as provided
for in clause (13 b) of the
GPRTU constitution.
It was the case of the plaintiffs,
Ricky Kuenyehia, former
deputy national general secretary
in charge of operations and James
Aryee, the vice chairman of the
Accra branch that, Mr Khaleepha
remained dismissed from the
union since December 2011 and
that his nomination and subsequent
election as general secretary
should be declared as void.
They sought an order annulling
the purported nomination and
election of the general secretary.
The court in its judgement said
from the proceedings, it seemed
that the second defendant conceded
that as at the time of the
election he held no other office as
per their constitution and therefore
did not meet the requirement.
The court after annulling the
election, additionally awarded the
plaintiffs damages in the sum of
GH¢ 10, 000.00 and also awarded
further cost of GH¢10, 000.00
against the GPRTU and the second
defendant.
Capacity
On whether or not the plaintiffs
had the capacity to institute
the action, the court said the capacity
argument was anchored on
the fact that a search conducted at
the Greater Accra Secretariat of
the GPRTU showed that the
plaintiffs were no more members
of the GPRTU .
According to the court, the
plaintiffs tendered in their membership
and dues cards and the
cards had records of payment of
membership dues by the plaintiffs
at the time the action commenced.
Justice Ackaah-Boafo said the
defendants did not seriously challenge
that exhibit as to their validity
and reliability though counsel
for the defendants contested it in
the cross-examination.
The court said based on balance
of probability, the defendant
failed to establish that the plaintiffs
lacked capacity to take the action.
“I am of the opinion that in
the absence of clear, unambiguous
or express language that the
plaintiffs are not members of the
GPRTU, even if they no longer
hold official positions of their
branch, the plaintiffs have the
right with justifiable interest to
seek judicial review as they claim
in this case.”
We want power
to prosecute
SSNIT contribution
defaulters — NPRA
BY PHILIP ANTOH
Philip.antoh@dailyheritage.com.gh
THE CHIEF Executive Officer
(CEO) of the National Pensions
Regulatory Authority (NPRA),
Mr Hayford Attah Krufi, has
called on the government to give
the authority prosecutorial powers
to prosecute employers who
fail to pay social security contributions.
Mr Krufi said the core mandate
of the authority, which is to
inform and educate people on
the need to have retirement income
security, is gradually changing
to enforcing and ensuring
that consumers have value for
money and enjoy better pay at
the end of service.
“With these powers, the Authority
will be able to hold employers
and companies to task
when they fail to remit monthly
contribution to the mandatory
Tier 1 and Tier 2 pension
schemes,” Mr Krufi said.
Mr Krufi made these statements
in Accra at a media training
exercise on the
implementation of the 3-tier
pension which is the voluntary
group or the personal pension
scheme.
He said after the establishment
of the National Pensions
Act, 2008, Act 766 which was
amended, the entity had been
able to sensitise the general public
and employers on the need to
ensure their retirement security
