more complex trad<strong>in</strong>g programs, governmental organizations may be preferable. In some<br />
situations, notably <strong>the</strong> Grassland Area Farmers (CA), Long Island Sound (CT), and <strong>the</strong><br />
Passiac Valley Sewerage programs, <strong>the</strong> need for an adm<strong>in</strong>istrative organization has been<br />
elim<strong>in</strong>ated as <strong>the</strong> trades are conducted directly with <strong>the</strong> government agencies.<br />
S<strong>in</strong>ce <strong>the</strong> ma<strong>in</strong> stem of <strong>the</strong> <strong>Delaware</strong> <strong>River</strong> could potentially <strong>in</strong>volve an <strong>in</strong>terstate<br />
trad<strong>in</strong>g situation, ei<strong>the</strong>r an agency with <strong>in</strong>terstate authority or a process <strong>in</strong>volv<strong>in</strong>g all <strong>the</strong><br />
needed agencies (and stakeholders) would be necessary. There is no major <strong>in</strong>terstate<br />
water quality trad<strong>in</strong>g program that covers an area comparable <strong>in</strong> size and nature to <strong>the</strong><br />
LDR Bas<strong>in</strong> (eg. a large, tidal, multi-state system with an exist<strong>in</strong>g complex governance<br />
structure). The Long Island Sound Program covers a area that is similar <strong>in</strong> size to <strong>the</strong><br />
LDR but its trad<strong>in</strong>g program currently <strong>in</strong>cludes only dischargers from <strong>the</strong> State of<br />
Connecticut (Johnson 2005). The organizational structure will be different for a situation<br />
where all trades would occur between sources <strong>in</strong> one state (<strong>in</strong>trastate trades) versus <strong>the</strong><br />
LDR situation where <strong>the</strong> potential trad<strong>in</strong>g partners are located <strong>in</strong> different states<br />
(<strong>in</strong>terstate trades). S<strong>in</strong>ce <strong>the</strong>re is a potential for <strong>in</strong>terstate trades <strong>in</strong> <strong>the</strong> LDR <strong>the</strong><br />
adm<strong>in</strong>istrative organization should have broad representation from <strong>Delaware</strong>,<br />
Pennsylvania, and New Jersey.<br />
In ei<strong>the</strong>r <strong>in</strong>terstate or <strong>in</strong>trastate programs it is essential to <strong>in</strong>volve all pert<strong>in</strong>ent<br />
permitt<strong>in</strong>g agencies and <strong>in</strong>terested stakeholders <strong>in</strong> some way. For example, to <strong>the</strong> extent<br />
that permits under <strong>the</strong> NPDES are <strong>in</strong>volved <strong>in</strong> trad<strong>in</strong>g programs (this is usually <strong>the</strong> case),<br />
<strong>the</strong> permitt<strong>in</strong>g authority has usually been <strong>in</strong>volved <strong>in</strong> an active way. In <strong>the</strong> LDR, all three<br />
states (<strong>Delaware</strong>, Pennsylvania, and New Jersey) have been delegated <strong>the</strong> authority to<br />
adm<strong>in</strong>ister <strong>the</strong> NPDES permit, compliance, and enforcement program. The EPA<br />
ma<strong>in</strong>ta<strong>in</strong>s a role of “oversee<strong>in</strong>g” <strong>the</strong> adm<strong>in</strong>istration of <strong>the</strong> state-adm<strong>in</strong>istered NPDES<br />
programs <strong>in</strong> order to ensure consistency with national standards and policies. The DRBC<br />
also has authorities to be considered <strong>in</strong> any trad<strong>in</strong>g scenario. Evaluations of <strong>the</strong> strengths<br />
of organization relative to trad<strong>in</strong>g are provided <strong>in</strong> <strong>the</strong> last section of this chapter.<br />
• In addition to designat<strong>in</strong>g or design<strong>in</strong>g an adm<strong>in</strong>istrative organization, for a trad<strong>in</strong>g<br />
program to be successful, it is essential to build trust with key <strong>in</strong>terested<br />
stakeholders. These stakeholders typically <strong>in</strong>cluded groups such as <strong>the</strong> regulated<br />
community, elected and career government officials at all levels, environmental<br />
groups (mostly at <strong>the</strong> local level but sometimes at <strong>the</strong> national level), and civic<br />
organizations. The tim<strong>in</strong>g of <strong>the</strong> stakeholder <strong>in</strong>volvement is also important. The<br />
process of establish<strong>in</strong>g a trad<strong>in</strong>g program should be as transparent as possible,<br />
<strong>in</strong>volv<strong>in</strong>g potential stakeholders at <strong>the</strong> earliest possible time. S<strong>in</strong>ce <strong>the</strong>re are many<br />
complex issues to address before it is determ<strong>in</strong>ed if trad<strong>in</strong>g is appropriate for a<br />
watershed, and s<strong>in</strong>ce many stakeholders may be <strong>in</strong>terested but may also have time<br />
constra<strong>in</strong>ts, it is important for leaders to f<strong>in</strong>d effective ways to communicate.<br />
Nationwide, <strong>the</strong> traditional methods of mail<strong>in</strong>gs, <strong>in</strong>ternet sites, and newspaper<br />
articles have all used by various leaders <strong>in</strong>volved <strong>in</strong> trad<strong>in</strong>g. However, meet<strong>in</strong>g<br />
early and often with potentially-impacted parties is viewed to be especially<br />
important <strong>in</strong> establish<strong>in</strong>g <strong>the</strong> trust needed to be successful <strong>in</strong> <strong>the</strong> long run.<br />
