• Scale--Is <strong>the</strong> geographic area covered by <strong>the</strong> organization compatible with areas<br />

where potential trades will be made?<br />

• Local Network--Does <strong>the</strong> organization have a history of positive relationships<br />

with various stakeholders <strong>in</strong> <strong>the</strong> area where <strong>the</strong> trad<strong>in</strong>g program will be<br />

established?<br />

• Work<strong>in</strong>g Relationships with Regulators--- Does <strong>the</strong> organization have a good<br />

work<strong>in</strong>g relationship with key governmental organizations such as EPA and <strong>the</strong><br />

state environmental programs?<br />

Us<strong>in</strong>g <strong>the</strong> criteria listed above <strong>the</strong> follow<strong>in</strong>g is an assessment of some of <strong>the</strong> key<br />

agencies that are potentially <strong>in</strong>volved <strong>in</strong> WQT <strong>in</strong> <strong>the</strong> LDR Bas<strong>in</strong>.<br />

The US Environmental Protection Agency (EPA)<br />

EPA has a Regional Office (Region 3) located <strong>in</strong> Philadelphia. This office has<br />

federal jurisdiction over parts of <strong>the</strong> LDR bas<strong>in</strong> that dra<strong>in</strong>s Pennsylvania and <strong>Delaware</strong>.<br />

Areas that dra<strong>in</strong> New Jersey are under <strong>the</strong> federal jurisdiction of EPA Region 2, located<br />

<strong>in</strong> New York City. In general EPA:<br />

• has <strong>the</strong> legal authorities needed to implement a WQT program<br />

• has a strong <strong>in</strong>terest <strong>in</strong> promot<strong>in</strong>g WQT<br />

• has split jurisdiction for <strong>the</strong> Bas<strong>in</strong> between Region 2 and Region 3<br />

• could br<strong>in</strong>g national assistance to <strong>the</strong> program<br />

• has <strong>the</strong> organization to handle f<strong>in</strong>ancial, economic, or legal issues that may arise<br />

• elsewhere has been <strong>in</strong> a support role ra<strong>the</strong>r than hav<strong>in</strong>g <strong>the</strong> role of <strong>the</strong><br />

adm<strong>in</strong>istrat<strong>in</strong>g WQT programs<br />

• has a large staff skilled <strong>in</strong> issues relat<strong>in</strong>g to trad<strong>in</strong>g<br />

Summary: EPA has supported market-based programs <strong>in</strong> <strong>the</strong> past and <strong>the</strong> current<br />

Adm<strong>in</strong>istration cont<strong>in</strong>ues to make <strong>the</strong>se programs a priority. EPA is more <strong>in</strong>terested <strong>in</strong><br />

giv<strong>in</strong>g strong support to o<strong>the</strong>rs who would adm<strong>in</strong>ister <strong>the</strong> program. Their support and<br />

leadership is very important to gett<strong>in</strong>g a program started and susta<strong>in</strong>ed.<br />

State Agencies<br />

Each state has its own capabilities and <strong>in</strong>terests. As a whole, <strong>the</strong>y can be<br />

characterized as follows. Each state has:<br />

• The staff skills needed for a trad<strong>in</strong>g program or could obta<strong>in</strong> <strong>the</strong>m through a<br />

contractor<br />

• The legal authority to implement trades with<strong>in</strong> <strong>the</strong>ir state boundaries but <strong>the</strong>se<br />

authorities may have difficulties with <strong>in</strong>terstate issues.<br />

• Sufficient organizational capabilities to handle f<strong>in</strong>ancial, economic, or legal issues<br />

• Strong local contacts <strong>in</strong> <strong>the</strong>ir respective state but usually not <strong>in</strong> <strong>the</strong> o<strong>the</strong>r states<br />

• A delegated NPDES permit program, <strong>the</strong> responsibility for <strong>the</strong> development of<br />

TMDLs, and primary responsibilities for o<strong>the</strong>r programs relat<strong>in</strong>g to water quality<br />
