CALL FOR SUBMISSIONS<br />

Application to extend the Lyttleton <strong>Harbour</strong>/Whakaraupō<br />

Mātaitai Reserve, Canterbury<br />

Pursuant to Regulation 17 of the Fisheries (South Island<br />

Customary Fishing) Regulations 1999, Te Hapū o Ngāti<br />

Wheke (Rāpaki) Rūnanga have applied to extend the Lyttleton<br />

<strong>Harbour</strong>/Whakaraupō Mātaitai Reserve.<br />

Proposed area<br />

The proposed extension covers all that area of South Island<br />

fisheries waters enclosed by a line:<br />

a) starting at a point on the mean high-water mark near the<br />

eastern extremity of Ōtokitoki / Gollans <strong>Bay</strong> at 43°35.950’S<br />

and 172°45.450’E; then<br />

b) proceeding along the mean high-water mark in a generally<br />

north-easterly direction to a point at Awaroa / Godley Head<br />

at 43°35.<strong>23</strong>4’S and 172°48.535’E; then<br />

c) proceeding in a straight line in a south-easterly direction<br />

to a point on the mean high-water mark at Te Piaka /<br />

Adderley Head at 43°36.228’S and 172°49.566’E; then<br />

d) proceeding along the mean high-water mark in a<br />

generally south-westerly direction to a point near the<br />

eastern extremity of Deep Gully <strong>Bay</strong> at 43°37.092’S and<br />

172°46.147’E; then<br />

e) proceeding in a straight line in a north-westerly direction to<br />

the starting point.<br />

The approximate area of the proposed mātaitai extension is<br />

11.08 km 2 .<br />

Mātaitai do not affect private landowners’ land titles, or their<br />

ability to exercise resource consents for such things as taking<br />

water or extracting gravel or sand. Resource consents are<br />

managed under the Resource Management Act 1991.<br />

Consultation on the proposed Mātaitai Reserve extension<br />

Pursuant to Regulation 18, this notice invites written or<br />

electronic submissions from the local community on the<br />

application. The local community is defined as those persons<br />

who own land in the proximity of the proposed mātaitai reserve,<br />

or have a place of residence in the proximity of the proposed<br />

mātaitai reserve and have been in occupation for a cumulative<br />

period of no less than three months in the three consecutive<br />

years immediately prior to January <strong>2022</strong>.<br />

Pursuant to Regulation 19(1), a further notice will be published<br />

to advertise a public meeting with the local community to<br />

discuss the application. The public meeting will be held in<br />

accordance with the COVID-19 Protection Framework.<br />

this proposed mātaitai reserve extension and the application, is<br />

available on the Ministry for Primary Industries website (www.<br />

mpi.govt.nz/consultations), or by contacting Fisheries New<br />

Zealand at the below address.<br />

Submission process<br />

Submissions must be made by 5pm on Monday 28 March<br />

<strong>2022</strong>.<br />

Mātaitai Reserves<br />

A mātaitai reserve is an identified traditional fishing ground and<br />

is established for the purpose of customary food gathering.<br />

Mātaitai reserves are limited to fisheries waters and do not<br />

include any land area.<br />

Commercial fishing is banned within a mātaitai unless:<br />

• The applicants for the mātaitai request conditions that<br />

enable some commercial fishing to continue; and<br />

• The Minister for Oceans and Fisheries approves that Submissions are public information<br />

request.<br />

Fishing by the local community for recreational or customary<br />

purposes would only be affected if the Minister for Oceans and<br />

Fisheries subsequently approves a request from the Tangata<br />

Tiaki to make bylaws for fishing in the mātaitai. Bylaws apply<br />

only to the taking of fish, not to other activities such as land<br />

use, recreational activities such as boating or kayaking, or<br />

shipping channels.<br />

Mātaitai do not change the public’s ability to access areas of<br />

public land adjoining the mātaitai. Mātaitai also do not change<br />

any existing arrangements for access to private land.<br />
