5-5(10) <strong>AGREEMENTS</strong> Nov 2012<br />

• investigation <strong>of</strong> the condition <strong>of</strong> the streets and/or structures;<br />

• determination, in consultation with the local <strong>of</strong>ficials, <strong>of</strong> the maintenance operations to be<br />

included in the maintenance program;<br />

• preparation <strong>of</strong> the maintenance resolution, estimate, and proposal;<br />

• attendance at meetings <strong>of</strong> the governing body as may reasonably be required;<br />

• attendance at the public letting and preparation <strong>of</strong> the contract or acceptance <strong>of</strong> proposal<br />

forms; and<br />

• preparation <strong>of</strong> the maintenance expenditure statement.<br />

For engineering inspection projects, the pr<strong>of</strong>essional design firm or sole proprietorship is usually<br />

responsible for the following:<br />

• furnishing the engineering field supervision <strong>of</strong> maintenance operations requiring<br />

pr<strong>of</strong>essional on-site inspection;<br />

• checking materials invoices for payment; and/or<br />

• preparing the payment estimate for contract maintenance, including any necessary<br />

changes-in-plans, and providing a final estimate <strong>of</strong> the contract maintenance cost.<br />

Form BLR 05520 may be used for maintenance preliminary engineering and/or engineering<br />

inspection agreements. The agreement requires the signature and seal <strong>of</strong> the licensed<br />

pr<strong>of</strong>essional engineer, or structural engineer as applicable, and the signature and title <strong>of</strong> the<br />

local <strong>of</strong>ficial. Attach the formal agreement to the maintenance documents submitted to the<br />

district for approval showing the estimated cost <strong>of</strong> maintenance and the operations requiring<br />

engineering inspection.<br />

5-5.07(c) Form BLR 05530<br />

If FA funds will be requested to pay for construction engineering provided by the LPA, Central<br />

BLRS approval is required. The department is required to pre-audit all projects receiving federal<br />

funding in accordance with applicable federal regulations. Any services performed prior to the<br />

approval from the department may jeopardize the eligibility <strong>of</strong> federal funding reimbursement.<br />

Any invoices submitted for reimbursement for services performed by a LPA will not be<br />

processed for payment until a request for a pre-audit and approval is submitted to the Central<br />

BLRS.<br />

5-5.08 Other Engineering Services Agreements<br />

5-5.08(a) Road District Engineering and Administration<br />

605 ILCS 5/6-701.3 allows for a County to be paid administrative and engineering costs for road<br />

district MFT construction and maintenance. Engineering and administrative work may be<br />

performed on either an actual cost or a fixed-percentage basis, or a combination <strong>of</strong> these<br />

methods. The following will apply:<br />
