MAP PROVISIONS: SPECIAL TREATMENT AREAS<br />

Map Code 4.1 (Accepted <strong>County</strong> <strong>Plan</strong> Areas) - A designation <strong>of</strong> areas for which specific<br />

land use plans have already been prepared and approved. These plans are<br />

accepted and incorporated by this reference and the respective land use map<br />

associated with each such plan is hereby adopted as the <strong>General</strong> <strong>Plan</strong> diagram for<br />

each such area. Each plan area is indicated on the <strong>General</strong> <strong>Plan</strong> map. See<br />

Appendix A for details <strong>of</strong> accepted <strong>County</strong> plans.<br />

Map Code 4.2 (Interim Rural Community <strong>Plan</strong>) - A designation used to identify<br />

settlements in the <strong>County</strong> that have individual character which, in past plans, have<br />

been broadly merged with the surrounding countryside. These settlements are<br />

recognized as unique communities; each with its own character, special<br />

advantages, and problems which should more appropriately be addressed at a<br />

specific plan level <strong>of</strong> detail. See Appendix B for details and maps <strong>of</strong> interim rural<br />

community plans.<br />

Map Code 4.3 (Specific <strong>Plan</strong> Required) - A designation applied to areas wherein largescale<br />

projects have been previously proposed by the project landowner(s). This<br />

map code recognizes the need for additional assessment and evaluation <strong>of</strong> these<br />

proposals and does not create a commitment on the part <strong>of</strong> <strong>Kern</strong> <strong>County</strong> to<br />

approve any such proposals. The project proponent bears the burden <strong>of</strong><br />

demonstrating the suitability <strong>of</strong> the property for the conceptual uses and densities.<br />

Areas designated Map Code 4.3 shall be subject to development, consideration,<br />

and adoption <strong>of</strong> a specific plan in accordance with all applicable local and State<br />

requirements pertaining thereto.<br />

The Maximum Allowed <strong>Land</strong> <strong>Use</strong> Density tables (Appendix C) showing acreages<br />

and densities are conceptual and shall be used as guidelines should a specific plan<br />

be developed. Actual land uses and densities shall be based on consistency with<br />

the <strong>General</strong> <strong>Plan</strong> goals, policies and environmental review and may require<br />

reduction or elimination.<br />

POLICIES: SPECIAL TREATMENT AREAS<br />

1. The land use map diagrams adopted for special treatment areas establish the land<br />

use patterns for these areas.<br />

2. Applicant-initiated Specific <strong>Plan</strong>s, adopted after the 2004 <strong>General</strong> <strong>Plan</strong> Update,<br />

that have not been implemented through the application <strong>of</strong> zoning and/or land<br />

division (where applicable) within five years <strong>of</strong> <strong>County</strong> approval shall be viewed<br />

as inactive. Applicant-initiated Specific <strong>Plan</strong>s, adopted prior to the adoption <strong>of</strong><br />

the 2004 <strong>General</strong> <strong>Plan</strong> Update shall also be viewed as inactive if not<br />

implemented within ten years <strong>of</strong> the 2004 <strong>General</strong> <strong>Plan</strong> Update. The <strong>County</strong><br />

utilizing a <strong>County</strong>-initiated <strong>General</strong> <strong>Plan</strong> Amendment process shall consider<br />

inactive applicant-initiated Specific <strong>Plan</strong>s for rescission.<br />
