West Virginia-American Water Company - American Water Works, Inc. is the parent
company of West Virginia-American Water Company. In late 2002, the PSC granted its consent
for Thames Water Aqua Holdings GmbH to acquire all of American Water’s stock. On May 8,
2006, in Case No. 06-0597-W-PC. Thames Gmbh asked the PSC’s consent to sell American
Water’s stock on the New York Stock Exchange, which would result in American Water
becoming the largest publicly-traded water company in the United States. In early December,
the Commission conducted a hearing on this request. As of this report, the parties are filing
briefs for the Commission’s consideration.
Pocahontas County Public Service District - In Case No. 05-0103-PSD-CN, the District
filed an application for a certificate of convenience and necessity for the construction,
acquisition, operation and maintenance of a wastewater treatment and collection system to
service approximately 1,981 customers in Linwood, Slaty Fork, Snowshoe, Silver Creek and
Hawthorne Valley areas of Pocahontas County. A Recommended Decision granting the
application contingent upon the receipt of all necessary local, state and federal permits was
entered in the matter on December 12, 2005.Two intervenors filed exceptions to the
Recommended Decision. The Commission entered a final order adopting the Recommended
Decision on February 21, 2006. Intervenor Thomas Shipley filed an appeal with the Supreme
Court of Appeals on March 23 ,2006. The Court refused to hear the petition for appeal on
September 6, 2006.
