In this case it is considered that FENATRADO follows the conduct o abuse of dominant positionestablished in article 6 of the Competition Law of the Dominican Republic.On the other hand the analysis undertaken indicates that the trade union has ha the capacity to blockmarket access since according to the paragraph III of article 7 of its statues has the capacity toestablish unjustified barriers to entry to the relevant market.Considering the latter this study recommends proceeding for the establishing of the CompetitionCommission in order to apply the competition law. Also it si recommended to initiate the requiredstudies to issue the required rulings to the named law.On the other hand it is considered important to undertake coordination among the authorities relatedto the land transport cargo in order to avoid the establishment of regulations that may set obstaclesfor market access of the economic agents.In this sense the competition authority should play a central role in order to disseminate thecompetition concepts through activities to increase the knowledge level and sensitiveness regardingthe benefits of the competition law. It is recommended the establishment of a strategy todisseminate to the general public the benefit of competition for welfare and consumers that allow allagents involved (public, private, trade unions and citizens in general) the possibility to know thisright.a) Cargo transport is crucial for economic performance of a country, particularly of an openeconomy such as that of the Dominican Republic. For its development it is necessary toprovide it with technological, financial and human resources support through public policiesaimed to those ends.Summing up the results of the research indicate preliminarily that the trade union operationIn the cargo transport market restricts the free competition operation since:i) Operating rates are being negotiated for its members by the trade unions restrictingcompetition between operating transport persons and cargo land transport firmsrestricting free competition among them.ii) Establish the zones where transport cargo firms can operate restricting competitionbetween different zones of the country.iii) Press firms to give a proportion of cargo to its affiliates in cases where firms own itscargo transport.iv) They own the control the service of load and download for international and forbuilding materials and impose the celebration of contracts with transport trade unions.Dominant position of FENATRADO in the cargo land transport market make it necessary toproceed to tariff regulations according to its main input costs (namely fuel oil, tires an spare parts)and also to proceed to a tariff revision applied in the different sectors in order to determine andanalyze all its components.12
