LACLETA 35 L'article 17 du Pacte était l'un des articles concernant le règlement des dimerends et il ne faisait que rendre applicable aux Etats non membres le mécanisme de règlement prévu pour les Membres (art. 12 a 16). si I'Etat non membre acceptait l'invitation du Conseil. La Russie n'ayant pas accepté. il n'y avait pas lieu d'appliquer le mécanisme en ce qui concerne le Conseil de la Société ni en ce qui concerne la Cour permanente. La Cour justifiait les règles du Pacte en soulignant que celles-ci ne faisaient que reconnaitre et appliquer un principe qui est a la base méme du droit international : le principe de l'indépendance des Etats : (< II est bien établi en droit international qu'aucun Etat ne saurait être obligé de soumettre ses différends avec les autres Etats soit a la médiation. soit a l'arbitrage. soit enfin a n'importe quel procédé de solution pacifique. sans son consentement. Ce consentement peut être donné une fois pour toutes sous la forme d'une obligation librement acceptee ... [soit] dans un cas déterminé, en dehors de toute obligation préexistante. (C.P.J.I. série B n05, p. 27.) Le Gouvernement espagnol considère que rien n'a modifié cette aflirmation de la Cour permanente. Et s'il est vrai que le Maroc et l'Espagne ont accepté les obligations contenues dans la Charte des Nations Unies et notamment dans son chapitre VI concernant le règlement des différends. on ne pourrait trouver nulle part dans la Charte la déclaration qu'un Etat Membre serait obligé de soumettre un differend avec un autre Etat i la juridiction contentieuse ou consultative de la Cour sans son consentement. La base de la juridiction de la Cour est conventionnelle. et dans la juridiction contentieuse. et dans la juridiction consultative. Dans les deux cas. la Cour doit se trouver devant des manifestations de consentement des Etats. car ce consentement - vous l'avez maintes fois répété - reste a la base cle votre juridiction. Cela a été le cas lors des affaires du Statut de fa Care/ieorienrale, de l'Accès aux écoles minoritaires allemandes en Huuie-Silésie, du Detroii de Cot$ou, de la Reporarion des dommages subis au service des Noiions Uiiies, de Iïnierpré~aiion des traites de paix. de I'Anglo-lranian Oil Co.. etc. Les données de l'affaire du Srarur de la Carélie orieirrale. par rapport a celles de la présente affaire. permetterit de bien mettre en lumiere le problème du consentement dans la juridiction consultative. En ce qui concerne la position des Etats par rapport a l'organe requérant. il est certain que l'Union soviétique avait décide de rester en dehors de la Société des Nations. Dans la présente amaire, tout au contraire. l'Espagne est Membre de l'organisation des Nations Unies et Etat partie au Statut de la Cour, aussi bien que les autres Etals ici représentés. L'élément institutioiinel par conséquent est différent. Par contre. si on tient compte de la nature des questions objet de la requète pour avis consultatif, les données de la présente espèce ne diffèrent pas de celles de l'affaire du Sfarut de /a Carélie orien~ale. Dans le cas d'espèce, de méme que dans l'affaire précitée, la requête pour avis consullatif parait avoir été adoptée au sujet d'un diffërend entre Etats. De ce fait. !'avis ne concerne pas le cadre institutionnel de l'organisation. celui qui intéresse tout Etat Membre. II est aisé de comprendre que par rapport a des questions touchant l'activité de l'organisation, les Etats Membres sont censés avoir donné leur consentement pour que certaines questions soient soumises a la Cour pour avis corisultatif. Ces questions intéressent l'ensemble des Membres de l'organisation. et la requète pour avis consultatif est I'expression de la volonté générale de l'institution requérante. Tel n'est pas le cas quand la question. objet de la requète pour avis consultatir. est en dehors du cadre particulier de IDrga-
